China Civil Aviation Passenger and Luggage Domestic Transport Law

(Formulated on January 1, 1985 and revised on February 28, 1996)

general provisions

Article 1 These Rules are formulated in accordance with the Civil Aviation Law of the People's Republic of China in order to strengthen the management of domestic air transport of passengers and luggage, protect the legitimate rights and interests of the carrier and passengers, and maintain normal air transport order.

Article 2 These Rules shall apply to domestic air transport for which remuneration is received for the carriage of passengers and baggage by civil aircraft and free domestic air transport with the consent of the carrier.
The term "domestic air transport" as mentioned in these Rules refers to air transport in which the place of departure, agreed stopping place and destination are all within the territory of the People's Republic of China according to the passenger transport contract.

Article 3 The following terms in these Rules shall have the following meanings, unless otherwise specified in the specific provisions or otherwise specified:
(1) "Carrier" refers to the air carrier who fills in and issues the ticket and all air carriers who carry or agree to carry passengers and their baggage listed in the ticket.
(2) "Sales agent" refers to an enterprise engaged in civil air transport sales agency business.
(3) "Ground service agent" refers to an enterprise engaged in ground service agency business of civil air transport.
(4) "Passenger" means any person other than crew members who is carried on board a civil aircraft with the consent of the carrier.
(5) "Group passengers" refer to passengers with more than 10 people (including 10 people) in a unified organization who have the same flight distance, boarding date and flight.
(6) "Child" means a person who has reached the age of two but not the age of twelve.
(7) "Baby" refers to a person under the age of two years.
(8) "Seating reservation" refers to the reservation of seats, class of accommodation, or weight and volume of baggage for passengers.
(9) "Contract unit" refers to the unit that signs the reservation and ticket purchase contract with the carrier.
(10) "Flight" refers to the regular flight of the aircraft according to the specified route, date and time.
(11) "Passenger reservation form" refers to the business document that must be filled out by the passenger before purchasing the ticket for the carrier or its sales agent to handle the reservation and fill in and issue the ticket.
(12) "Valid identity document" refers to the document required by the competent government department to prove the identity of passengers when purchasing tickets and boarding. For example: resident identity card, valid passport, officer card, police officer card, soldier card, civilian cadre or retired cadre certificate that can be used according to regulations, student card, household register and other certificates for minors under 16 years of age.
(13) "Passenger ticket" refers to the voucher called "passenger ticket" and baggage filled and issued by or on behalf of the carrier, including the conditions of the transport contract, declaration, notice, passenger coupon and passenger coupon.
(14) "Connecting ticket" refers to the ticket with two or more flights listed.
(15) "Round trip ticket" refers to the ticket that returns to the original place of departure on the original voyage from the place of departure to the place of destination.
(16) "Scheduled ticket" refers to the ticket that lists the flight, the date of taking the flight and the reserved seat.
(17) "Non scheduled ticket" refers to a ticket that does not specify the flight, flight date and seat.
(18) "Flight coupon" refers to the part of the ticket marked "applicable to transportation", indicating that the flight coupon is applicable to transportation between two designated places.
(19) Passenger coupon "refers to the part marked with" passenger coupon "in the passenger, which is always held by the passenger.
(20) "Missed flight" means that the passenger fails to complete the check-in procedures within the specified time or fails to board because the travel document does not meet the requirements.
(21) "Missed flight" means that the passenger fails to board the designated flight after check-in at the departure station or when passing through the stop.
(22) "Wrong flight" means that the passenger has taken a flight that is not listed on the ticket.
(23) "Luggage" refers to articles and other personal belongings carried by passengers for the purpose of dressing, using, comfort or convenience during travel. Unless otherwise specified, it includes checked baggage and self baggage of passengers.
(24) "Checked baggage" refers to the baggage that the passenger hands over to the carrier for care and transportation and fills in the baggage check.
(25) "Self care baggage" refers to the baggage that the passenger is responsible for taking care of with the consent of the carrier.
(26) "Carry on items" refer to small and sporadic items carried by passengers with the consent of the carrier.
(27) "Baggage tag" refers to the sign identifying the baggage and the voucher for the passenger to claim the checked baggage.
(28) "Departure time" refers to the time when flight passengers close the door after boarding.

