Please read carefully and choose to accept or reject this agreement. Unless you accept all the terms of this agreement, you have no right to register, log in or use the services covered by this agreement. Your registration, login, use and other behaviors will be deemed as acceptance of this agreement, and you agree to be bound by the terms of this agreement. This agreement stipulates the rights and obligations between Yunmai and the user regarding the "OCR SDK Development Platform" service (hereinafter referred to as the "service"). "User" refers to the main body (including but not limited to individuals, groups, companies, etc.) that registers, logs in and uses the SDK provided for download by the Service. This agreement can be updated by Yunmai at any time. Once the updated agreement terms are published, they will replace the original agreement terms without further notice. Users can check the latest version of the agreement terms on this website. After Yunmai modifies the terms of the agreement, if the user does not accept the modified terms, please stop using the services provided by Yunmai immediately. If the user continues to use the services provided by Yunmai, it will be deemed to accept the modified agreement.
1、 Service content
1.1 Yunmai provides users with existing recognition performance, including business cards, documents, ID cards, driver's licenses, driving licenses, license plates and other OCR SDK downloads, and charges a certain amount of fees according to the number of users.
2、 Instructions
2.1 The OCR SDK downloaded by this service does not contain any malicious code designed to destroy the user's computer data and obtain the user's privacy information, nor does it contain any functional code to track and monitor the user's computer and or operation behavior, nor will it monitor the user's online and offline behavior or disclose the user's privacy.
2.2 The user promises to abide by the following agreements on the premise of abiding by laws and this Agreement:
2.2.1 Do not delete the copyright ownership information and content of the SDK downloaded by the service;
2.2.2 It is not allowed to reverse engineer, reverse assemble, reverse compile, etc. the SDK downloaded by the service;
2.2.3 Do not modify or destroy the original status of the SDK provided for download by the service;
2.2.4 It is not allowed to carry out any behavior endangering network security, including but not limited to: using unauthorized data or entering unauthorized servers/accounts; Entering the public network or other people's operating system without permission and deleting, modifying or adding stored information; Unauthorized attempts to probe, scan, test the weaknesses of the platform and the SDK downloaded by the service or other acts that undermine network security; Attempting to interfere with and disrupt the normal operation of the platform and the SDK downloaded by the service, deliberately spreading malicious programs or viruses, and other acts that disrupt and interfere with normal network information services; Forge TCP/IP packet names or partial names;
2.2.5 Users shall not log in or use the services of Yunmai through third-party compatible software or systems not developed, authorized or recognized by Yunmai, and users shall not use plug-ins and plug-ins not developed, authorized or certified by Yunmai for the services of Yunmai;
2.2.6 Without the written consent of Yunmai, the user shall not use, rent, lend, copy, modify, link, reprint, assemble, publish, publish, set up mirror sites, develop derivative products, works, services related to the SDK provided for download by the service Plug in, plug-in, compatibility, interconnection, etc;
2.2.7 Do not use the SDK provided and downloaded by this service to publish, transmit, disseminate, store content that violates national laws, endangers national security, national unity, social stability, public order and good customs, or any inappropriate, insulting, slanderous, obscene, violent content or any content that violates national laws, regulations and policies;
2.2.8 It is not allowed to use the SDK downloaded by this service to publish, transmit, transmit, store and infringe on others' intellectual property rights, trade secret rights and other legal rights;
2.2.9 Do not use the SDK provided by the service to publish, transmit and disseminate advertising information and junk information;
2.2.10 Without permission, it is not allowed to add, delete, or change the functions or operating effects of the software by modifying or forging the instructions, data, and data packets in the operation of the software works, and disseminate or operate the software used for the above purposes to the public through the information network;
2.2.11 Without the express written authorization of Yunmai, it is not allowed to sell, rent, lend, distribute, transfer or sublicense the enjoyment of this service or related links or profit from the enjoyment of services or service terms, regardless of whether the above use is direct economic or monetary benefits;
2.2.12 Do not use the SDK downloaded by this service and other services provided by Yunmai in any illegal way, for any illegal purpose, or in any way inconsistent with this agreement;
2.2.13 There shall be no other acts in violation of relevant laws and regulations or policies, public order and good customs, public morality, and improper actions considered by Yunmai;
2.2.14 Yunmai will not bear any responsibility for the damage to the rights and interests of a third party or the user himself caused by the above behaviors of the user; If the rights and interests of Yunmai are damaged, Yunmai reserves the right of prosecution.
