This agreement is signed by you and our company.

You agree that our company has the right to change the content of this agreement and the rules of the services provided by AliOS, and to push messages and publish on the web（ http://www.alios.cn/ ）And other methods, and shall take effect 30 days from the date of publication; If you continue to use the AliOS service after the effective date of the above changes, it means that you have fully read, understood and accepted the modified agreement and rules, and will also use the AliOS service in accordance with the modified agreement and rules; If you do not agree with the modified agreement and rules, you should immediately stop using AliOS services.

AliOS licensing

On the premise of abiding by this agreement, you are granted a limited, non exclusive right to use AliOS on the intelligent terminal built in this system. This license is only limited to the smart terminal you are currently using. You may not copy AliOS and install it in other devices, nor may you distribute or provide AliOS software to a third party on the network or through other channels.

You shall not, and you agree not to, or cause others to, copy (except as permitted by this License), disassemble, reverse manufacture, disassemble, attempt to export its source code, decode, modify AliOS software or manufacture its derivative works Or any service provided by AliOS software or any part thereof (except as prohibited by applicable laws or the use license terms of open source components that may be included in AliOS software).

You may not rent, lease, lend, sell, redistribute or sublicense AliOS software. However, you can permanently transfer all your license rights to the AliOS software to another party for the transfer of ownership of the intelligent terminal attached with the legal built-in AliOS, provided that: (a) the transfer content must include your legal built-in AliOS intelligent terminal and all AliOS software, including all its components, original media, printed materials and this license; (b) You may not keep all or part of the copies of AliOS software, including copies stored on computers or other storage devices; And (c) the party accepting the AliOS software has read and agreed to accept the terms and conditions of this license.

AliOS Service Usage Guidelines

In order to effectively protect your legitimate rights and interests in using AliOS services, you understand and agree to accept the following rules:

During your use of AliOS service, the content of this agreement, the rules or agreements appearing on AliOS product or function pages, or the content of information (SMS or phone calls, etc.) sent by our company to your mobile phone, including the existing and future agreements or rules that may be published and notified by reasonable means, are the relevant rules for your use of AliOS service, By using the AliOS service, you agree to accept the relevant rules of the AliOS service.

Our company may notify you of the service progress and prompt you to proceed with the next operation by email (or SMS or phone sent to your mobile phone, etc.), but we do not guarantee that you can receive or timely receive the email (or SMS or phone sent to your mobile phone, etc.). Therefore, during the service process, you should log in to the designated location of AliOS in time to view and conduct transaction operations. Our company will not be responsible for any dispute or loss caused by your failure to check and modify or confirm the service status in time or to submit the relevant application, unless otherwise specified by law.

You authorize our company to review your identity and qualification through a third party and obtain relevant information about your use of AliOS services

When you use AliOS services, our company has the right to charge you service fees according to the corresponding service charge introduction, order and/or relevant agreement. The Company has the right to formulate and adjust the service fee. The specific service fee shall be subject to the notice of charging methods listed on the page when you use AliOS services or other written agreements reached between you and the Company.

Your rights and obligations

You have the right to enjoy the Internet technology and information services provided by AliOS, and have the right to receive AliOS technical support, consultation and other services when accepting the services provided by AliOS. See the relevant product introduction of AliOS for the service content.

You should respect the intellectual property rights and other legal rights of the Company and other third parties, and ensure that you will try your best to protect the Company and its shareholders, employees, partners, etc. from being affected or lost by such events in case of violations of the above rights and interests; The company has the right to stop providing services to you and not return any money when you infringe upon the legitimate rights and interests of the company.

You guarantee that when you use AliOS services, you will comply with national and local laws and regulations, industry practices and social public ethics, and will not use the services provided by AliOS to store, publish, and disseminate the following information and content:

Any content (information) that violates national laws, regulations and policies;

Political propaganda and/or news information in violation of national regulations;

Information involving state secrets and/or security;

Feudal superstition and/or obscene, pornographic, indecent information or information abetting crime; "

Gambling with prizes and gambling games;

Information that violates national ethnic and religious policies;

Information that hinders the security of Internet operation;

Information that infringes on the legitimate rights and interests of others and/or other information or content that is detrimental to social order, public security and public morality.

