Regulations on the Work of the Party Leadership Group of the Communist Party of China (for Trial Implementation)

general provisions

Article 1 These Regulations are formulated in accordance with the Constitution of the Communist Party of China in order to further standardize the work of the Party Leadership Group, strengthen and improve the Party's leadership, improve the Party's governing ability, and better give play to the Party's leadership core role in taking overall responsibility and coordinating all parties.

Article 2 The leading group of the Party is the leading body set up by the Party in the leading organs of the central and local state organs, people's organizations, economic organizations, cultural organizations, social organizations and other organizations, and plays a leading core role in its own unit.

Article 3 The work of the Party Leadership Group shall follow the following principles:

(1) Adhere to the leadership of the Party and ensure the implementation of the Party's theories, lines, principles and policies;

(2) Adhere to strict governance of the Party in an all-round way, carry out work in accordance with the Party Constitution and other intra party laws and regulations, and implement the responsibility of the Party Leadership Group to manage and govern the Party;

(3) Adhere to democratic centralism and ensure the vitality of the Party group and the unity of the Party;

(4) Adhere to the unity of the role of the leading group of the Party as the core of leadership and the leadership of the unit performing its duties in accordance with the Articles of Association, and translate the Party's propositions into the decisions of the leadership of the unit through legal and democratic procedures.

Article 4 The leading group of the Party must obey the leadership of the Party organization that approved its establishment. The Central Committee of the Party and local committees at all levels should strengthen their leadership over the work of the leading Party groups. The organization department of the Party Committee is responsible for the specific work of the establishment review and daily management of the Party Leadership Group, and the discipline inspection organ, other work departments of the Party Committee and relevant dispatched offices do a good job of related work according to the division of responsibilities.

Chapter II Establishment

Article 5 If there are more than three leading members of Party members in the leading organs of central and local state organs, people's organizations, economic organizations, cultural organizations, social organizations and other organizations, a leading group of the Party may be established upon approval.

The standing committee of the people's congress at or above the county level, the government and its working departments, the CPPCC, the courts, the procuratorates, trade unions, women's federations and other people's organizations should generally establish a leading party group. Organs of the Standing Committee of the People's Congress, government organs, and CPPCC organs at or above the county level may, with the approval of the Party committee at the corresponding level, establish an organ party group.

Public institutions directly under governments at or above the county level may set up party groups, except for those that should set up grass-roots party organizations according to regulations.

With the approval of the Central Committee of the Communist Party of China, key state-owned enterprises and financial enterprises under the central management can set up party groups, but their subordinate enterprises generally do not set up party groups.

Important national cultural and social organizations may, with the approval of the Central Committee of the Party, establish leading Party groups.

Other organizations other than those specified above may set up a leading party group upon approval due to work needs.

Article 6 The establishment of a leading Party group should generally be examined and approved by the Central Committee of the Party or the local Party committee at the corresponding level. The Party group shall not approve the establishment of the Party group.

For relevant organizations that have set up party groups, if it is really necessary to set up sub party groups in subordinate units due to the needs of industry and system management, the party group shall report to the organization department of the party committee at the same level for approval.

If the newly established relevant organizations meet the conditions for the establishment of a Party group, the Central Committee of the Party or the local Party committee at the same level may make a decision on the establishment of a Party group as needed, or the unit that needs to establish a Party group or its superior competent department may apply for the establishment, and the Central Committee of the Party or the local Party committee at the same level shall make a decision.

If relevant organizations need to change or revoke the Party Leadership Group due to organizational reform, changes in departmental functions, zoning adjustment and other reasons, the Party organization that approved its establishment shall make a timely decision.

Article 7 The leading Party group shall have a secretary and, when necessary, deputy secretaries.

The Secretary of the Party Leadership Group is generally held by the main person in charge of the leading group of the unit. If the main person in charge is not a member of the Communist Party of China or is concurrently held by a superior leader or is not suitable for other reasons, the Secretary of the Party Leadership Group and the main person in charge can be divided. Other members of the Party Leadership Group are generally Party cadres from the leading group members of the unit and the leader of the discipline inspection group, and if necessary, the main person in charge of Party members from the important functional departments of the unit or subordinate units can also serve as members of the Party Leadership Group.