2.3 The services provided by Yunmai may include advertisements, and users agree to display advertisements provided by Yunmai and third-party suppliers and partners during use. Except as explicitly stipulated by laws and regulations, the user shall be responsible for the transaction based on the advertising information, and Yunmai shall not be responsible for the loss or damage suffered by the user due to the transaction based on the advertising information or the content provided by the aforementioned advertisers.
3、 Statement of Rights
1. The SDK provided by this service is developed by Yunmai. All copyrights of the SDK downloaded by this service, as well as all information content related to the platform, including but not limited to: text expression and its combination, icons, decorations, charts, colors, interface design, layout framework, relevant data, printed materials, or electronic documents, are subject to the copyright law, trademark law, patent law Yunmai enjoys the above intellectual property rights under the protection of anti unfair competition law, corresponding international treaties and other intellectual property laws and regulations.
2. Without the written consent of Yunmai, the user shall not implement, utilize, transfer or license any third party to implement, utilize, transfer the above intellectual property for any profit-making or non-profit purpose. Yunmai reserves the right to investigate the responsibility for the above unlicensed acts.
3. Without the written consent of Yunmai, the user shall not reverse engineer, decompile or disassemble the SDK downloaded by the service, and Yunmai reserves the right to investigate the responsibility for the above unauthorized acts.
4. All other rights not expressly authorized in this Agreement still belong to Yunmai. Users must obtain Yunmai's written consent when using other rights.
5. Except for the explicit provisions in this Agreement, this Agreement does not stipulate the relevant service terms for other services of Cloud Vein other than the SDK downloaded by using this service. There may be separate service terms for these services to regulate. Please understand and confirm separately when using the relevant services. If the user uses the service, it shall be deemed as acceptance of the relevant service terms.
4、 Protection of users' personal privacy information
1. In the process of registering an account or using the service, users may need to fill in, submit or upload some necessary information, such as the identity information required to be filled in by laws, regulations, and regulatory documents (hereinafter referred to as "laws and regulations"). If the information submitted by the user is incomplete or does not comply with laws and regulations, the user may not be able to use the service or be restricted in the process of using the service.
2. Personal privacy information refers to the information involving the user's personal identity or personal privacy, such as the user's real name, ID card number, mobile phone number, mobile device ID code, IP address, etc. Non personal private information refers to the basic recorded information, other general information outside the scope of personal private information, and the above private information that users agree to disclose, such as the user's operation status and usage habits of the service, which are clearly and objectively reflected in the cloud pulse server.
3. It is a consistent system of Yunmai to respect the privacy of users' personal privacy information. Yunmai will take technical measures and other necessary measures to ensure the security of users' personal privacy information and prevent the disclosure, destruction or loss of users' personal privacy information collected in the service. In case of the above circumstances or Yunmai finds that the above circumstances may occur, it will take remedial measures in a timely manner.
4. Yunmai will not disclose or disclose the user's personal privacy information to any third party without the user's consent. Except for the following specific circumstances:
4.1 Yunmai provides users' personal privacy information according to laws and regulations or instructions of competent authorities;
4.2 The disclosure of any personal information caused by the user's informing others of his/her user password or sharing his/her registered account and password with others, or the disclosure of other personal privacy information not caused by Yunmai;
4.3 Users disclose their personal privacy information to a third party by themselves;
4.4 The user reached an agreement with Yunmai and its partners on the use and disclosure of the user's personal privacy information, and Yunmai therefore disclosed the user's personal privacy information to the partners;
4.5 Any leakage of users' personal privacy information due to hacker attacks, computer virus intrusion and other force majeure events.
5. The user agrees that Yunmai can use the user's personal privacy information in the following matters:
5.1 Yunmai sends important notices to users in a timely manner, such as software updates and changes to the terms of this agreement;
5.2 Yunmai conducts internal audit, data analysis and research to improve its products, services and communication with users;
5.3 According to the agreement, Yunmai manages, reviews user information and takes processing measures;
5.4 Other matters specified by applicable laws and regulations.
In addition to the above, Yunmai will not use the user's personal privacy information for any other purpose without the user's prior consent.
6. In order to improve the technology and services of Yunmai and provide users with better service experience, Yunmai can collect and use the user's non personal private information by itself or provide it to a third party.
5、 Service risk and disclaimer
1. For any claim, demand or loss claimed by any third party, including reasonable attorney fees, which is caused or generated by the user's violation of this Agreement or the relevant service terms, the user agrees to compensate Yunmai and its cooperative companies and affiliated companies, and to protect them from damage.
2. Yunmai will not be liable for all losses suffered by the user due to third-party reasons, including but not limited to communication line failure, technical problems, network and terminal failures, system instability and other force majeure reasons.
