In recent years, the procuratorial organs have conscientiously studied and implemented Xi Jinping's thought on the rule of law, more actively responded to the people's urgent problems and anxieties, pressured themselves, taken pragmatic measures, implemented the people-centered approach in every case handling, effectively resolved the contradictions and disputes between letters and visits, effectively maintained judicial justice, and promoted social governance. From January to August this year, the procuratorial organs across the country received 656000 letters and visits from the masses, down 4.2% from the same period in 2019; Among them, 207 thousand repeated letters and visits, accounting for 31.6% of the total number of letters and visits, a decrease of 2.5 percentage points. The highest inspection received 138000 pieces, accounting for 21% of the total number of letters and visits, 0.8 percentage points less than the same period in 2019.

From March 2019 to August this year, the procuratorial organs across the country received 2.425 million letters and visits from the masses, all of which were informed within 7 days of "who has received them and who is handling them", and the response rate of the process or results within 3 months exceeded 90%.

After receiving complaints and appeals, it was a basic requirement to reply to the handling situation in a timely manner. However, due to various reasons such as insufficient working force, most of the letters received by the procuratorial organ from the masses in the past were not replied in a timely manner. In 2019, the Supreme People's Procuratorate proposed "reply to the procedure within 7 days, reply to the process or result within 3 months" of the mass petition, and made a commitment at the National Two Sessions.

Practice has proved that the "reply to every complaint" conforms to the people's urgent expectations, and is conducive to timely and effective resolution of conflicts and maintenance of social harmony and stability. Although there are a large number of letters from the masses, as long as we pay attention to them from the bottom of our hearts, treat them as family members and letters from the masses as family letters, we can not only respond to them one by one, but also do a good job.

The reform of the judicial responsibility system emphasizes that paid leading cadres take the lead in handling cases. The Supreme People's Procuratorate requires the chief procurators of procuratorates at all levels to take the lead in handling cases, and should mainly handle difficult and complicated complaint reporting cases, especially for the poor implementation of the first responsibility, which leads to the upward problem of contradictions. It requires that all complaint reporting cases that first go to the grass-roots procuratorates should be handled by the leaders of the procuratorates, and the contradictions should be resolved in the first step as far as possible. From January 2018 to August this year, the chief procurators of procuratorates at all levels contracted to handle 43000 cases of letters and visits, with a resolution rate of more than 80%, which promoted the solution of a number of "long-standing problems". In 2020, there were 18 cases of top inspection leaders, all of which were resolved properly; Since this year, there have been 22 cases, 18 of which have been resolved.

Leading cadres take the lead in handling difficult and complicated complaint cases, which not only drives a hospital or a region to handle complaint cases with high quality and efficiency, but also can find and solve the deep-seated problems in procuratorial supervision and handling cases, more realistically and optimally solve social conflicts, and maintain fairness and justice.

From January to August this year, the procuratorial organ organized a total of 5036 public hearings, 2.2 times the number of the same period last year. 73.4% of those who said they would stop the lawsuit and visit on the spot after the hearing.

The Supreme People's Procuratorate fully implemented open hearings, invited deputies to the National People's Congress, CPPCC members, people's supervisors, lawyers, representatives of village (neighborhood) committees, experts and scholars, etc. to serve as hearers, conducted targeted hearings on difficult and controversial issues such as the facts of the case, the application of law, and jointly interpreted the law and reasoned, and promoted the formation of joint efforts for handling according to law, third-party judgment, and mass witness, so that fairness and justice can be seen, understood Realistic and sensible.

The procuratorial organ insisted on "hearing should be heard and hearing should be done". In 2020, it organized 4272 public hearings on complaint cases, 3.4 times the number in 2019. 67.6% of the people who said they would not appeal or visit on the spot after the hearing. Since this year, the Supreme People's Procuratorate has also deployed to carry out a regular "simple public hearing", set up a special team of hearing staff, and at the same time of receiving visitors, organize public hearings on the spot, so as to promote that the contradictions between letters and visits can be solved in a timely and effective manner.

This year, procuratorial organs normalized and promoted the substantive resolution of administrative disputes. As of August, 4018 administrative disputes had been resolved, including 40 disputes over 20 years and 212 disputes over 10 years but less than 20 years.

In practice, some accusation and appeal cases have been handled with legal procedures exhausted in form, but the parties' reasonable demands have not been really resolved, resulting in repeated complaints and petitions. In this regard, the procuratorial organ prevents the procedure from simply closing the case with "no violation in the process of handling", practically integrates law, reason and situation, solves the reasonable demands of the masses with "heart" and "substance", truly realizes the unity of political effect, social effect and legal effect of handling complaint cases, and puts the people as the center into practice.

In October 2019, the Supreme People's Procuratorate deployed a special activity of "promoting the substantive resolution of administrative disputes" in view of the fact that some administrative litigation cases in judicial practice have been settled but the disputes have not been resolved, and urged the cases to be settled. By December 2020, the procuratorial organs had substantially resolved 6304 administrative disputes, and concentrated on resolving a number of issues that the people strongly felt worried about.

The procuratorial organ insisted on "rescue as soon as possible", and provided timely help to the needy people who were victims of crime. From January to August this year, 12073 judicial relief cases were handled, and more than 200 million yuan of relief funds were distributed, up 61.2% and 70% respectively year on year.

Some petition people are affected by the case, and their lives are in trouble. Some of them directly become poor and return to poverty. If only legal problems are solved for such cases, contradictions and accumulated grievances are often difficult to resolve. In handling complaints and appeals, procuratorial organs make full use of the Party and state policies to properly handle cases according to law and help solve "difficult" problems. The Supreme People's Procuratorate and the former Poverty Alleviation Office of the State Council countersigned the document, taking judicial assistance as an important measure to help poverty alleviation, adhering to the principle of "rescue as much as possible", providing timely help to people in need who have been harmed by crime, especially for key groups such as minors, the elderly, and the disabled, giving priority to and quickly handling, and giving full play to the role of judicial assistance in "emergency rescue", Let the masses feel the care of the Party and the government, the warmth of justice and the warmth of society. In 2020, procuratorial organs across the country handled more than 20000 cases of judicial assistance and paid more than 400 million yuan in relief funds; 12073 cases were handled from January to August this year, and more than 200 million yuan of relief funds were issued, up 61.2% and 70% respectively year on year, 1.3 times higher than the same period in 2019.

If the procuratorial organ, after careful examination, believes that the original judicial procedure or the handling result is indeed wrong, it shall start the litigation supervision procedure according to law to promote the correction of errors and maintain judicial justice. From October 2020 to August this year, the procuratorial organs cleared up 6290 criminal "pending cases" involving private enterprises.

The procuratorial organs conscientiously handle complaints involving criminal filing and investigation activities. Focus on solving the problems that the petition people strongly reflect that they should intervene in civil economic disputes with the right to handle criminal cases, should not file a case, should not file a case but file a case, and should "hang up a case" for a long time. In October 2019, special clean-up of criminal "pending cases" involving private enterprises was deployed. A total of 2870 cases were identified and 2423 cases were cleared. In October 2020, together with the Ministry of Public Security, a new round of special clean-up was carried out. As of August this year, another 6951 cases had been identified, and 6290 had been cleared.

From January 2018 to August this year, 3881 criminal protests were filed in accordance with the trial supervision procedure, and 2720 were concluded by the courts in the same period, of which 2289 were revised and remanded for retrial, accounting for 84.2% of the number of trials concluded in the same period.