Article 4 The flight schedule of the carrier shall be announced before implementation. The carrier's flight schedule shall not be changed arbitrarily. However, the carrier may make adjustments according to the specified procedures to ensure flight safety, first aid and other special needs.

Chapter II Reservation

Article 5 After a passenger has booked a seat, he or she shall take the flight with the ticket.
The carrier may specify the time limit for the start and end of a flight to receive reservations, and may suspend the acceptance of reservations for a flight if necessary. The tramp ticket can only be used after the seat is reserved with the carrier.
The contract unit shall reserve seats as agreed in the contract.

Article 6 If the seat has been reserved, the passenger shall purchase the ticket within the time limit specified or agreed in advance by the carrier, and the carrier shall reserve the seat within the time limit specified or agreed in advance.
The carrier shall provide seats according to the flight and class of accommodation booked by passengers.

Article 7 If a passenger holds a connecting or round-trip ticket with a reserved seat and stays at the connecting or round-trip place for more than 72 hours, he/she must go through the seat reconfirmation procedures before 12:00 noon two days before the departure of the connecting or round-trip flight, or the original seat will not be reserved. If the passenger's departure time from the flight at the connecting or return time does not exceed 72 hours, the passenger does not need to go through the seat reconfirmation procedure.

Chapter III Passenger Tickets

Article 8 The ticket is registered and can only be used by the passenger whose name is listed on the ticket, and cannot be transferred or altered, otherwise the ticket will be invalid and the fare will not be refunded. The passenger ticket shall at least include the following contents:
(1) Carrier name;
(2) Name, time and place of the drawer;
(3) Passenger's name;
(4) Flight origin, stop and destination;
(5) Flight number, class, date and departure time;
(6) Ticket price and payment method;
(7) Ticket number;
(8) Transportation instructions.

Article 9 Passengers shall complete all the flights listed on the ticket within the validity period of the ticket.
When using the ticket, the passenger shall submit a valid ticket for inspection, including the flight coupon of the flight segment and all other flight coupons and passenger coupons that are not used and reserved on the ticket. If any of the above coupons is missing, the ticket will be invalid.
For international and domestic interline tickets, the flight coupon of the domestic interline segment can be used in the domestic interline segment without changing into a domestic ticket; A domestic air transport ticket purchased by a passenger outside China and filled out with an international ticket shall be used only after being replaced with a domestic ticket.
The carrier and its sales agent shall not use domestic air transport tickets for sales outside China.
The time ticket is only applicable to the flight date and flight listed on the ticket.

Article 10 The validity period of the passenger ticket is:
(1) The ticket is valid for transportation within one year from the date of travel. If all the tickets are unused, they will be valid for transportation within one year from the date of ticket issuance.
(2) The period of validity shall be calculated from 0:00 on the next day after the travel or the day when the ticket is filled out to 0:00 on the next day after the expiration of the validity period.

Article 11 The carrier and its agent shall be conscientious and responsible when selling tickets.
If the passenger fails to travel within the validity period of the ticket due to the carrier, the validity period of the ticket will be extended until the carrier can arrange the passenger to board the aircraft.

Chapter IV Fares

Article 12 The ticket price refers to the air transportation price of passengers from the airport of departure to the airport of destination, excluding the ground transportation cost between the airport and the urban area. The ticket price is the ticket price applicable on the day when the passenger starts boarding. After the ticket is sold, if the ticket price is adjusted, the fare will not be changed. The fare published in the tariff table is applicable to direct flight transportation. If a passenger requests to stop or transfer to another flight, the fare shall be calculated by adding up the actual flight segment.

Article 13 The passenger shall pay the fare in the currency and payment method specified by the state. Unless otherwise agreed by the carrier and the passenger, the fare shall be paid in cash.

Chapter V Ticket Purchase


Article 14 Passengers shall purchase tickets at the ticket office of the carrier or its sales agent.
When purchasing tickets, passengers shall present their own valid identity documents or other identity documents issued by the public security organ, and fill in the Passenger Reservation Form.
When purchasing child tickets and baby tickets, valid certificates of the birth date of the child and baby shall be provided.
When purchasing tickets for seriously ill passengers, they should hold a certificate issued by the medical unit that is suitable for taking the flight, and they can only purchase tickets with the consent of the carrier.
Each passenger shall fill out a separate ticket.

