Paragraphs 1 and 4 of Article 5 of the Marriage Registration Ordinance
Mainland residents who apply for marriage registration shall present the following certificates and supporting materials:
(1) My household register and ID card;
(2) A signed statement that I have no spouse and no direct blood relationship or collateral blood relationship within three generations with the other party.
Foreigners who apply for marriage registration shall present the following certificates and supporting materials:
(1) Their valid passports or other valid international travel documents;
(2) The certificate that I have no spouse issued by the notary office or competent authority of the country where I am located and certified by the embassy (consulate) of the People's Republic of China in that country or the embassy (consulate) of that country in China, or the certificate that I have no spouse issued by the embassy (consulate) of the country where I am located.
Article 4, paragraph 2
If a Chinese citizen marries a foreigner in the mainland of China, or a mainland resident marries a Hong Kong resident, a Macao resident, a Taiwan resident, or an overseas Chinese in the mainland of China, both men and women shall jointly go to the marriage registration office in the place where the mainland resident's permanent residence is located to register their marriage.
How to sue for divorce without marriage certificate and household registration
If there is no marriage certificate or residence booklet, the party concerned should go to the marriage registration authority to apply for a marriage certificate and the public security organ to apply for a residence booklet, and then go to the court to sue for divorce. In a lawsuit, a bill of complaint shall be submitted to the people's court, and copies shall be provided according to the number of defendants.
Article 17 of the Marriage Registration Ordinance
If the marriage certificate or divorce certificate is lost or damaged, the party concerned may apply to the original marriage registration authority or the marriage registration authority in the place where one party's permanent residence is located for a replacement with the household register and identity card. The marriage registration authority shall verify the marriage registration files of the parties and, if it is confirmed to be true, shall reissue the marriage certificate and divorce certificate for the parties.
Advantages and disadvantages of getting a marriage certificate
Getting a marriage certificate does little harm to the woman. The advantage is that various rights and interests can be protected by law, and the relationship between the woman and the woman will be more stable.

2. Spousal rights
In the marriage relationship, both parties have the duty of loyalty, such as bigamy or adultery. The innocent party can request compensation for damages at the time of divorce. At the same time, the criminal law also stipulates the crime of bigamy. But if it is a cohabitation relationship, it is purely a moral issue, and the law does not adjust it.
3. Circumstances requiring marriage certificate
In many areas, marriage certificate, household register, ID card and other documents are required for birth registration. The marriage certificate may also be used in the case of settling down in another place, children entering the home, outbound travel, showing the certificate of joint ownership of property, or immigration and study abroad.