You also promise not to provide any convenience for others to publish the above information content that does not comply with national regulations and/or the AliOS service terms, including but not limited to setting URL, BANNER link, etc.

You acknowledge that AliOS has the right to terminate the provision of services to you and not return any money when you violate the above agreement. If AliOS suffers losses due to your above behaviors, you should compensate.

Using and accessing some functions and services of AliOS software may require you to apply for an AliOS account. In addition, you agree that many functions and services of AliOS software (such as cloud space and application center) will transfer data, which may cause you to generate some traffic, and you may have to bear some traffic costs. You can also check the usage of each function traffic in the mobile phone butler.

You expressly agree to the Privacy Protection Policy issued by the Company and have the right to revise it, and publish it in a reasonable manner.

In order to let you know about your use of AliOS or the services you know, you expressly agree to send you service status notifications, marketing activities and other commercial SMS messages in the form of SMS.

AliOS's rights and obligations

AliOS should provide you with qualified network technology and information services according to the service you choose and the payment.

AliOS has the right to decide on the modification, revision or termination of various AliOS services (collectively referred to as "service adjustment"). If the modification and revision of the above services may affect your existing legal rights and interests, AliOS will issue corresponding advance announcements 30 days in advance and provide you with appropriate solutions to protect your rights and interests; If the above services are terminated, the Company has the right to notify the termination of the services 3 months in advance. AliOS promises to collect, use and protect your user information in strict accordance with the Privacy Protection Policy.

AliOS reserves the right to terminate the service provided to you and terminate your AliOS account if you violate the national and local laws and regulations or the service terms, and in any case, AliOS is not responsible for any indirect, incidental, special and consequential damages.

Special instructions for some services included in AliOS:

The application center and game center are open application platforms, which mainly provide free information storage space services for application developers or providers, and you can browse or download applications on the platform. You agree to use the platform according to law and abide by the rules of the platform;

Cloud space, cloud album, etc. are information storage spaces specially provided for you to store information to the cloud and share pictures and other information with others. You agree to use the platform according to law and abide by the rules of the platform.

The butler application is a tool specially built for you to facilitate your phone management and ensure the security of your phone. This tool can help you monitor the progress of various functions in your phone and provide you with security services. So you agree that the mobile phone steward will have a more in-depth understanding of the use of your mobile phone.

AliOS service interruption or failure

AliOS may fail to operate normally due to the following conditions, which make you unable to use various networking services, and our company will not be liable for damages, except as expressly provided by law. Such conditions include but are not limited to:

The company is in the period of system shutdown maintenance.

The telecommunication equipment fails to transmit data.

The company is unable to perform business due to force majeure factors such as typhoon, earthquake, tsunami, flood, power failure, war and terrorist attacks.

Service interruption or delay caused by hacker attacks, technical adjustment or failure of telecommunications departments, website upgrades, banking problems, etc.

Scope of liability and limitation of liability

The Company is only responsible for the scope of liability listed in this Agreement.

AliOS user information is provided by you. We cannot guarantee the accuracy, timeliness and completeness of the information. You should be fully responsible for your judgment.

Unless otherwise specified by law, we will try our best to ensure that the licensed software and the technology and information involved in it are safe, effective, accurate and reliable. However, due to the existing technology, you understand that our company cannot guarantee AliOS services, including but not limited to the following matters:

AliOS services meet your needs.

AliOS service is free from interference, timely provision or error.

Any products, services, information or other materials you purchased or obtained through AliOS services meet your expectations.

AliOS is perfect without flaws;

The quality and content of services provided by the partner of AliOS services shall be the responsibility of the partner. You understand that the third-party applications or functions preinstalled on AliOS are provided by a third party. If you have any questions, opinions, suggestions, complaints, disputes, etc. about the third-party applications or functions, you must contact and resolve them by yourself.