The secretary of the Party Leadership Group of state-owned enterprises is determined according to the internal governance structure of the enterprise. The chairman of the board of directors generally holds the concurrent post, while those without a board of directors are generally set up separately from the general manager. Other members of the Party group are generally the party leaders and the head of the discipline inspection group who enter the board of directors, the board of supervisors and the management level according to the work needs.

There are generally 3 to 7 members of the Party Leadership Group, and there are generally no more than 9 members of the Party Leadership Group in units at or above the provincial and ministerial level, key state-owned enterprises and financial enterprises under central management.

Article 8 In addition to meeting the basic requirements of the Party Constitution and the Regulations on the Selection and Appointment of Party and Government Leading Cadres, the members of the Party Leadership Group shall also have a party age of more than 3 years, of which the members of the Party Leadership Group of the departments and bureaus above shall have a party age of more than 5 years.

Members of a leading party group are generally determined by the party organization that approved the establishment of the leading party group. If a unit that implements vertical management or dual leadership establishes a Party group, the appointment and removal of the members of the Party group of its subordinate units shall be carried out in accordance with the cadre management authority. The members of the sub party group shall be determined by the party group of its superior unit. The appointment and removal of the members of the enterprise's Party group shall be carried out in accordance with the cadre management authority.

Chapter III Responsibilities

Article 9 The leading group of the Party should conscientiously perform its political leadership responsibility, do a good job in theoretical armed and ideological and political work, be responsible for studying, publicizing and implementing the Party's theories, lines, principles and policies, implement the decisions and arrangements of the Party Central Committee and the Party organizations at higher levels, and play an important role in steering the direction, managing the overall situation, and ensuring implementation.

Article 10 The Party Leadership Group shall discuss and decide on the following major issues of the unit:

(1) Important matters that need to be reported to the superior party organization, and important matters that the party group, organ and the party organization directly under the subordinate unit need to report;

(2) Internal organization setup, responsibilities, staffing and other matters;

(3) Major decisions, important personnel appointments and dismissals, major project arrangements, use of large funds and other matters;

(4) Important matters in the construction of grass-roots party organizations and party members;

(5) Important matters in ideological work, ideological and political work and spiritual civilization construction;

(6) Important matters in building a clean and honest government and anti-corruption work;

(7) Other major issues that should be discussed and decided by the Party Leadership Group.

Article 11 The Party leading group shall implement the principle of the Party governing cadres, strengthen the construction of the cadre team, improve the cadre training and selection mechanism, strengthen the education and training of cadres, and strictly manage and supervise cadres in accordance with the standards of good cadres who are firm in belief, serve the people, diligent and pragmatic, dare to take responsibility, and honest.

The leading group of the Party should implement the principle of the Party governing talents, and strengthen the construction of the talent team in accordance with the important decisions and arrangements of the Party Central Committee and the Party organizations at higher levels on talent work.

Article 12 The leading group of the Party should strengthen its leadership over the united front work of its own unit and the work of the trade unions, the Communist Youth League, the women's federations and other mass organizations, pay attention to the training and use of non party cadres and talents, better unite and lead non party cadres and the masses, pool wisdom in all aspects, and complete the tasks assigned by the Party Central Committee and higher party organizations.

Article 13 The leading group of the Party should earnestly fulfill the responsibility of the Party to manage the Party and strictly govern the Party, strengthen the leadership over the Party building of the unit, and implement the responsibility system for Party building work. The secretary of the Party group shall perform the duty of the first person responsible for Party building, and other members of the Party group shall do a good job of Party building within the scope of their duties according to the division of labor.

The leading group of the Party should strengthen its guidance on the work of the Party organizations of its own organs and units directly under it, and support the work committees of the Party organs in performing their leadership duties over the work of the Party organizations of the organs and units directly under it.

The Party Leadership Group should earnestly fulfill the main responsibility of building a clean and honest government, and support the discipline inspection and supervision institutions to fulfill their supervision responsibilities.

Article 14 The leading Party group and its members shall strengthen ideological and political construction, firm their ideals and beliefs, and strictly observe political discipline and rules. Seriously carry out political life within the Party, hold democratic life meetings in accordance with regulations, and carry out serious criticism and self-criticism. Strictly implement the provisions of the Central Committee on improving work style and keeping close contact with the masses, and resolutely oppose formalism, bureaucracy, hedonism and extravagance. We will conscientiously strengthen our awareness of thought and action in implementing the requirements of "three strictness and three realities". Strictly abide by the relevant regulations on the incorruptible administration of Party members and leading cadres, and consciously accept the supervision of the Party organization and the Party members and the masses.