Article 15 Disabled revolutionary armymen shall purchase tickets at 80% of the applicable ticket price by presenting the "Pension Certificate for Disabled Revolutionary Armymen".
Children shall purchase children's tickets at 50% of the applicable adult ticket price and provide seats.
Babies can buy infant tickets at 10% of the applicable adult ticket price, and no seat is provided; If you need to occupy a seat separately, you should buy a child ticket.
If each adult passenger carries more than one baby, the child ticket shall be purchased for the more than one baby.

Article 16 The carrier or its sales agent shall sell connecting and return tickets according to the requirements of passengers.

Article 17 The ticket office shall be equipped with necessary information such as flight schedule, route map, air tariff and passenger instructions.

Chapter VI Ticket Change

Article 18 If the passenger requests to change the flight, date and class of class after purchasing the ticket, the carrier and its sales agent shall actively handle it according to the actual situation.

Article 19 In case of flight cancellation, advance, delay, change of flight schedule or failure to provide original seats, the carrier shall give priority to passengers to take subsequent flights or transfer flights to other carriers. If the class of the passenger's cabin is changed due to the carrier's reason, the difference between the fare will not be refunded or supplemented.

Article 20 If the passenger wants to change the carrier, he/she shall obtain the consent of the original carrier or the ticket issuer, and sign off if the new carrier's flight seat allows. The circumstances listed in Paragraph 1 of Article 19 of these Rules require the passenger to change the carrier. The endorsement can be carried out only after obtaining the consent of the passenger and the carrier.

Chapter VII Refund

Article 21 If the passenger does not complete part or all of the voyage within the validity period of the ticket due to the carrier or the passenger, he/she may request a refund within the validity period of the ticket.
Passengers who want to refund their tickets should present the "flight coupon" and "passenger coupon" of the ticket or the unused part of the ticket.
Refund can only be handled at the ticket office of the carrier or its sales agent at the place of issue, the place of departure, and the place of termination of travel.
The ticket price can only be refunded to the passenger or the payer listed on the ticket.

Article 22 If a passenger wishes to return a ticket voluntarily, in addition to presenting a valid passenger ticket, he or she shall also provide his or her own valid identity card, which shall be handled according to the following provisions.
(1) If a passenger requests a refund within 24 hours or two hours before the scheduled departure time of the flight, a 10% refund fee will be charged; A refund fee of 2% of the ticket price will be charged if the ticket is returned within two hours before the scheduled departure time of the flight. After the specified departure time of the flight, the ticket shall be refunded and handled as missed flight.
(2) If a passenger with a connecting or round-trip ticket requests a refund, it shall be handled in accordance with the provisions of the first paragraph of this article.
(3) Disabled revolutionary armymen who request refund of their tickets are exempted from refund fees.
(4) Passengers with baby tickets are exempted from refunding.
(5) If a passenger with an irregular ticket requests a refund, he or she shall go to the original place of purchase to go through the refund formalities within the validity period of the ticket.
(6) Passengers will automatically terminate their travel at the stopover of the flight, and the fare for the unused leg of the flight will not be refunded.

Article 23 In case of flight cancellation, advance, delay, flight change, or the carrier's inability to provide the original seat, if the passenger requests a refund, the departure station shall refund all the ticket fare, and the stopover shall refund all the ticket fare for the unused leg, without any refund fee.

Article 24 If a passenger wants to refund a ticket due to illness, he/she shall provide the certificate of the medical unit. The place of departure shall refund all the ticket fare, and the stopover place shall refund all the ticket fare for the unused leg, without charging a refund fee. If the accompanying person of the sick passenger requests to refund the ticket, the first paragraph of this article shall apply.

Chapter VIII Loss of Passenger Tickets

Article 25 If a passenger loses a ticket, he/she shall apply in writing to the carrier or its sales agent for reporting the loss.
The carrier shall not be liable for any fraudulent use or refund of the ticket before the passenger applies for loss reporting.

Article 26 If a scheduled ticket is lost, the passenger shall provide a certificate to the carrier one hour before the scheduled departure time of the flight, and the carrier can reissue a new ticket for the original flight. A supplementary ticket cannot be refunded.

Article 27 If an unscheduled ticket is lost, the passenger shall apply for reporting the loss after providing proof to the original ticket selling place in time, and the ticket selling place shall notify all relevant carriers in time. It is verified that the ticket has not been fraudulently used or returned, and the refund formalities shall be handled within 30 days after the expiry of the ticket.

