Main Responsibilities of the Supreme People's Procuratorate of the People's Republic of China

The Supreme People's Procuratorate is the highest procuratorial organ, leading the work of local people's procuratorates at various levels and special people's procuratorates, and is responsible and reports on its work to the National People's Congress and its Standing Committee. Its main responsibilities are:

(1) We will thoroughly implement Xi Jinping's Thought on Socialism with Chinese Characteristics for a New Era, the Party's line, principles, policies and deployment, unify the thinking and actions of procuratorial organs, uphold the Party's absolute leadership over procuratorial work, resolutely uphold General Secretary Xi Jinping's core position in the Party Central Committee and the core position of the whole Party, and resolutely uphold the authority and centralized and unified leadership of the Party Central Committee.

(2) Propose bills to the National People's Congress and its Standing Committee according to law, request the Standing Committee of the National People's Congress to interpret laws, and request the Standing Committee of the National People's Congress to review whether administrative regulations, local regulations, autonomous regulations, and separate regulations conform to the Constitution and laws.

(3) To lead the work of local people's procuratorates at various levels and special people's procuratorates. To guide the relevant businesses of the lower level procuratorates, study and formulate procuratorial work guidelines and overall plans, and deploy procuratorial work tasks.

(4) In accordance with the law, the Supreme People's Procuratorate shall exercise the power of investigation over criminal cases directly accepted by it, and lead local people's procuratorates at various levels and special people's procuratorates in the investigation of criminal cases directly accepted by it in accordance with the law.

(5) To review, approve, decide to arrest and initiate public prosecution of major national criminal cases in accordance with the law, and to lead local people's procuratorates at various levels and special people's procuratorates in approving, deciding to arrest and initiating public prosecution of criminal cases.

(6) To be responsible for the legal supervision of criminal, civil and administrative litigation activities undertaken by the Supreme People's Procuratorate and the implementation of effective legal documents such as criminal, civil and administrative judgments and rulings.

(7) To be responsible for the initiation of public interest litigation that should be undertaken by the Supreme People's Procuratorate, and to lead local people's procuratorates at all levels and special people's procuratorates in initiating public interest litigation.

(8) To supervise the activities of the Supreme People's Court in reviewing death sentences.

(9) Examine the cases reported by the provincial people's procuratorates for approval and prosecution, and decide whether to prosecute them.

(10) To be responsible for the legal supervision over law enforcement activities in prisons, detention centers, etc., which should be undertaken by the Supreme People's Procuratorate, and to lead local people's procuratorates at various levels and special people's procuratorates in carrying out legal supervision over law enforcement activities in prisons, detention centers, etc.

(11) To accept complaints and appeals submitted to the Supreme People's Procuratorate, and to lead the procuratorial work of local people's procuratorates at various levels and special people's procuratorates on complaints and appeals.

(12) Review the decisions made by the local people's procuratorates at various levels and the special people's procuratorates in the exercise of procuratorial power and correct wrong decisions.

(13) Explain the specific application of law in procuratorial work and issue guiding cases.

(14) To guide the theoretical research work of procuratorial organs throughout the country.

(15) To be responsible for the team building and ideological and political work of procuratorial organs. To lead the people's procuratorates at all levels and the special people's procuratorates in managing the work of prosecutors and other procurators according to law, to coordinate with the central competent departments in managing the organizational structure and staffing of the people's procuratorates, to formulate management measures for relevant personnel, and to organize and guide the education and training work of procuratorial organs.

(16) Cooperate with the central competent department in the management and assessment of the chief procurators of the people's procuratorates and special people's procuratorates of provinces, autonomous regions, and municipalities directly under the Central Government, and cooperate with the provincial party committees in the management and assessment of the deputy chief procurators of the people's procuratorates and special people's procuratorates of provinces, autonomous regions, and municipalities directly under the Central Government.

(17) To lead the procuratorial supervision work of local people's procuratorates at various levels and special people's procuratorates.

(18) To plan and guide the financial equipment work of procuratorial organs throughout the country, and guide the procuratorial technical information work of procuratorial organs throughout the country.

(19) To organize foreign exchanges and cooperation of procuratorial organs and carry out relevant international judicial assistance.

(20) To be responsible for other matters that should be undertaken by the Supreme People's Procuratorate.
