Three departments: break the community broadband monopoly, and at least three broadband enterprises have equal access

  

Recently, the Beijing Municipal Commission of Housing and Urban Rural Development, the Beijing Municipal Communications Administration and the Beijing Municipal Commission of Economy and Information Technology jointly issued the Notice on Promoting the Implementation of Broadband Access in Residential Districts under Property Management. The issuance of the Notice further accelerated the pace of fiber to the home transformation of existing property management residential quarters, and put the brakes on the monopoly of broadband access in residential quarters.

The Notice stipulates that real estate development enterprises or property service enterprises shall not sign monopoly or exclusive broadband operation agreements with others. On the premise that the equipment room and other infrastructure have multiple access, the property service enterprise should try its best to meet the needs of the owners, ensure that at least three broadband operators have equal access, and disclose the relevant information of broadband access to the owners at a prominent location in the community. The fees charged by property service enterprises in broadband access shall be included in the scope of other business income, and shall be publicized to all owners in the first quarter of each year.

The Notice also puts forward specific requirements for the implementation of broadband operators' access to residential quarters. For residential quarters that have been built and implemented property management, broadband operation enterprises and property service enterprises are required to negotiate clearly on broadband access, construction cooperation, operation and maintenance and other matters. If property service enterprises are required to provide construction cooperation, operation and maintenance and other services, both parties shall sign a contract and pay reasonable fees. Before the access construction, the broadband operation enterprise shall formulate a practical construction scheme based on the actual situation of the community, and the construction can be organized only after the scheme is confirmed by the property service enterprise. During construction, broadband operators are required to properly protect the common parts and common facilities in the community, and repair the damaged ones in time.

The relevant person in charge of the Municipal Commission of Housing and Urban Rural Development said that the municipal (district) construction administrative department and the housing administrative department would strengthen the supervision and management of real estate development enterprises and property service enterprises' behaviors such as blocking broadband access and signing exclusive agreements, and if problems are found, they will be ordered to correct in a timely manner. If the circumstances are serious, they will be recorded as bad behaviors in the enterprise credit information system, And make public exposure. At the same time, the Municipal Communications Administration will also strengthen supervision, supervise the access construction, operation and maintenance of broadband operators, investigate and deal with unqualified operation, signing exclusive agreements and other violations according to law, jointly guarantee the free choice of broadband users, and promote fair competition and sound development of the market.
