After the case of Yan Dabin, the briber voluntarily surrendered to the case and became a hero in the earthquake relief. Recently, the Jiangbei District Court found him guilty of bribery by his unit, sentenced him to one and a half years' imprisonment and suspended his sentence for two years.
Shen Guoqing, born in 1974, is the project manager of the branch of Sichuan Road and Bridge Construction Co., Ltd. In 2006, during the bidding for the New Longmen Bridge Project in Wushan County, Shen Guoqing expressed his hope to Yan Dabin to undertake the project, and promised to give Yan Dabin 2.5 million yuan as long as he won the bid.
Before the Spring Festival in 2007, the project was about to invite bids. Yan Dabin told Shen Guoqing about the base price of the project in advance. In April of that year, Shen Guoqing's company won the bid with more than 63 million yuan, and Shen Guoqing became the project manager of the project.
In order to fulfill their commitment to Yan Dabin, Shen Guoqing and others decided to pay the gratitude fee by signing a false contract. In June of that year, at the instigation of Yan Dabin, Shen Guoqing signed a fake ship leasing contract and a material purchase and sale contract with Peng, the head of Wushan Project Department of Banan Construction Group Co., Ltd. In this way, Shen Guoqing "justifiably" wired 2.5 million yuan to Peng's account, and Peng withdrew the money and handed it to Yan Dabin three times.
After the Yan Dabin case, Shen Guoqing surrendered himself to the Jiangbei District Procuratorate on April 16 this year, and was approved to obtain a guarantor pending trial on April 30. After the Wenchuan earthquake, Shen Guoqing, who lives in Chengdu, Sichuan Province, actively participated in the earthquake relief work and performed extremely well. Later, he was rated as a hero of earthquake relief by Yingxiu Frontline Headquarters of Wenchuan County.
The Jiangbei District Court held that in order to seek illegitimate interests for his unit, Shen Guoqing sent 2.5 million yuan in cash to the staff of the state organs, which has constituted the crime of bribery by the unit. Considering that he voluntarily surrendered and actively provided disaster relief in the Wenchuan earthquake, it can be regarded as meritorious performance. According to relevant laws and regulations, the court held that Shen Guoqing could be given a lighter punishment and suspended sentence, so it made the above judgment.
