Institutional reform plan of the State Council

The Second Plenary Session of the Twentieth Central Committee of the Communist Party of China adopted the Plan for the Reform of Party and State Organs. Deepening the reform of the State Council is an important task. We must follow the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, take strengthening the centralized and unified leadership of the Central Committee of the Communist Party of China as the guide, and take promoting the modernization of the national governance system and governance capability as the guide To promote high-quality development, we need to strengthen the optimization and adjustment of institutional responsibilities in key areas such as science and technology, financial regulation, data management, rural revitalization, intellectual property rights, and aging work, transform government functions, accelerate the construction of a government ruled by law, and provide a strong guarantee for building a socialist modern country in an all-round way and promoting the great rejuvenation of the Chinese nation in an all-round way.

1、 The Ministry of Science and Technology was reorganized. Strengthen the functions of the Ministry of Science and Technology in promoting and improving the new national system, optimizing the whole chain management of scientific and technological innovation, promoting the transformation of scientific and technological achievements, promoting the integration of science and technology with economic and social development, strengthen the macro management responsibilities of strategic planning, institutional reform, resource planning, comprehensive coordination, policies and regulations, supervision and inspection, and retain the national basic research and applied basic research The relevant responsibilities of national laboratory construction, national major science and technology projects, national technology transfer system construction, transfer and transformation of scientific and technological achievements and integration of production, learning and research, regional scientific and technological innovation system construction, scientific and technological supervision and evaluation system construction, scientific research integrity construction, international scientific and technological cooperation, scientific and technological talent team construction, national scientific and technological awards and other related responsibilities remain as the constituent departments of the State Council.

The responsibility of the Ministry of Science and Technology for organizing the formulation of plans and policies for promoting agricultural and rural development through science and technology and guiding rural scientific and technological progress shall be transferred to the Ministry of Agriculture and Rural Areas. The responsibility of the Ministry of Science and Technology for organizing the formulation of plans and policies for promoting social development through science and technology is divided into the National Development and Reform Commission, the Ministry of Ecological Environment, the National Health Commission and other departments. The Ministry of Industry and Information Technology is responsible for organizing the Ministry of Science and Technology to draw up plans and policies for high-tech development and industrialization, guiding the construction of national independent innovation demonstration zones, national high-tech industrial development zones and other science and technology parks, and guiding the development of science and technology services, technology markets, and science and technology intermediary organizations. The Ministry of Science and Technology's responsibility for introducing foreign intelligence will be assigned to the Ministry of Human Resources and Social Security, and the Ministry of Human Resources and Social Security will be attached with the brand of the State Administration of Foreign Experts Affairs.

Deepen the reform of the allocation and use mechanism of financial science and technology funds, improve the implementation of the central financial science and technology plan and the management system of professional institutions, adjust the responsibilities of the Ministry of Science and Technology for the coordination and management of the central financial science and technology plan (special projects, funds, etc.), and coordinate and evaluate the funds for scientific research projects, and transfer the China Rural Technology Development Center under the Ministry of Science and Technology into the Ministry of Agriculture and Rural Areas, The China Biotechnology Development Center is included in the National Health Commission, and the China Agenda 21 Management Center and the High tech Research and Development Center of the Ministry of Science and Technology are included in the National Natural Science Foundation of China.

The National Natural Science Foundation of China is still managed by the Ministry of Science and Technology.

The Ministry of Science and Technology will no longer retain the brand of the State Administration of Foreign Experts Affairs.

2、 The State Financial Supervision and Administration Administration was established. It is responsible for the supervision of the financial industry other than the securities industry, strengthening institutional supervision, behavior supervision, functional supervision, penetration supervision, and continuous supervision, taking overall responsibility for the protection of the rights and interests of financial consumers, strengthening risk management and prevention and disposal, and investigating and punishing violations of laws and regulations according to law, as an institution directly under the State Council.

The State Administration of Financial Supervision and Administration was established on the basis of the China Banking and Insurance Regulatory Commission, and transferred the daily supervision responsibilities of the People's Bank of China on financial holding companies and other financial groups, related financial consumer protection responsibilities, and the investor protection responsibilities of the China Securities Regulatory Commission to the State Administration of Financial Supervision and Administration.

The China Banking and Insurance Regulatory Commission will no longer be retained.

3、 Deepen the reform of local financial supervision system. Establish a local financial supervision system dominated by local dispatched offices of the central financial management department, and optimize the setting and strength allocation of local dispatched offices of the central financial management department. The financial supervision institution set up by the local government is specialized in supervision responsibilities, and no longer attached with the brand of Financial Work Bureau, Financial Office, etc.

4、 The China Securities Regulatory Commission was reorganized into an institution directly under the State Council. The China Securities Regulatory Commission was restructured from a public institution directly under the State Council to an institution directly under the State Council. The China Securities Regulatory Commission shall be responsible for the examination and approval of corporate (enterprise) bond issuance in a unified manner by strengthening the supervision of capital market and incorporating the examination and approval of corporate bond issuance into the National Development and Reform Commission.

5、 We will comprehensively promote the reform of the branches of the People's Bank of China. The People's Bank of China's regional branches and branch business management departments, business management departments directly under the head office and provincial capital city central branches were abolished, provincial branches were set up in 31 provinces (autonomous regions, municipalities directly under the Central Government), and branches in cities specifically designated in the plan were set up in Shenzhen, Dalian, Ningbo, Qingdao, and Xiamen. The Beijing Branch of the People's Bank of China retains the brand of the Business Management Department of the People's Bank of China, and the Shanghai Branch of the People's Bank of China co operates with the Shanghai Headquarters of the People's Bank of China.

