Xi'an Mobile cable is forced to be cut by local operators, and disputes continue

  

Who has the road pole resources, who has the right to cut off the optical cables of other countries?

At the end of March, the broadband facilities of Xi'an Mobile near the second phase of Xinglong Community in Chang'an District were artificially damaged. According to Xi'an Mobile, 11 mobile optical cables were cut off this time.

On April 6, the person in charge of the news center of China Telecom Xi'an Branch (hereinafter referred to as "Xi'an Telecom") said in an interview with the reporter of China Business Daily that the company knew about the relevant situation, but did not respond to this matter more, suggesting that the reporter should learn more from Chang'an Xinglong Police Station.

The staff of Xinglong Police Station in Chang'an District told reporters that China Mobile and China Telecom had reported the case separately and the case was under investigation.

The investigation found that Xi'an Mobile used the communication pipeline and pole road resources of China Telecom, and Xi'an Telecom removed these communication optical cables without authorization after it found them. Such disputes have occurred many times before in Xi'an. The relevant person in charge did not reply.

Mobile optical cable is cut

According to Xi'an Mobile, the 11 optical cables that were cut this time caused 87 mobile base stations to be interrupted at the same time, 11 ring networks to be interrupted, 11 OLTs (optical line terminals) and 160 ONUs to be out of service. This incident caused 31320 mobile users in the region to be unable to make normal calls and 5123 mobile broadband users to be unable to access the Internet.

On April 6, the reporter saw in Ganhe Village, Chang'an District that dozens of optical cables were put together on the communication poles in two rows of the road, and the previously cut optical cables have basically been repaired.

"We use mobile broadband, and the network was cut off several days ago." Some residents living in Building 16, Phase II of Xinglong Community told reporters that after the network was cut off, she called 10086 for maintenance, only to know that the optical cable was cut.

Xinglong Community is a resettlement project for local villagers after the establishment of Samsung Electronics in Xi'an. The newly built community has 10639 households, making it a competitive place for the three major operators.

According to the property management personnel, in Xinglong Community, Telecom, China Mobile and China Unicom often set up sites and made promises to residents such as "on-site opening".

"Compared with telecommunications, mobile charges are cheaper." Some residents of the community told reporters that before, the price of 50M broadband of Telecom was 169 yuan per month, while the mobile charge was 1200 yuan per year. With the user's self paid cat and other facilities, the package year was close to 1500 yuan, while the price of 10M or 20M broadband was cheaper than that of Telecom.

An employee of Xi'an Mobile doubted that it was because the mobile charges were cheap that someone cut the mobile optical cable.

The person in charge of Xi'an Telecom News Center said that the company knew about cutting the optical cable. She also said that the communication management department and the public security have intervened, and according to the regulations of China Telecom, Xi'an Telecom only accepts interviews with local media in Xi'an.

It is worth noting that after the cable of Xi'an Mobile was cut off, Xi'an Mobile and Xi'an Telecom both lowered the price of broadband charges, and the "battle" between the two sides showed an upward trend.

The company has lowered the monthly price of 50M broadband to 119 yuan, which is 50 yuan lower than the previous price. "This price is only for Xinglong Community," the telecom employee emphasized.

The reporter learned that after Xi'an Telecom cut the tariff, Xi'an Mobile also introduced a new tariff for Xinglong community users on April 7, which is 1200 yuan per year for 50M broadband, and will give users 1200 yuan per year for their calls; 20M broadband is 800 yuan per year and 600 yuan is returned.

An employee of Xi'an Mobile stationed in Xinglong Community said: "We don't want to argue with Telecom anymore. After the optical cable was cut, the company started a new line for Xinglong Community."

Pole road resource disputes for many years

"The national ministries and commissions have made it clear that road pole resources are special resources that need to be actively shared by major operators." A market manager of Xi'an Mobile, who did not want to be named, told reporters that some companies should be severely punished for ignoring subordinate employees' vicious competition by cutting optical cables and other vicious means.

However, in the opinion of an insider of Xi'an Telecom, the cut optical cables are all on the company's own pole road, and the property rights and management rights of these communication facilities belong to the company itself, so it is in compliance with the regulations to clean them up.

In fact, the dispute between Xi'an Telecom and Xi'an Mobile has never stopped with regard to communication pole resources.

On April 8, 2009, Xi'an Telecom issued the Notice on Overall Cleaning up the Occupation of Pipeline and Pole Road Resources in the Whole City, requiring "all maintenance units to check the occupancy of pipeline and pole road resources..." pull the net "... for illegal occupation... remove immediately".

Then on April 23, 2009, Shaanxi Mobile submitted a report on the man-made destruction of the company's optical cable to Shaanxi Provincial Communications Administration.

In July of that year, Shaanxi Communications Administration reported that Xi'an Mobile had occupied 20 communication pipelines such as Gaoxin Road and Keji Road of Xi'an Telecom without authorization, and 3 pole roads such as Airport Road and Jiangcun Road. At the same time, Xi'an Telecom also violated the relevant regulations by dismantling other telecom operators' abuse of communication lines without authorization. Xi'an Telecom was fined 90000 yuan and Xi'an Mobile was fined 40000 yuan.

In December 2010, Shaanxi Communications Administration issued another report, responding to Xi'an Telecom's report in August that the company's communication pipeline was still occupied, and Xi'an Telecom was fined 50000 yuan. On the basis of joint construction and sharing of telecommunications infrastructure, Shaanxi Communications Administration also requires operators not to artificially destroy communication facilities for reasons such as equipment renovation and asset liquidation, and not to use technical means to destroy interconnection.

However, such documents do not seem to play a role in reality, and the incidents of cable cutting of operators in Xi'an market still occur frequently.

In June 2015, the Yuntong network optical cable located in Xi'an Economic Development Zone was cut, resulting in 435 households of 8 buildings in the community being disconnected from the network. The police handling the case confirmed that the cable cutter was a telecommunications employee. The optical cable of China Unicom Qujiang Branch in Longhu Ziducheng Community was cut artificially. In July 2015, the optical cable of Yuntong's computer room in the northern suburb of Xi'an was cut again, causing 435 households in 8 buildings in the community to be disconnected.

Cutting optical cables to solve the problem directly exposes the chaotic situation of disorderly competition and vicious competition in China's communication market.

"Sharing means that the inherent interests will be shaken. In order not to break the monopoly pattern, it is not difficult to understand why some companies use inferior means such as thread trimming." The aforementioned Xi'an Mobile market executives lamented that the communication pole resources are limited, and every enterprise's construction will cause a lot of resource waste. Not only that, but now the residents' awareness is rising, and it is particularly difficult to dig poles in some places.

In July 2014, China Tower Co., Ltd. was established. The purpose of the establishment of the company is to reduce the repeated construction of towers and related infrastructure in the telecommunications industry, and further improve the level of joint construction and sharing of telecommunications infrastructure. However, nearly two years after the establishment of the company, infrastructure disputes among major operators are still common.

"Communication resource sharing is an old problem, and similar conflicts are common everywhere." Fu Liang, an analyst in the telecommunications industry, told reporters that he proposed to formulate relevant policies and plans to promote the compulsory sharing of some communication resources. In addition, the Telecommunications Law and other relevant laws and regulations were introduced to provide legal protection for the industry development during the "13th Five Year Plan" period. He also believed that although the tower company was established, several operators were still responsible for specific businesses, so the integration work was not reflected in the actual operation, and the tower company failed to effectively achieve the expected goals at the beginning of its establishment.
