Article 19 Sale of counterfeit goods
[Applicable situation] Selling counterfeit goods refers to the act of selling counterfeit registered trademark goods or pirated goods.

The sale of counterfeit goods will be disposed of as returning the store. At the same time, in order to prevent adverse effects on the public and protect the rights and interests of buyers, Tmall will supervise stores suspected of violating the above situations according to the seriousness of the case.
2 points will be deducted each time if it provides convenience for the sale of counterfeit and pirated goods; If the circumstances are serious, 12 points will be deducted each time.

Rules and Implementation Rules for Improper Use of Rights of Others

Article 30 Improper use of the rights of others:
[Applicable situation] Improper use of others' rights means that the goods or information released by the business are suspected of improper use of others' trademark rights, copyrights, patent rights, portrait rights and other rights, or cause unfair competition.
[Treatment measures] Disposal of illegal goods or information, control of account authority, control of business authority, deduction of points (general violations), deduction of points (serious violations)
[Specific treatment measures]
Improper use of others' rights refers to any of the following behaviors of users:
(1) The merchant improperly uses others' trademark right, copyright, portrait right and other rights in the published commodity information or the store name and domain name used;
(2) Merchants selling goods are suspected of improperly using other people's trademark rights, copyrights, patent rights, portrait rights and other rights;
(3) The commodity information released or other information used by the business causes unfair competition.
If the merchant commits any of the above acts, Tmall will delete the goods or information it publishes that improperly uses the rights of others. At the same time, Tmall will deal with merchants according to the following provisions:
(1) If the merchant improperly uses the rights of others, 2 points will be deducted for general violations each time;
(2) 6 points will be deducted for each general violation if the business improperly uses the rights of others, and 48 points will be deducted for each general violation if the business improperly uses the rights of others for three or more times;
(3) If the circumstances of improper use of other people's rights by a business are especially serious, it shall be deemed as a serious violation and the business shall be dismissed.
The obligee's complaint against the same business within three days regarding the same right shall be deemed as one complaint.
At the same time, Tmall will, depending on the severity of the case, take measures such as closing the account, closing the store, supervising the store, restricting the delivery of goods, restricting the release of goods, restricting website login, restricting the use of Alibaba Wangwang, restricting the sending of messages within the site, and supervising the whole store or individual goods.
