Will Chen be acquitted of the Tsinghua Wife Murder in Silicon Valley?

2/14 Notes

The following are very subjective thoughts and judgments, so they are only published in Sweet House, not synchronized to social media.

What is the nature of this case?

This case belongs to very bad domestic violence, and calls on Silicon Valley Chinese to improve their awareness of domestic violence. I would like to add that domestic violence is a kind of violence. This person killed another person with his fist. It is not any rumor that can be explained and rationalized.

Do you know both parties?

incognizance. My Google friend L knows Chen and thinks that Chen is more social. Chen and Yu's circle of friends in Tsinghua and Silicon Valley are highly overlapping. Friends who knew Chen said they couldn't see it at all. They didn't expect such a tragedy to happen.

Why was Chen absent from the first five summonses?

California law stipulates that the arraignment of felony must be in person, not by a lawyer.

When Chen's lawyer was absent for the fifth time, I saw a reporter on the scene asking that the medical record should be submitted within the first 72 hours of the absence summons. Chen's lawyer said that it should be submitted, and when questioned, he said that he did not have the right to record. I think that interview was a breakthrough.

First, analyze Chen's lawyer's speaking style. The reporter also asked the lawyer whether Chen Fu had been there. At first, the lawyer said that he was not clear, maybe not, but later said that he might have been there once. "There are too many subpoenas" was unclear. From my point of view, Chen's father's social identity is just like that of the Internet, and the photos prove that he was present at the 1/24 interview. Chen's lawyer should be clear about this, but he chose to deny it, so we should be careful to deal with other views he said.

Then back to the fifth subpoena, Chen's lawyer should have known that Chen had submitted medical records, and just because he had not seen them with his own eyes, he picked himself up by spring and autumn writing. His answer, "I don't know what it is", is in a tone that makes people suspect that it is specific.

In other words, Chen submitted medical records as the basis for his absence. This is not contempt for the court, nor is it a special strategy, because the judge is obviously dissatisfied with Chen's repeated absences, and it is not wise to delay time in a simple communication link.

How do you feel when you see Chen at the scene?

His face was expressionless, or rather ashen. His eyes were cold. As a human emotion, he seemed to be pulled away, looking a bit scary. It's hard for normal people to pretend like that.

Combined with his friend's statement of "empty eyes" and abnormal behavior before the crime, I speculate that this may be a physical manifestation of mental illness.

Why did Chen wear a helmet when he attended the summons?

According to the internet, this helmet is "specially prepared for those prisoners who are extremely emotionally unstable in prison and may show suicidal tendencies". However, in the interview of the fifth subpoena, when asked by the reporter whether he committed suicide in the detention center, Chen's lawyer directly smiled and said that it was Rumor's, as if he was answering a very simple question, so I realized that this question and answer was not cut into the released video. In the sixth interview, the lawyer said that Chen's head was injured and he wore a helmet for protection.

If these information are true (big premise!), I can only understand that the medical record submitted by Chen is about mental health. Therefore, although he has no suicidal intention, he still wears a helmet in case.

Predict (blind guess) the trend of the case?

I bet 50 cents that the lawyer will plead innocence according to mental illness.

If the plea of innocence is based on mental illness, will it be found innocent?

There is a precedent of psychopathic homicide in California. In the second half of last year, the perpetrators had just completed all the legal processes. They had a medical history, no bright work or bright education, and were sentenced for more than 20 years:

With this as a reference, the probability of Chen being acquitted is very small.

To say the least, there will be civil proceedings after the criminal proceedings, and the parents of the victims will be awarded a compensation they deserve through visual inspection.

Why should I pay attention to this event?

At the first time when the news came out, before most of the media could find out how old the deceased was and whether the boy was dead, I sent a screenshot of California's public prosecution against Chen in Little Red Book. In the following week, when rumors about Chen's motives were overwhelming and dirty water was poured on girls, my social media flow was used to refute rumors, and hundreds of thousands of posts were read.

I am a truth seeker. My initial motivation was just to let people know the truth. I hoped that the women's family would be helped after contacting them. After they refused media interviews and public donations, I hope that people can continue to pay attention to this case anyway. Therefore, I try my best not to incorporate personal views, but only describe the scene I saw and present the first-hand information taken by my camera.

I participated because their Chinese technological background overlaps with mine in part, and because domestic violence is a female issue that I care about. From the perspective of laws and systems, California has a complete treatment process and safeguard mechanism for domestic violence, but there are still many restrictions on its actual implementation. For example, during the epidemic, the police told me that the prison was overcrowded, and some people would be released if the circumstances were not particularly serious; Now it is said that many places are also full of shelter people who take in victims of domestic violence.

To my satisfaction, among the hundreds of comments received, only one netizen scolded me for scraping traffic, which was much better than my experience had expected. Many netizens thanked me for my first-hand information and praised my good translation, which made me feel embarrassed. It seems that I will continue to run and shoot..

2/9 Site information

Chen himself finally attended, and there was a link to decide whether to plead guilty on April 19.