Chapter IX Group Passengers

Article 28 After the group passengers have booked their seats, they shall purchase tickets within the specified or pre agreed time limit, otherwise, the seats will not be reserved.

Article 29 If a group passenger wishes to refund a ticket after purchasing it, a refund fee shall be charged according to the following provisions:
(1) If group passengers request a refund 72 hours before the specified departure time of the flight, a refund fee of 10% of the passenger ticket price will be charged.
(2) Group passengers request to refund their tickets within 72 hours of the scheduled departure time and before 12:00 noon of the day before the scheduled departure, and charge a 30% refund fee.
(3) A 50% refund fee will be charged for group passengers who ask for a refund after 12:00 p.m. on the day before the scheduled departure time and before the departure of the flight.
(4) Group passengers holding connecting and return tickets who request refund shall be handled in accordance with the provisions of sub paragraphs (1), (2) and (3) of this article respectively.
(5) If the group passenger misses the flight, the ticket will be invalid and the fare will not be refunded.

Article 30 If some members of a group passenger request a ticket refund, they shall be charged a refund fee according to Article 29 of these Rules.

Article 31 The group passengers who are involuntary or some members of the group passengers ask for change or refund due to illness shall be subject to Article 19
Article 32 or 24.

Chapter X Boarding

Article 33 The passenger shall arrive at the airport within the time limit specified by the carrier, and go through the check-in procedures such as ticket inspection, checked baggage, and getting a boarding pass on time with the ticket and his valid identity card. The time specified by the carrier for stopping check-in shall be notified to passengers in an appropriate manner. The carrier shall open the check-in counter on time, accept the ticket issued by the passenger as required, and handle check-in procedures quickly and accurately.

Article 35 Special passengers, such as unaccompanied children, sick and disabled passengers, pregnant women, blind people, deaf people or prisoners, can be carried only with the prior consent of the carrier and if necessary, arrangements made by the carrier. The carrier shall not carry passengers with infectious disease, mental illness or health condition that may endanger itself or affect the safety of other passengers.
The carrier has the right to refuse passengers who cannot board according to the relevant provisions of the state, and the purchased tickets will be refunded voluntarily.

Article 36 Passengers who miss the flight shall be handled according to the following provisions:
(1) In case of missed flight, passengers should go to the airport or the original ticket purchasing place to handle flight change and ticket refund procedures.
(2) If the passenger requests to change to a subsequent flight after missing the flight, the carrier shall actively arrange if there are spare seats on the subsequent flight. No late arrival fee will be charged.
(3) If the passenger misses the flight and asks for a refund, the carrier can charge an appropriate missed flight fee.
Missing passengers shall be handled according to the following provisions:
(1) If the passenger misses the flight due to the passenger's reason and requests to return the ticket, the relevant provisions of the first paragraph of this article shall apply.
(2) If the passenger misses due to the carrier, the carrier shall arrange the passenger to take the subsequent flight as soon as possible. If the passenger requests a refund, the provisions of Article 23 of these Rules shall apply.
Passengers who miss the train shall be handled according to the following provisions:
(1) If the passenger is on the wrong flight, the carrier shall arrange the passenger to take the earliest flight to the destination on the passenger ticket, and the fare will not be refunded without compensation.
(2) If the passenger is wrong due to the carrier, the carrier shall arrange the passenger to take the subsequent flight as soon as possible. If the passenger requests to refund the ticket, it shall be handled according to Article 23 of the Rules

Chapter XI Baggage Transportation

Article 37 The baggage carried by the carrier shall be limited to the items within the scope of Item 23 of Article 3 of these Rules.
The baggage carried by the carrier is divided into checked baggage, self care baggage and carry on items according to the transport responsibility.
Important documents and materials, diplomatic bags, securities, currency, bills of exchange, valuables, fragile and perishable items, and other items that need special care shall not be checked in baggage. The carrier's loss or
The damage shall be compensated according to the general checked baggage.
Prohibited articles, restricted transport articles, dangerous articles, and other articles with peculiar smell or easy to contaminate the aircraft, as stipulated by the state, cannot be checked as baggage or put into baggage. The carrier may refuse to accept the baggage or terminate the transportation at any time if he finds that the baggage contains any items that cannot be transported as baggage or included in the baggage before receiving the baggage or during the transportation.
Passengers are not allowed to carry controlled knives on board. Sharp or blunt tools other than controlled knives shall be checked with checked baggage and cannot be carried with you.