Article 15 The party group of the unit that implements vertical management or dual leadership and is dominated by the leaders of the unit at the higher level may discuss and decide on important matters such as the work planning and deployment of the system, institutional setting, management of the cadre team, and construction of a clean and honest party.

Subordinate units set up branch party groups, which can lead the work of the branch party groups.

When the party group of state-owned enterprises discusses and decides on major issues, it shall be consistent with the Company Law, the Enterprise State owned Assets Law and other laws and regulations, and shall be connected with the articles of association. Business management matters are generally decided by the Board of Directors or the management level according to the internal governance structure of the enterprise. Major business management matters involving national macro-control, national development strategy, national security, etc. shall be decided by the Board of Directors or the management level after discussion by the Party Leadership Group.

Article 16 The party group of the standing committee of the people's congress, the party group of the government organ and the party group of the CPPCC organ at or above the county level must obey the leadership of the party organization that approved its establishment, and in the process of performing its duties, it should also accept the leadership of the party group of the standing committee of the people's congress, the party group of the government and the party group of the CPPCC at the corresponding level.

In the process of performing its duties, the party group of the unit that implements vertical management or dual leadership, in addition to accepting the leadership of the party organization that approved its establishment, should also request instructions from the party group of the higher unit of the system or the local party committee at the same level to report on the work of the party.

Article 17 The Secretary of the Party Leadership Group shall preside over the overall work of the Party Leadership Group, be responsible for convening and presiding over meetings of the Party Leadership Group, organizing activities of the Party Leadership Group, and signing and issuing documents of the Party Leadership Group.

The Deputy Secretary of the Party Leadership Group assists the Secretary of the Party Leadership Group in his work and performs relevant duties as entrusted by the Secretary of the Party Leadership Group.

When the Secretary of the Party Leadership Group is vacant, the Party organization at a higher level may designate the Deputy Secretary of the Party Leadership Group or other members of the Party Leadership Group to preside over the daily work of the Party Leadership Group.

Members of the Party Leadership Group shall be responsible for relevant work and exercise relevant functions and powers according to the decision of the Party Leadership Group and the authorization.

Chapter IV Organizational Principles

Article 18 The leading group of the Party must resolutely implement the instructions and decisions of the Central Committee of the Party and the Party organizations at higher levels, resolutely safeguard the authority of the Central Committee of the Party, and ensure that the central decrees are unblocked.

Article 19 Establish and improve the working system of the Party leading group asking for instructions and reporting to the Party organization that approved its establishment. The Party Leadership Group shall make a comprehensive report at least once a year, and in case of major problems, it shall timely ask for instructions and report.

A special report shall be made on the implementation of an important instruction and decision of the Party Central Committee, the Party organization at a higher level and the Party group at a higher level.

Article 20 When making decisions on important issues, the Party Leadership Group shall fully solicit the opinions of the Party organizations of the organs and directly affiliated units, as well as the Party members and the masses of the units, as required. Important information shall be reported in a timely manner.

Article 21 The leading group of the Party shall practise a system of collective leadership. All matters within the scope of the responsibilities of the Party Leadership Group shall be decided by the members of the Party Leadership Group through collective discussion in accordance with the principle that the minority is subordinate to the majority.

The Secretary of the Party Leadership Group shall take the lead in implementing democratic centralism, and shall not override the organization or act arbitrarily. The members of the Party Leadership Group shall conscientiously implement the collective decisions of the Party Leadership Group, dare to take responsibility, dare to be responsible, and earnestly perform their duties.

Article 22 Documents and articles published or reported in the name of the leading party group, and speeches and reports made by members of the leading party group on behalf of the leading party group shall be examined and approved by the leading party group through collective discussion or transmission. Articles related to work that are signed and published by members of the Party group shall be examined and approved in advance by the Party group or the Secretary of the Party group.

The personal opinions expressed by the members of the Party leading group when conducting investigations and studies, inspecting and guiding work or participating in other activities shall conform to the spirit of the decision of the Party leading group.