3. If the normal operation of the service is affected by irresistible events such as technical failure, Yunmai promises to cooperate with relevant units in the first time to deal with and repair in a timely manner, but Yunmai will not be responsible for all losses suffered by users as a result.
4. The user understands and confirms that in the process of using the service, it may encounter risk factors such as force majeure, which may interrupt the service. Force majeure refers to unforeseeable, insurmountable and unavoidable objective events that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, as well as social events such as wars, disturbances, government actions, etc. In case of the above situations, Yunmai will try to cooperate with relevant units at the first time to repair them in a timely manner, but the losses caused to users or third parties will be exempted by Yunmai and its partners to the extent permitted by law.
5. The SDK provided for download by this service, like most Internet software, is affected by differences in factors including but not limited to user reasons, network service quality, social environment, etc., and may be harassed by various security issues, such as harassment in real life caused by others using user information; Other software downloaded and installed by the user or other websites visited by the user contain viruses such as "Trojan Horse", which threatens the security of the user's terminal information and data, and then affects the normal use of the SDK downloaded by the service. Users should strengthen the awareness of information security and user data protection, and pay attention to strengthening password protection to avoid loss and harassment.
6. The user understands and confirms that Yunmai needs to regularly or irregularly overhaul or maintain the "OCR SDK Development Platform" platform or related equipment. If the service is interrupted within a reasonable time due to such circumstances, Yunmai does not need to bear any responsibility for this, but Yunmai should make an announcement in advance.
7. Yunmai has the right to deal with violations or defaults in accordance with laws and regulations and this agreement. This right does not constitute the obligation or commitment of Yunmai. Yunmai cannot guarantee that it will find violations or defaults in a timely manner or deal with them accordingly.
8. The user understands and confirms that Yunmai is not responsible for the quality defects of the following products or services provided by Yunmai to the user and any losses caused by them:
8.1 Services provided by Yunmai to users free of charge;
8.2 Any product or service provided by Yunmai to users.
9. In no case will Yunmai be liable for any indirect, consequential, punitive, incidental, special or punitive damages, including the loss of profits suffered by users using the "OCR SDK Development Platform" (even if Yunmai has been informed of the possibility of such losses). Although this agreement may contain contradictory provisions, Yunmai's full responsibility to the user, regardless of the reason or behavior, will never exceed the fees paid to Yunmai by the user for using the services provided by Yunmai
10. Any other SDK derived software not developed and officially released by Yunmai or authorized by Yunmai and downloaded by this service is illegal. Downloading, installing and using such software may lead to unpredictable risks, and all legal liabilities and disputes arising therefrom have nothing to do with Yunmai.
11. Users must understand that the SDK products provided and downloaded by using this service involve Internet services and may be affected by unstable factors in all aspects. Therefore, there is a risk of service interruption or failure to meet user requirements due to force majeure, terminal virus or hacker attacks, system instability, user location, user shutdown and any other technology, Internet, communication lines and other reasons. Users must bear the above risks, and Yunmai does not guarantee. Yunmai will not assume any responsibility for the consequences of the user's failure to upload or download content, or to send and receive or read information, or to receive and send wrong information.
12. The user must understand that the SDK product downloaded by using this service has the risk of anonymous or pseudonymous information from any other person, including threatening, defamatory, offensive or illegal content or behavior, or infringement of the rights of others (including intellectual property rights). The user must bear the above risks. Yunmai does not make any type of warranty for the service, Whether explicit or implicit, including all implied warranties and conditions relating to the authenticity, merchantability, suitability for a particular purpose, ownership and non infringement of information, Yunmai will not bear any responsibility for any direct, indirect, incidental, special and subsequent damages caused by users' improper or illegal use of services.
13. When the user uses the SDK downloaded by the service or requires Yunmai to provide specific services, the SDK downloaded by the service may call a third-party system to support the user's use or access, and the results of use or access are provided by the third party. Yunmai does not guarantee the security, accuracy, effectiveness and other uncertain risks of the results achieved through third-party system support, Any dispute and damage arising from this has nothing to do with Yunmai, and Yunmai will not bear any responsibility.
14. The information content defined by Yunmai includes: text, software, voice, photos, videos, charts, etc; All contents in the advertisement; The business information provided by Cloud Pulse for users. All such content is protected by copyright, trademark rights, and other intellectual property and ownership laws. Therefore, users can only use these content with the authorization of Cloud and advertisers, and cannot copy, modify, edit these content, or create derivative products related to content without authorization.
15. When using the downloaded SDKs and services provided by the service, the user must bear the risk content including but not limited to the following cloud vein uncontrollable:
15.1 Risks such as message delay or loss, login failure, slow page opening, etc. due to unstable network signals, low network bandwidth, etc.
