Yayi Intellectual Property User Agreement

Before becoming a user of the intellectual property rights of Yayi, please read the following articles carefully to ensure that you understand and agree to all the contents of this agreement. Yayi Intellectual Property Platform is a comprehensive platform for trademark transfer operated by Shenzhen Yayi Intellectual Property Agency Co., Ltd. (Yayi). Its domain name is yayip.com. The following contents will constitute the service contract terms between you and Shenzhen Yayi Intellectual Property Agency Co., Ltd. 1、 User Registration You agree to this agreement and become a registered user of Yayi's intellectual property right upon successful registration until your account is cancelled. Yayi Intellectual Property may change the terms of this Agreement and the individual service agreements of Yayi Intellectual Property when necessary, and such changes will come into effect after being published on Yayi Intellectual Property or agreed by both parties orally or in writing during the specific service process. You can choose to stop using the services related to the intellectual property of Yayi or cancel your account in the intellectual property of Yayi, otherwise, the intellectual property of Yayi will be deemed that you agree to the changed service terms. The service terms that are not published in the intellectual property rights of Yayi or notified by the intellectual property rights of Yayi in the specific service process will not have legal effect unless a written agreement is signed and is only valid for the parties signing the agreement. 2、 User account You should have full capacity for civil rights and full capacity for civil conduct recognized by the laws of the People's Republic of China, otherwise you and other subjects who can exercise rights or assume responsibilities on your behalf will bear all consequences. To this end, you should provide appropriate proof. If you are a natural person, such proof can be your resident identity card or individual business license. If you are a legal person, such certificate can be your business license. If you are another type of organization, you should provide the corresponding legal certificate. If you use the individual services provided by Yayi Intellectual Property, you may also need to submit other relevant materials and information. In order to provide better services, you can also provide us with other materials and information. We will protect your materials and information in accordance with the privacy policy of Yayi's intellectual property rights. You should protect your account. Unless you have received your advance notice, Yayi Intellectual Property will consider that your account is under your control. If your account is at risk or has suffered losses without your control, please notify Yayi Intellectual Property in a timely and effective manner, and you can ask Yayi Intellectual Property to suspend the service or freeze the account. If you use the Yayi intellectual property account to directly access other websites, you should abide by the service terms of the website. 3、 Account management 1. The ownership of the intellectual property account of Yayi belongs to the intellectual property of Yayi. After the user completes the application for registration, he/she will obtain the right to use the intellectual property account of Yayi. The right to use the intellectual property account only belongs to the initial applicant for registration, and it is forbidden to give, borrow, rent, transfer or sell it. Due to the need of operation, Yayi Intellectual Property has the right to recover the user's account number of Yayi Intellectual Property. 2. Users can change or delete the personal data, registration information and transmission content on the intellectual property account of Yayi, but it should be noted that deleting relevant information will also delete the text and pictures saved in the system. Users need to bear this risk. 3. The user is responsible for keeping the security of the registered account information and the account password properly. The user may be subject to the theft of the account or password due to improper storage, and the responsibility shall be borne by the user. The user needs to bear legal responsibility for the behavior under the registered account and password. The user agrees not to use the account or password of other users under any circumstances. When the user suspects that others use his/her account or password, the user agrees to immediately notify Yayi of the intellectual property rights. 4. The user shall abide by the terms of this agreement and use the service correctly and appropriately. If the user violates any of the terms of this agreement, Yayi Intellectual Property has the right to suspend or terminate the provision of services to the defaulting user's Yayi Intellectual Property account according to the agreement after notifying the user. At the same time, Yayi Intellectual Property reserves the right to withdraw the account number and user name of Yayi Intellectual Property at any time. 5. If the user does not log in one year after registering the account of Yayi intellectual property, after notifying the user, Yayi intellectual property can withdraw the account to avoid waste of resources, and the adverse consequences caused thereby shall be borne by the user. 4、 User responsibility Users must comply with all applicable national laws, local regulations and international standards when using the intellectual property rights of Yayi. The user is fully responsible for all operations and comments made by the user account. After the user cancels the account, he or she should still be responsible for the operations and comments made before the cancellation. Users must follow: (1) The transmission of technical data from within China must comply with relevant Chinese regulations. (2) Use network services for no illegal purpose (3) Do not interfere with or disrupt network services (4) Comply with all network protocols, regulations, procedures and practices for using network services. Users must promise not to transmit any illegal, harassing, slandering, abusive, threatening, injurious, vulgar, obscene and other information. Users are also not allowed to transmit any information that instigates others to commit criminal acts. It is not allowed to conduct any operation that may have any adverse impact on the system of the intellectual property rights of Yayi, and it is not allowed to transmit materials that promote domestic adverse conditions and involve national security. Do not transmit any data that does not comply with local regulations, national laws and international standards. Unlawful access to other computer systems without permission is prohibited. If the user's behavior does not conform to the service terms mentioned above, Yayi Intellectual Property has the unilateral right to freeze or cancel the user's account. Users should bear legal responsibility for their own online behavior. If users spread and spread reactionary, pornographic or other information in violation of national laws on the intellectual property rights of Yayi, the system records of the intellectual property rights of Yayi may be used as evidence of users' violation of laws. 5、 Data storage 1. Yayi intellectual property is not responsible for the user's deletion or storage failure of relevant data in the service. 