2/5 Site information

Today, I arrived at the hearing scene, and the man himself was still not present. The prosecutor, the judge and the defendant's lawyer talked quietly for about five minutes, and then the judge announced that the hearing was postponed to Friday.

Sort out the information points:

  • When we arrived at the scene, we learned that the man was absent again, and we discussed with the judge and decided to postpone it to February 9th Friday;
  • The medical records of the man are being obtained, and the mental state is not clear;
  • According to the regulations, medical records must be submitted within the first 72 hours, and the man should have submitted them;
  • I met his father offline and talked with him twice;
  • The father of the man first contacted him by mail. He may have attended the hearing and has now returned to China;
  • It is too early to talk about strategies without ruling out the possibility of mental appraisal and innocent defense.

Personal thoughts:

I don't understand why I was absent again. I thought that the man and his lawyer had discussed the defense strategy and details to delay time together. One possibility is that the lawyer knows something but doesn't get specific records, so he just says he doesn't have permission.

In addition, it seems that the woman's parents did not appear at the scene.

1/29 update

Tsinghua Alumni Association in Silicon Valley is assisting the female parents and said that there is no public fund-raising plan for the time being.

Personally, the energy difference between the two countries is quite large——

  • While family members here are still rushing to apply for humanitarian visas, people on the other side have already arrived at the hearing in Silicon Valley;
  • On the one hand, they hope not to contact the media for the time being, and on the other hand, they will seize the time to arrange public opinion and use industry resources;
  • Although the man's family members are not fluent in language, they resolutely choose white lawyers+translators rather than local Chinese lawyers;
  • The man did not contact the woman's parents to avoid confessing his guilt and suspicion of harassment, and the family members of the latter also lamented why the former was unapologetic;
  • Lawsuits are time-consuming and labor-intensive, and there is also a great demand for funds for intermediate clothing, food, housing and transportation. Ah.

The cognition and execution of the man's family members are amazing. Of course, they can hire the best lawyer for their son within their ability, which is legal and reasonable. They can't ask others to destroy their relatives...

As an ordinary person, it is hard for me to guarantee that I will hang up one day for various reasons. My parents can have a very high awareness of American society, and strive for the right to speak and get their own interests while properly handling things. We are all ordinary people. We hope the world can be gentle.

1/26 update

It was confirmed by several friends of Google that the man's in-service status became a former employee for unknown reasons.

In the afternoon hearing, the man himself did not come, and the date was changed to 2/5. The court specially reiterated the discipline, and could not take photos or videos, "put your cameras down". Videos or screenshots of courts are against California law.

The delay may be good for the wife's family. The man's family members have already appeared in the onlookers' seat at the 1/24 hearing in a low profile (the news has been verified by XHS), while the woman's family members are still urgently applying for visas (public news reports), hoping they can catch up with the hearing.

A new round of rumors about the parties also appeared, so we will refute them here——

The first is the "green card destruction theory". There is an old post posted by other people in three parts of an acre, which is rumoured to be a rumor that the man could not apply for a green card because of the newspaper J. That post mentioned that both parties have children, which is quite different from this event (don't tell me that children refer to cats instead of cats. Normal people don't talk like that when they send serious posts). The case information publicly available in California does not include the record of two people who reported to J.

The other is the so-called UCSD melon with 10w+reading in the first two days of a public number Z, which has no factual basis. The woman is introverted and has a simple life. Just because the school she has studied has produced other wonderful alumni, she can be rumored for no reason. The public number Z has deleted the article on its own due to fear of the legal consequences of rumors.

1/24 update

The Santa Clara court heard again in the afternoon, and the number of online viewers was full. The man no show, the judge said to reschedule again.

My personal understanding is that the meaning of the hearing is to decide whether to prosecute the captured person and complete the handover from J to justice. If the district attorney files a lawsuit, the plaintiff is all the Californian people represented by the public prosecutor, and any party, including the victim, cannot withdraw the case.

Despite repeated delays, in the case of such serious circumstances and sufficient evidence, the probability of the man being prosecuted is 99.9%. And because the man confessed his crime to Richard at the first scene and at the first time, it was difficult to overturn the case even if he paid the most top lawyer. The essence of American arrest is that suspects wait for their lawyers to arrive without saying a word...

1/20 update

Local Chinese organizations in Silicon Valley have participated in the follow-up help.

1/19 Updated

In the afternoon of hearing in Santa Clara court, the public can access by phone. The boy did not appear in court and is said to be still in hospital. The hearing ended after ten minutes, and the meeting was rescheduled to the afternoon of the 24th.

Original answer

Local people in Silicon Valley are tired of refuting rumours, and highly praised for talking about layoffs, but the truth is not [suicide caused by layoffs] but [murder].

According to information publicly available in California, the name of the boy is proposed to be prosecuted. The girl in question has died. In California, the dead cannot be prosecuted, which means that at least the boy was still alive and suspected of felony.

This is reported by the local mainstream media. The words are precise, and the description of boys killing girls with their bare hands is still shocking:

According to the local records (the most reliable information source), the crime was committed in Santa Clara, where migrant workers from large factories gathered. Not Los Altos, it's another case.

Please don't believe the rumors, and don't make use of them to lay off employees.
