In recent years, Taojiang County in Hunan Province has taken people's mediation as an important starting point for the construction of "safe Taojiang", innovated ideas, integrated resources, focused on strengthening the construction of mediation organization positions, continuously expanded the coverage of grass-roots legal services, and firmly built the "first line of defense" to maintain social harmony. Since 2012, the county has mediated more than 2000 contradictions and disputes through mediation committees at all levels every year, with a resolution rate of 98%, and people's satisfaction has gradually increased.
We will improve people's mediation networks at multiple levels. First, strengthen the construction of village level people's mediation organizations. People's mediation committees have been set up in 15 townships and 309 villages (communities) in the county, and mediation groups have been set up in village (residents) groups, forming a mediation network at the county, township (town), village and group levels. The village level mediation committees carry out standardized construction in accordance with the standard of "six have and four implement", and regularly investigate and mediate conflicts and disputes. By moving forward the mediation position, the disputes found out were handled in a timely and effective manner. Second, strengthen the construction of professional people's mediation organizations. Seven professional and industrial people's mediation committees for consumption, traffic accidents, marriage and family, labor and doctor-patient disputes have been established. Mediation institutions have been established in 4 hospitals, 18 police stations, county courts and central courts, county procuratorates and two type districts of the county, and a comprehensive and multi-level network platform has been built to resolve conflicts and disputes. Since its establishment in April 2013, the Road Traffic Accident Mediation Committee has mediated 246 traffic accident disputes, with a success rate of 100%, and achieved zero intensification of traffic accident disputes. The third is to constantly improve the working mechanism of "three coordination linkage". Actively explore and promote the connection and linkage of people's mediation, administrative mediation and judicial mediation, take the establishment of the "three coordination linkage" working mechanism as the fundamental way to resolve social conflicts and maintain social stability through institutional innovation, and establish and improve the "three coordination linkage" working mechanism by strengthening the operation of the mechanism, improving the work network, building a work platform, and implementing work security. This year, by carrying out the special mediation activity of "three mediation linkage contradictions, interest litigation, interest visit to promote peace", a total of 37 cases of three mediation linkage were handled, with a success rate of 100%, and 8 emergencies were successfully resolved, playing a positive role in maintaining social stability.
Take multiple measures to improve people's mediation service capacity. First, improve the professional level of people's mediators. Establish and improve the education and training system, and extensively carry out business training and post training in centralized training, court trial observation, case evaluation, case guidance and other ways. In the first half of this year, 561 people's mediators were organized to focus on learning the theory and skills of conflict mediation, and people's mediators' certificates were issued to qualified personnel for training, so that they could work with certificates. More than 60 people's mediators were organized to go to Xiangtan University Law School for a 4-day closed centralized training. The ability of people's mediators to resolve conflicts and disputes has been effectively enhanced. Second, we will expand the ranks of grassroots people's mediators. We will promote the expansion of full-time mediators from towns to villages, and fully implement the working mechanism of part-time mediators. At present, there are 1172 full-time and part-time people's mediators in the county. At the same time, we continued to develop the volunteer team of civil mediation, encouraged the legal service team to actively participate in the people's mediation work, provided professional professional guidance for the mediation committee to mediate disputes in a timely manner, and effectively improved the quality of people's mediation work. The third is to innovate the way of work incentive. The incentive mechanism of "replacing compensation with awards" was implemented throughout the county, and the Administrative Measures for "Replacing Compensation with Awards" of Village (Community) People's Mediators was printed and issued, which included all cases handled by village (community) mediation committees and professional industry mediation committees into the scope of awards. Since last year, the county financial department has separately budgeted 300000 yuan as the "reward instead of compensation" fund. Each case will be rewarded 30-200 yuan according to the difficulty of the dispute. One case, one compensation will be implemented. The county government will not cap the total amount of rewards, which has well mobilized the enthusiasm and initiative of the mediators. By the end of October, the people's mediation committees at all levels in the county had investigated 4852 disputes, up 77% year on year, and successfully resolved 4846.
Broaden the coverage of people's mediation in various ways. First, strengthen mobile mediation. Innovate the mobile mediation and on-site mediation mode to serve the masses, change from passive response to active attack, actively go deep into village farmers and fields, move the mediation room to any possible place, mediate nearby, and eliminate conflicts and disputes in the bud. This year, 70% of the disputes were settled through on-site mediation. From the original "sitting in the hall for consultation" to the present "visiting doctors and treating patients", mobile mediation has achieved the goal of resolving conflicts at the people's doorstep, and accepting the supervision of the people throughout the process, effectively preventing the intensification of conflicts and disputes. Second, strengthen joint defense and joint debugging. We strengthened communication and consultation with border counties, established the border joint debugging committee of Wutan Town in Taojiang County and Yangjiaotang Town in Anhua County, formulated and established the working mechanism of joint defense and joint debugging in border areas, and achieved the goal of forecasting, preventing and handling conflicts and disputes in border areas first. In the past two years, by carrying out joint defense and joint debugging in successive regions and strengthening cooperation, there have been no mass armed fights, no cases of transferring people to criminal punishments, and no cases of casualties caused by border disputes in border areas, which has effectively maintained social harmony and stability in border areas. The third is to strengthen multi modulation linkage. In addition to giving full play to the role of people's mediators as the main force in the investigation and resolution of conflicts and disputes, a system for legal service workers to participate in the mediation of conflicts and disputes has also been established. Lawyers, grass-roots legal service workers, and legal aid volunteers have been organized to participate in the mediation of conflicts and disputes in villages, enterprises, and industry mediation committees, and served as legal advisers to villages, enterprises, and institutions. Through multiple coordination, a number of accumulated disputes have been effectively resolved, and a number of petition cases have been pacified, making positive contributions to maintaining the social stability of the whole county. Fourth, strengthen the combination of coordination and assistance. The people's mediation has always been integrated into the legal aid work. In accordance with the principle of "mediation first and combination of mediation and assistance", when reviewing and accepting the party's legal aid application, if it is considered that the case can be settled by mediation, the party should be guided to settle the dispute by mediation as far as possible and terminate the dispute in a timely manner. At present, 32 conflicts and disputes of all kinds have been successfully resolved through the combination of assistance and adjustment, which has more timely and efficiently safeguarded the legitimate rights and interests of recipients and promoted social harmony and stability.