Article 38 Checked baggage must be well packed, well latched, securely bound, able to withstand certain pressure, safely loaded, unloaded and transported under normal operating conditions, and meet the following conditions, otherwise, the carrier may refuse to accept the shipment:
(1) The luggage, bags and handbags must be locked;
(2) Two or more packages cannot be bundled into one;
(3) No other items can be attached to the luggage;
(4) Bamboo baskets, net bags, straw ropes, straw bags, etc. cannot be used as the outsourcing of luggage;
(5) The baggage shall be marked with the passenger's name, detailed address and telephone number.
The weight of checked baggage shall not exceed 50 kg per piece, and the volume shall not exceed 40 kg(
60 (100 cm), baggage exceeding the above requirements can only be checked with the prior consent of the carrier.
The weight of self care baggage shall not exceed 10 kg, and the volume of each piece shall not exceed 20 (40 (55 cm).
The weight of carry on items is limited to 5 kg per passenger. Passengers with first-class tickets can carry two items with them. The volume of each carry on item shall not exceed 20 (40 (55 cm). Carry on items exceeding the above weight, number or volume limits shall be checked as checked baggage.

Article 39 Free baggage allowance for each passenger (including checked and self baggage): 40 kg for first class passengers with adult or child tickets, 30 kg for business class passengers and 20 kg for economy class passengers. There is no free baggage allowance for passengers with baby tickets.
If two or more fellow passengers who take the same flight to the same destination go through baggage check in at the same time and place, their free baggage allowance can be consolidated according to their respective ticket price level standards.
For the domestic leg of international transportation, the free baggage allowance for each passenger shall be calculated according to the applicable free baggage allowance for international routes.

Article 40 Passengers must check their luggage with a valid ticket. The carrier shall indicate the number and weight of checked baggage on the passenger ticket and baggage check.
The carrier shall generally collect and transport baggage when handling check-in procedures on the day of flight departure; If group passengers have too much baggage or need to check in in advance for other reasons, they can agree with the passengers on the time and place for collection.
The carrier shall attach a baggage tag to each piece of baggage checked in by the passenger, and give the identification copy to the passenger. The self care baggage agreed by the carrier shall be weighed together with the checked baggage, and then handed over to the passengers to take care of themselves in the cabin, with self care baggage tags attached to the baggage.
Articles not belonging to baggage shall be checked as cargo and cannot be checked as baggage.

Article 41 Excess baggage of passengers shall be transported together with passengers on the same aircraft when the capacity of the aircraft allows. Passengers shall pay excess baggage fees for excess baggage. The excess baggage rate is 1.5% of the economy class fare per kilogram, and the amount is in yuan.

Article 42 The carrier may, together with the passenger, inspect his baggage for the sake of transport safety; If necessary, the inspection can be carried out together with relevant departments. If the passenger refuses to accept the inspection, the carrier has the right to refuse to transport the baggage.

Article 43 The checked baggage of the passenger shall be transported with the passenger on the same plane. If it cannot be transported on the same plane under special circumstances, the carrier shall explain to the passenger and give priority to the transportation on subsequent flights.

Article 44 When the value of each kilogram of checked baggage exceeds 50 yuan, the passenger may declare the value of the baggage.
The carrier shall charge a surcharge of 5% of the declared value of the passenger in excess of the limit specified in the first paragraph of this article. The amount is in yuan.
The declared value of checked baggage cannot exceed the actual value of the baggage itself. The maximum declared value of each passenger's baggage is 8000 yuan. If the carrier disagrees with the declared value and the passenger refuses to accept the inspection, the carrier has the right to refuse to accept the shipment.

Article 45 Small animals refer to cats, dogs or other small animals raised at home. Small animals shall be transported according to the following provisions:
Passengers must put forward at the time of booking or ticket purchase, and provide animal quarantine certificate, which can be checked with the consent of the carrier.
Passengers shall transport small animals to the airport for check-in at the time specified by the carrier on the day of boarding.
Containers for small animals shall meet the following requirements:
(1) It can prevent small animals from damaging, escaping and extending beyond the container to damage passengers, baggage or cargo.
(2) Ensure the air circulation and prevent small animals from suffocating.
(3) It can prevent feces from seeping and polluting aircraft, equipment and other articles.
Small animals carried by passengers shall not be transported in the passenger cabin unless authorized by the carrier.
The weight of small animals and their containers shall be charged separately according to the standard of excess baggage charge.