The county (city) branch of the People's Bank of China will no longer be retained, and the relevant functions will be transferred to the local (city) central branch of the People's Bank of China. For border areas or areas with large foreign trade settlement and sales of foreign exchange business, relevant management and service functions can be performed in the form of local (municipal) central sub branches of the People's Bank of China according to work needs.

6、 We will improve the management system for state-owned financial capital. According to the relevant regulations on the management of state-owned financial capital contributors, the market operation institutions managed by the central financial management department will be stripped off, and the relevant state-owned financial assets will be transferred to the state-owned financial capital trustee, who will perform the responsibilities of a contributor in accordance with the authorization of the State Council.

7、 Strengthen the unified and standardized management of the staff of the financial management department. The People's Bank of China, the State Administration of Financial Supervision and Administration, the China Securities Regulatory Commission, the State Administration of Foreign Exchange and its branches and agencies all use administrative staffing. The staff are included in the unified and standardized management of national civil servants, and the salary and treatment standards of national civil servants are implemented.

8、 Establish the National Data Bureau. The National Development and Reform Commission is responsible for coordinating and promoting the construction of the data infrastructure system, coordinating the integration, sharing, development and utilization of data resources, and promoting the planning and construction of digital China, the digital economy, and the digital society.

The Office of the Central Cyber Security and Information Technology Commission will be responsible for studying and formulating the digital China construction plan, coordinating and promoting the informatization of public services and social governance, coordinating and promoting the construction of smart cities, coordinating the development, utilization and sharing of important national information resources, and promoting the interconnection of information resources across industries and departments, The responsibilities undertaken by the National Development and Reform Commission to comprehensively promote the development of the digital economy, organize the implementation of the national big data strategy, promote the construction of the basic system of data elements, and promote the layout and construction of digital infrastructure are included in the National Data Bureau.

9、 Optimize the responsibilities of the Ministry of Agriculture and Rural Affairs. In order to make overall efforts to focus on the work of "agriculture, rural areas and farmers" focusing on rural revitalization, accelerate the construction of an agricultural power, take the lead of the National Bureau of Rural Revitalization to carry out poverty prevention monitoring and assistance, organize the drafting of assistance policies for key counties and areas in rural revitalization, and organize the cooperation, counterpart support and social assistance between the East and the West, To study and put forward a proposal for the central finance to link up and promote the allocation of funds related to rural revitalization, guide and supervise the use of funds, promote the development of rural assistance industries, promote the development of rural social undertakings and public services, and other responsibilities are included in the Ministry of Agriculture and Rural Affairs, and the Ministry of Agriculture and Rural Affairs is attached with the brand of the National Rural Revitalization Bureau.

During the transition period after the completion of the national poverty alleviation goals, the relevant assistance policies, financial support, and project arrangements remained generally stable, and the fund projects were operated and managed relatively independently.

The separate National Bureau for Rural Development will no longer be retained.

10、 We will improve the work system for the elderly. Implement the national strategy of actively responding to population aging, promote the realization of basic elderly care services for all the elderly, and assign the responsibility of the National Health Commission to formulate and coordinate the implementation of policies and measures to respond to population aging, and undertake the specific work of the National Working Committee on Aging to the Ministry of Civil Affairs. The Office of the National Working Committee on Ageing was set up in the Ministry of Civil Affairs to strengthen its responsibilities of comprehensive coordination, supervision and guidance, and organization to promote the development of the cause of ageing.

The Chinese Association for the Aged was entrusted by the Ministry of Civil Affairs.

11、 We will improve the intellectual property management system. Accelerate the construction of a powerful intellectual property country, comprehensively improve the level of intellectual property creation, application, protection, management and service, and adjust the State Intellectual Property Office, which is managed by the State Market Supervision and Administration Administration, to an institution directly under the State Council. Law enforcement responsibilities in trademark, patent and other fields continue to be undertaken by the comprehensive law enforcement team of market supervision, and relevant law enforcement work is subject to the professional guidance of the State Intellectual Property Office.

12、 The National Bureau of Letters and Calls was adjusted to be an institution directly under the State Council. We will implement the Party's mass line for the new era, strengthen and improve people's complaint reporting, better safeguard the fundamental interests of the people, and adjust the National Bureau of Letters and Calls, which is managed by the General Office of the State Council, to an institution directly under the State Council.

13、 The staffing of central state organs was reduced. The staffing of all departments of central state organs will be reduced by 5%, and the recovered staffing will be mainly used to strengthen key areas and important work.

After the reform, except for the General Office of the State Council, the State Council still has 26 constituent departments. According to the Organic Law of the State Council, the adjustment and establishment of the Ministry of Science and Technology, the Ministry of Agriculture and Rural Affairs and other constituent departments of the State Council shall be reviewed and approved by the National People's Congress.

The adjustment and establishment of institutions under the State Council other than the State Market Supervision Administration, the State Financial Supervision Administration, the China Securities Regulatory Commission, the State Letters and Calls Bureau, the State Intellectual Property Office, the State Data Bureau, the National Rural Development Bureau and other State Council departments will be reviewed and approved by the newly formed State Council.
