Android is adjudged to infringe Google or pay Oracle billions of dollars

Phoenix Science and Technology News According to Bloomberg News on March 28, Beijing time, the U.S. Court of Appeals for the Federal Circuit ruled that Google needs to compensate Oracle for billions of dollars in economic losses due to its use of Oracle's Java code in the Android operating system.

The U.S. Court of Appeals for the Federal Circuit ruled Tuesday that Google's use of Java code in Android infringes Oracle's copyright. The case was sent back to a federal court in California to determine Google's compensation amount. Oracle initially asked Google to pay $8.8 billion in damages, but the amount of compensation it seeks may increase.

The dispute between Google and Oracle over the use of Java code for Android has a profound impact on the entire software industry. Mark Schonfeld, a lawyer from the law firm Burns&Levinson, said, "This is a major ruling on the issue of fair use. It is very, very important for the software industry. I think the case will go to the Supreme Court because the ruling made by the Court of Appeal is very controversial."

Dorian Daley, Oracle's general counsel, said in a statement, "The ruling of the federal court supports the basic principles of copyright law and clearly shows that Google has violated the law. This ruling protects the legitimate rights and interests of creators and consumers."

Google and its supporters believe that this ruling will endanger the development of new software and increase the cost of consumers. Google said in a statement, "We are very disappointed that the court overturned the jury's ruling that Java is open and free for all. The Court of Appeal ruled that "Android is free, which does not mean that Google's use of Java API (application programming interface) is non-commercial", saying that Android has generated more than 42 billion dollars in revenue through advertising. The court also said that Google had not made any changes to Oracle's copyrighted materials.

The two sides are expected to have a heated debate on the amount of compensation. Oracle claimed more than $8.8 billion in compensation, while Google claimed that it had made very little profit from Android.

In 2016, a jury in California expressed its support for Google, saying that Google's use of Java code in Android code constitutes "fair use" and should not be investigated by copyright law. Tuesday's appeal court ruling overturned the jury's verdict.

Google may ask the three appellate court judges hearing the case to reconsider their decision, or refer the issue to all judges of the court for decision.
