The spring was just in time, but the pear trees with blooming flowers and snows were very lively. People gathered together. It was the People's Court of Fengxian County Come to mediate the dispute.
Orchard Circuit Judicial Team of Fengxian People's Court
Lao Bao, a businessman, has been engaged in special fertilizer and pesticide for fruits in Dashahe Town for more than ten years, and local fruit farmers mostly buy pesticides, fertilizers, fruit seedlings and other necessities for fruit production and operation in their stores.
In 2021, Uncle Cui, who is over 70 years old, wants to plant some pear trees to subsidize his family, so he will buy pesticides and sprouts on credit from the old bag and issue an IOU. Later, Uncle Cui found that the grafting success rate was low, so he suspected that there was a quality problem with the bud pieces and was unwilling to pay the payment to Lao Bao. Lao Bao felt that the amount of goods on credit was not large and he was not in a hurry, so he put the matter on hold.
Near the golden period of pear tree pollination, the Orchard Circuit Court gave full play to the advantages of "court branch" and "grid member", strengthened contact with each township and village branch, and systematically sorted out possible fruit related disputes. Uncle Cui's "IOU" was recently found in the "Spear Tune" center of the town during the investigation of Spear Dun.
The court learned that Lao Bao had not only the IOUs of Uncle Cui, but also the IOUs of more than ten people, including Song, Wang and Tian, who owed pesticide money on credit. Although the amount was not large, it would not be a solution in the long run.
Guo Xin, the president of the court, decided to contact both parties to organize mediation and solve the "IOU" issue. Considering that Uncle Cui is old and his hearing has declined, his son will participate in the mediation as his agent.

"Everyone is from the neighborhood, so why should we fight to win? If we encounter problems in the future, we should take care of each other, right?" Judge Guo Xin appealed to emotion and reason for the differences in the case. Finally, Uncle Cui's son paid the money to Lao Bao on the spot by WeChat transfer.
Both parties shook hands and made peace, and signed a mediation agreement under the guidance of the court. After the mediation, Judge Guo Xin explained the leaflet of "How Much Fruit Farmers Know about Laws and Regulations" to both parties, and hoped that everyone could act as a "law popularization member" and guide local fertilizer and pesticide dealers and fruit farmers to establish an orderly market trading mechanism through this case as a demonstration case, enhance their legal awareness of safeguarding their legitimate rights and interests, and jointly contribute to the development of the fruit industry.
The plaintiff, Lao Zhang, is a foreigner who has contracted over 70 mu of orchards in Songlou Town for more than six years. In order to meet the needs of fruit storage, self built cold storage and external operation shall be carried out while planting fruit trees. The defendant, Lao Zhao, is a local fruit farmer who contracted and planted more than 20 mu of fruit trees.
In 2023, the apples will have a bumper harvest. In order to sell at an ideal price, Lao Zhao will store 100000 jin of apples in Lao Zhang's cold storage. Considering that we are all old acquaintances, Lao Zhang made verbal agreements on storage costs without written agreements. Later, when Lao Zhao picked up and sold stored apples, he found that some apples had bad fruit, so he was unwilling to pay all the storage fees to Lao Zhang.
After many unsuccessful communications, Lao Zhang dialed the office phone of the Orchard Court.
At the scene of the circuit trial, Judge Wang Qianqian patiently interpreted the law and reasoned, and the two sides changed from a fierce argument to a peaceful conversation. Lao Zhang took the initiative to reduce the storage fees that Lao Zhao should pay, and to save his economic losses while ensuring the minimization of his own cost losses. Lao Zhao also said that the long-term cooperation between the two sides was hard won. Lao Zhang's help is needed for Apple storage in the future, and he agreed to pay the negotiated storage fees as soon as possible.
With the efforts of the court, Lao Zhang took the initiative to withdraw the lawsuit.
Since Lao Zhang seldom signed written contracts with fruit growers in the process of operating the warehousing business, the court gave detailed guidance to Lao Zhang on how to properly safeguard his legitimate rights and interests in the operation, how to sign effective written contracts and other relevant legal knowledge.
The judge answered questions after the case.
"Originally, the lawsuit was about money, but Judge Wang provided more help for my production and operation from the legal perspective, which made me, a fruit farmer from other places, have greater confidence in the development of our local fruit industry!" Lao Zhang said after the mediation ended.