Chapter V Discussion and Decision making

Article 23 The leading group of the Party should adhere to collective leadership, democratic centralism, individual deliberation, and decisions made at meetings when discussing and making decisions. Major decisions should be fully negotiated, and scientific, democratic, and legal decisions should be made.

The party group shall, in combination with the actual situation of the unit, specify the contents of the proceedings in its working rules and implement list management. The contents of the proceedings can be adjusted according to work needs.

Article 24 When making major decisions, the Party Leadership Group should generally put forward plans on the basis of investigation and research, fully listen to the opinions of all parties, conduct risk assessment and legal compliance review, and make decisions through collective discussion.

The party group shall discuss and decide on the appointment and removal of personnel in strict accordance with the Regulations on the Selection and Appointment of Party and Government Leading Cadres.

Article 25 The decision-making of the Party Leadership Group generally takes the form of a meeting of the Party Leadership Group. Party group meetings are generally held once a month, and can be held at any time in case of important circumstances.

The topics for the meeting of the Party Leadership Group shall be proposed by the Secretary of the Party Leadership Group, or proposed by other members of the Party Leadership Group, and determined after comprehensive consideration by the Secretary of the Party Leadership Group.

Article 26 Party group meetings can be held only when more than half of the members of the Party group are present, and more than two-thirds of the members of the Party group must be present to discuss and decide on the appointment and removal of cadres. Party group members who are unable to attend the meeting for some reason shall ask for leave before the meeting, and important opinions on the topics of the meeting can be expressed in writing. If the topic of a party group meeting involves himself or his relatives and there are other circumstances that need to be avoided, the relevant party group members shall withdraw.

According to work needs, members of the leading group of the unit who are not members of the party group can be invited to attend the party group meeting as nonvoting delegates. The convener of the meeting may designate relevant personnel to attend the meeting as nonvoting delegates according to the topic of discussion. The Party organization that approved its establishment may send its members to attend the meeting of the Party Leadership Group as nonvoting delegates.

Article 27 The topics of the meeting of the Party Leadership Group shall be fully discussed before being submitted for voting.

Voting can be carried out orally, by a show of hands, by secret ballot or by open ballot. If the affirmative votes exceed half of the members of the Party Group who should be present at the meeting, they shall be passed. The written opinions of the members of the Party Leadership Group who are not present at the meeting shall not be counted into the number of votes. The system of the last position of the chairperson is adopted for voting. If the meeting considers and decides on several matters, it shall vote item by item.

Party group meetings shall be truthfully recorded by special personnel and filed for future reference according to regulations.

Article 28 Once a decision of the Party Leadership Group is made, it shall be resolutely implemented. If members of the Party Leadership Group have different opinions on the decision of the Party Leadership Group, they may reserve or report to the superior Party organization, but they should resolutely implement the decision before it is changed. The leading group of the Party should establish an effective supervision and feedback mechanism to ensure the implementation of its decisions.

Chapter VI Accountability

Article 29 Establish a system for the Secretary of the Party Leadership Group to report on his/her work. Party organizations that have approved the establishment of the Party Leadership Group may, if necessary, listen to the report of the Secretary of the Party Leadership Group on their performance of duties.

The Party organization that approved the establishment of the Party group shall be responsible for establishing a system for assessing the performance of the Party group and its members, with the participation of the discipline inspection organ, the relevant working departments of the Party committee, and the working committee of the Party organ. The assessment shall be carried out once a year, which can be carried out in combination with the work report of the Party Leadership Group, the annual assessment of the leadership and the democratic life meeting.

The implementation of these Regulations by the Party leading group and its members shall consciously accept the supervision of the discipline inspection organ and its post, the grass-roots Party organization of the unit and the party members and the masses, and shall be included in the scope of patrol supervision and the content of regular review by the party members.