You should consider and bear the risk of downloading or obtaining any data through the use of AliOS services. You should bear the risk and responsibility of any damage to your intelligent terminal system or loss of data caused by downloading the data according to the law

To the extent permitted by law, the Company shall not be liable for personal damage or indirect, punitive, special and derivative losses (including business losses, loss of earnings, loss of profits, loss of use data or other economic benefits) related to or caused by this Agreement, except as expressly provided by law.

Termination of Agreement and Liability for Breach of Contract

You should understand that using the licensed software according to the scope of authorization, respecting the intellectual property rights of the software and its contents, using the software according to specifications, and performing obligations according to this agreement are the preconditions for you to obtain our licensed software. If you seriously violate any terms in this agreement, we will automatically terminate this agreement and investigate your liability for breach of contract.

Your use of the software depends on the supporting services provided for you by our affiliated companies. If you violate the terms, agreements, rules, announcements and other relevant provisions of our company or other affiliated companies or websites, and are terminated by any of the above companies, it may lead to your inability to use the licensed software normally. Our company has the right to terminate this agreement, And the affiliated company may terminate providing relevant services to you according to your breach of contract

You understand that for the purpose of maintaining the order of the platform and protecting the rights and interests of consumers, if you make any form of commitment to us and (or) our affiliated companies, and the related companies have confirmed that you have violated the commitment and notified us to deal with it according to your relevant agreements, Then we can take restrictive measures on your use license and other rights and interests that we can control according to your commitment or agreement, including suspending or terminating your use license.

Once you violate this agreement or other agreements signed with us, we can notify our affiliates to require them to take restrictive measures against your rights and interests, including requiring them to suspend or terminate the provision of some or all services to you, and publicize your breach of contract in accordance with the law on the website they operate or actually control.

Upon the termination of this Agreement, you shall stop any use of AliOS and destroy all copies of AliOS.

If you violate any of the terms of this agreement and cause losses to us or other users, you must bear all the liability for compensation. If we assume the above responsibilities, you agree to compensate us for relevant expenses and losses, including reasonable attorney fees.

Entire Agreement

This agreement consists of the terms of this agreement and the rules publicized for the services provided by AliOS. Relevant terms can be referred to each other. In case of different understandings, the terms of this agreement shall prevail.

If you understand and agree with this agreement, you will understand and agree with all the components of this agreement. Once you use AliOS services, you and the company will be bound by all the components of this agreement.

If some contents of this agreement are found illegal by a court with jurisdiction, the validity of other contents will not be affected, and you and we shall still perform in good faith.

Protection of trademarks and intellectual property rights

Except for third-party products or services, all content on AliOS, including but not limited to works, pictures, files, information, data, architecture, and page design, is legally owned by the Company or its affiliates, including but not limited to trademark rights, patent rights, copyrights, trade secrets, etc.

Without the written consent of the Company or its affiliates, no one is allowed to use, modify, copy, publicly disseminate, change, distribute, distribute or publicly publish AliOS programs or content.

Respect for intellectual property rights is the obligation of our company and you. In case of violation, both parties shall bear their own risks and responsibilities according to the law.

Applicable law and jurisdiction

The validity, interpretation, change, implementation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If there are no relevant laws, the general international business practices and/or industry practices shall be referred to. This agreement is signed by you and us in Yuhang District, Hangzhou City, Zhejiang Province, where our server is located. Any dispute arising from or in connection with this Agreement shall be settled through friendly negotiation with us or submitted to the people's court with jurisdiction for adjudication.

We have the right to change the subject who provides software services to you according to business adjustment. The changed subject will jointly perform this agreement with you and provide services to you. The above changes will not affect your rights and interests under this agreement. In case of a dispute, you can determine the subject of your performance and the other party to the dispute according to the service you use and the specific behavior object that affects your rights and interests.

All headings in this Agreement are only for the sake of striking and reading convenience, and have no actual meaning, and cannot be used as the basis for interpreting the meaning of this Agreement.

This Agreement is renewed on January 1, 2018.