2. Yayi intellectual property can decide the maximum storage period of the user's data in the service according to the actual situation, and allocate the maximum storage space for the data on the server. Users can back up relevant data in the service according to their own needs. 3. If the user stops using the service or the service terminates, Yayi intellectual property can permanently delete the user's data from the server. After the service is stopped or terminated, Yayi intellectual property has no obligation to return any data to the user. 6、 Risk taking 1. Users understand and agree that Yayi intellectual property only provides users with a platform for information sharing, transmission and acquisition, and users must be responsible for all acts under their registered accounts, including any content transmitted by users and any consequences arising therefrom. Users shall make their own judgments on the intellectual property rights of Yayi and the content in this service, and bear all risks arising from the use of the content, including risks arising from reliance on the correctness, integrity or practicality of the content. Yayi intellectual property rights cannot and will not be liable for any loss or damage caused by users' actions. If the user finds that anyone violates the agreement or uses the service in other improper ways, please immediately report or complain to Yayi Intellectual Property, which will be handled according to the agreement. 2. The user understands and agrees that, due to the needs of business development, Yayi intellectual property reserves the right to unilaterally change, suspend, terminate or revoke all or part of the service content, and the user needs to bear this risk. 7、 Yayi Intellectual Property Services Yayi Intellectual Property provides users with trademark trading, trademark forum and other related services. Users should follow the service rules and page prompts of Yayi Intellectual Property, or directly contact Yayi Intellectual Property for more services. In case of any conflict or special provisions between the individual service agreements of Yayi Intellectual Property and this Agreement, the individual service agreements shall prevail. The service fees of Yayi intellectual property rights are published on Yayi intellectual property rights. Yayi intellectual property rights have the right to unilaterally adjust the price standard according to changes in relevant policies, market conditions, service scope and other reasons. The adjusted items will be updated on Yayi intellectual property rights without additional notice. Yayi Intellectual Property has the right to refuse to provide services to users who do not provide information according to the requirements of Yayi Intellectual Property or do not obey the service rules of Yayi Intellectual Property, and has the right to cancel or freeze the user account. The user has the right to withdraw the unused funds in the intellectual property account of Yayi, but shall not use the intellectual property capital account of Yayi to cash out the credit card funds, and shall not commit other acts in violation of the norms of banks, payment intermediaries and intellectual property funds of Yayi. The order consumed by the user in the Yayi intellectual property account will provide details for the inquiry of funds without any form of fruits. The data of Yayi's intellectual property comes from the Internet, and the copyright belongs to the source website. The platform summarizes the information through technical means to achieve snapshots, which cannot avoid changes in the content of subsequent websites. If the collected data is inconsistent with the site, we will not be responsible. Yayi intellectual property has no obligation to save various account materials and records for users. 8、 Yayi Intellectual Property Exemption Clause Yayi Intellectual Property does not guarantee that the services provided will not be interfered with, timely provided or error free. Yayi intellectual property does not guarantee the marketability and applicability of the trade mark, nor does it guarantee that the trading party actually owns the trade mark. Yayi intellectual property does not verify the real identity of users. Unless the effective legal instruments clearly require and provide corresponding protection, the intellectual property rights of Yayi will comply with the privacy policy and will not provide user information externally. In case of failure to provide various services as agreed due to the following circumstances, Yayi Intellectual Property shall not be liable, including but not limited to: (1) The vacation or system maintenance of the intellectual property announcement of Yayi. (2) The telecommunication equipment fails to transmit data. (3) Failing to provide services due to typhoon, earthquake, tsunami, flood, power failure, war, terrorist attacks and other force majeure factors. (4) The service is interrupted or delayed due to hacker attacks, technical adjustments or failures of the telecommunications department, website upgrades, banking problems and other reasons. 9、 Intellectual property protection Users shall not apply for trademarks, service trademarks, domain names, copyrights, etc. that are the same or similar to the names, logos, brands, distinctive signs, domain names of the intellectual property rights and other services of Yayi in any countries and regions in the world without authorization. Users are not allowed to use, copy, modify, adapt, translate, compile, reprint, and distribute all the contents of Yayi's intellectual property rights without authorization, including but not limited to written works, picture works, photographic works, schematic diagrams, website architecture, website image arrangement, and web design. 10、 Privacy Policy The intellectual property privacy policy of Yayi constitutes the effective content of this agreement. If the privacy policy is adjusted, the latest privacy policy shall apply. 11、 Governing Law and Jurisdiction This Agreement and other individual service agreements shall be governed by the laws of the People's Republic of China. If there are no explicit provisions in the laws, they shall be interpreted in accordance with the service and transaction practices of Yayi's intellectual property rights. In the event that some provisions of the agreement are invalid, other provisions and agreements that are not affected remain valid. The People's Court of Gongshu District, Hangzhou City, Zhejiang Province is the competent court for disputes arising from this Agreement and other single service agreements. 12、 Others Business Day refers to the business day of Yayi Intellectual Property. Unless the vacation is notified by the AII intellectual property announcement, it is generally a rest day applicable to the People's Republic of China and a normal working day other than a legal holiday. The date is calculated using the Gregorian calendar, and the time is calculated using Beijing time. Yayi intellectual property is notified by announcement, and the time of announcement is the time of delivery to users; Remind users through the intellectual property page of Yayi, and the time when the reminder appears is the time of delivery; It shall be delivered to the user through the contact information provided by the user, and the time when the user or its representative signs and the user system receives it is the time of delivery.