15.2 If the user encounters content quality and security problems when accessing a third-party website using the SDK downloaded from this service, the user shall bear the responsibility.
16. Yunmai hereby reminds:
16.1 The SDK provided for download by using this service must comply with relevant national laws and policies, safeguard national interests, protect national security, and comply with this Agreement. The user shall be fully responsible for all responsibilities arising from the user's illegal use or violation of this Agreement, which has nothing to do with Yunmai; In case of any loss caused to Yunmai, Yunmai has the right to claim compensation from the user and retain relevant records. In addition, for users who violate laws or the relevant service terms of this Agreement, Yunmai has the right to take measures, including but not limited to interrupting the use license, stopping the provision of services, limiting the use, recycling the user account, legal prosecution and other measures, depending on the nature of the user's behavior, without notifying the user in advance. Yunmai has the right to reclaim its account for illegal activities, harassment, cheating other users and other behaviors using the SDK and account downloaded by the service. The user shall bear the loss caused thereby.
16.2 The user shall not log in to use the service through other methods developed without the authorization of Yunmai, including but not limited to illegal compatible software, programs or other ways not expressly permitted by Yunmai. Otherwise, Yunmai has the right to unilaterally terminate the user's use qualification without prior notice to the user.
17. The user agrees that in order to ensure the autonomy of the company's business development and adjustment, Yunmai has the right to modify, suspend, interrupt, cancel or terminate the services provided to the user at any time without notifying the user. If the user or others suffer losses due to the foregoing actions of Yunmai, Yunmai does not have to bear any liability for compensation.
6、 Account management
1. The ownership of the "OCR SDK Development Platform" account belongs to Yunmai. After the user completes the application and registration procedures, he/she obtains the right to use the "OCR SDK Development Platform" account. The right to use the account only belongs to the initial applicant and is not allowed to give, borrow, rent, transfer or sell. It is the user's responsibility to maintain the confidentiality and security of the password and account, and the user shall be fully responsible for all activities using his own password and account. Due to business needs, Yunmai has the right to recycle users' "OCR SDK Development Platform" accounts.
2. The user can change or delete the personal data, registration information and transmission content on the account of "OCR SDK Development Platform", but it should be noted that deleting the relevant information will also delete the text, pictures and other information stored in the system. Users need to bear this risk.
3. The user has the responsibility to properly keep the security of the registered account information and account password. The user may be subject to the theft of the number or password due to improper storage, and the responsibility shall be borne by the user. The user needs to bear legal responsibility for the behavior under the registered account and password. The user agrees not to use another user's account or password under any circumstances. When the user suspects that others use their account or password, the user agrees to notify Yunmai immediately.
4. The user should abide by the terms of this agreement and use the service correctly and appropriately. If the user violates any of the terms of this agreement, Yunmai has the right to suspend or terminate the provision of services to the defaulting user's "OCR SDK Development Platform" account according to the agreement after notifying the user. At the same time, Yunmai reserves the right to withdraw the "OCR SDK Development Platform" account and user name at any time.
7、 Legal liability
1. If Yunmai finds or receives reports or complaints from others about the user's violation of this agreement, Yunmai has the right to review and delete relevant content, including but not limited to user data, without notice, and impose penalties, including but not limited to warnings, account bans, device bans, and function bans, on the offending account depending on the seriousness of the case, and notify the user of the handling results.
2. The user understands and agrees that Yunmai has the right to punish any user who violates relevant laws and regulations or this Agreement in accordance with reasonable judgment, take appropriate legal action against any user who violates laws and regulations, and save relevant information to report to relevant departments in accordance with laws and regulations. The user shall bear all legal liabilities arising therefrom.
3. The user understands and agrees that, for any claim, demand or loss claimed by any third party, including reasonable attorney fees, due to the user's breach of this agreement, the user shall compensate Yunmai, its cooperative companies and affiliated companies, and keep them free from damage.
4. Yunmai solemnly reminds the user to pay attention to the clauses in this agreement that exempt Yunmai from liability and limit the user's rights. Please read carefully and consider risks independently. Minors shall read this Agreement accompanied by their legal guardians.
5. The validity, interpretation and dispute resolution of this agreement shall be applicable to the laws of the People's Republic of China. If there is any dispute or controversy between the user and Yunmai, it should be settled through friendly negotiation first. If the negotiation fails, the user agrees to submit the dispute or controversy to the competent people's court in the place where Yunmai is located for jurisdiction.
6. Any clause of this agreement is invalid or unenforceable for whatever reason, the remaining clauses are still valid and binding on both parties.