Article 30 Under any of the following circumstances, the relevant members of the leading Party group shall be held accountable:

(1) Failing to implement the Party's theories, lines, principles and policies, and the instructions and decisions of the superior Party organizations in a timely and effective manner;

(2) Major losses or adverse effects caused by violation of decision-making procedures or decision-making errors;

(3) Major problems arise in the selection and appointment of cadres;

(4) Failing to earnestly fulfill the responsibility of strict governance of the Party, resulting in weakness and laxity of the Party organization of the unit and weakening of the Party building work;

(5) Failing to perform the main responsibility of building a clean and honest government, causing serious consequences;

(6) Unauthorized public publication or publication of speeches, reports, articles or works that are inconsistent with the spirit of the Central Committee or the decisions of the Party Leadership Group, or publication of statements on the Internet that are inconsistent with the spirit of the Central Committee or the decisions of the Party Leadership Group;

(7) Disclosing confidential meeting contents and discussions;

(8) Responsible for other acts that cause serious consequences or adverse social impact.

In case of collective violation of these Regulations or gross negligence of other members of the Party Leadership Group in serious violation of these Regulations, the Secretary of the Party Leadership Group shall also be held accountable.

In case of major decision-making mistakes of the Party Leadership Group, the members of the Party Leadership Group participating in the decision-making shall be investigated for lifelong responsibility.

When discussing and deciding on relevant matters, members of the Party group who clearly disapprove of or reserve opinions on major mistakes in decision-making shall be exempted or relieved of responsibility.

Article 31 The members of the Party leading group who violate these Regulations shall, according to the seriousness of the case, be given criticism and education, ordered to make inspections, admonished talks, circulated a notice of criticism or transferred from their posts, ordered to resign, removed from their posts, demoted, etc.

If Party discipline and government discipline responsibilities should be investigated, corresponding Party discipline and government discipline punishments should be given in accordance with the Regulations of the Communist Party of China on Disciplinary Punishment, the Regulations of Administrative Organs on Civil Servants Punishment and other relevant provisions.

Those suspected of breaking the law or committing a crime shall be dealt with in accordance with the relevant laws and regulations of the State.

Chapter VII Party Committee of State Work Department

Article 32 The Party committee of the state work department referred to in this chapter refers to the leading organization set up by the Party in the state work department that exercises centralized and unified leadership over its subordinate units according to the provisions of Article 48 of the Party Constitution, and plays a leading core role in its own department and system.

The party committee of the state work department is a party committee in the nature of a party group, which is directly approved by the higher party organization. It is different from the local and grass-roots committees of the party elected.

Article 33 Party committees may be established in the following state departments and units:

(1) State work departments that exercise centralized and unified leadership over subordinate units;

(2) State work departments that exercise centralized and unified leadership over relevant units as authorized by the central government;

(3) Financial supervision institution;

(4) Other units of the Party committee can be set up according to work needs.

The establishment and revocation of a Party committee should generally be examined and approved by the Central Committee of the Party or the local Party committee at the corresponding level. The Party committees of the state work departments and units that implement vertical management are responsible for approving the establishment and revocation of the Party committees of the subordinate units.

The Party Committee can set up a working organization to be responsible for the daily work of the Party Committee according to needs.

Article 34 In addition to performing the relevant responsibilities of the Party group as stipulated in Chapter III of these Regulations, the Party Committee shall also lead the work of the Party organizations of its own departments and directly subordinate units, lead or guide the work of the Party organizations of its own system, discuss and decide the work planning and deployment of subordinate units, institutional setting, management of the cadre team, construction of a clean and honest party conduct and other important matters.

Article 35 The specific procedures for the establishment and revocation of the Party committee, the allocation of members, organizational principles, discussion and decision-making, accountability and other related matters shall be implemented in accordance with the relevant provisions of these Regulations on the work of the Party Leadership Group.

Chapter VIII Supplementary Provisions

Article 36 The Party committees of all provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Regulations, formulate detailed rules for implementation in combination with the actual situation.

The Party Group (Party Committee) shall, in accordance with these Regulations, formulate and improve its working rules in light of its own actual conditions.

Article 37 The working rules and other normative documents formulated by the party group (party committee) shall be submitted to the party organization that approved its establishment for the record with reference to the "Provisions on the Filing of the CPC's Intra Party Regulations and Normative Documents".

Article 38 These Regulations shall be interpreted by the General Office of the Central Committee in consultation with the Organization Department of the Central Committee.

Article 39 These Regulations shall come into force as of June 11, 2015. Other relevant provisions of the Party Leadership Group (Party Committee) that are inconsistent with these Regulations shall be implemented in accordance with these Regulations.