Article 46 Diplomatic pouches shall be carried by diplomatic couriers and taken care of by them. According to the requirements of diplomatic messengers, the carrier also handles as checked baggage, but the carrier only bears the responsibility of general checked baggage.
Diplomatic bags and luggage carried by diplomatic couriers may be weighed or pieced together. The excess of free baggage allowance shall be handled in accordance with the provisions on excess baggage.
If a seat is required for diplomatic bag transportation, it must be proposed at the time of reservation and approved by the carrier.
The weight limit of each seat occupied by diplomatic bags shall not exceed 75 kg, and the volume and weight limit of each piece is the same as that of luggage. There is no free baggage allowance for diplomatic bags occupying seats, and the freight is calculated according to the following two methods, whichever is higher:
(1) The freight shall be calculated according to the actual weight of diplomatic bags occupying seats and the excess baggage rate;
(2) According to the number of seats occupied by diplomatic bags occupying seats. The freight shall be calculated according to the same ticket price level as that of the passenger ticket held by the diplomatic courier between the starting and ending places of transportation.

Article 47 Among the checked baggage, self care baggage and carry on items of passengers, the whole piece of baggage containing prohibited items, restricted items or dangerous items according to national regulations is called illegal baggage. The handling regulations for illegal baggage are as follows:
(1) If illegal baggage is found at the place of departure, it shall be rejected; If the baggage has been transported, the transportation shall be canceled, or the illegal baggage shall be taken out for transportation, and the excess baggage fee collected shall not be refunded.
(2) If illegal baggage is found at the stop, it shall be stopped immediately, and the excess baggage fee collected will not be refunded.
(3) The prohibited articles, restricted articles or dangerous articles contained in the illegal baggage shall be handed over to the relevant departments for handling.

Article 48 If it is necessary for the carrier to arrange the passenger to change to another flight, the baggage transportation shall be changed accordingly with the passenger, and the excess baggage fees collected shall not be refunded or supplemented; The declared value surcharge paid is non refundable.
Baggage return shall be handled as follows:
(1) Passengers who request to return their baggage at the departure place must put forward the request before the baggage is loaded. If the passenger refunds the ticket, the checked baggage must also be returned at the same time. The excess baggage fee collected shall be refunded for all the above refunds.
(2) If a passenger returns baggage at a stopover, the excess baggage fee collected for the unused leg of the flight will not be refunded.
(3) When handling the return of baggage with declared value, the paid declared value surcharge shall be returned at the place of departure, and the paid declared value surcharge shall not be returned at the stop.

Article 49 Passengers shall claim their baggage at the airport with the identification coupon of the baggage tag immediately after the arrival of the flight. If necessary, the ticket shall be submitted for inspection.
The carrier shall deliver the baggage with the identification copy of the baggage tag, and shall not be responsible for whether the person claiming the baggage is the passenger himself, as well as the losses and expenses caused thereby.
After the passenger's baggage arrives late, the carrier shall immediately notify the passenger to claim it, or directly deliver it to the passenger
If the passenger does not raise an objection when claiming baggage, it is checked baggage
It has been delivered in good condition.
If the passenger loses the identification copy of baggage tag, he/she shall report the loss to the carrier immediately. If the passenger requests to claim baggage, he/she shall provide the carrier with sufficient proof and issue a receipt when claiming baggage. If the baggage has been falsely claimed before the declaration of loss, the carrier shall not be liable.

Article 50 If the undeliverable baggage is still unclaimed after 90 days from the day after its arrival, the carrier may handle it according to the relevant provisions on undeliverable baggage.

Article 51 In case of delay, loss or damage of baggage transportation, the carrier or its agent at the stop or destination of the flight shall fill in the Baggage Transportation Accident Record together with the passengers, find out the situation and reasons as soon as possible, and reply the investigation results to the passengers and relevant units. In case of baggage compensation, it shall be handled at the stop or destination.
If the checked baggage of the passenger fails to arrive on the same plane with the passenger due to the carrier's reason, which causes inconvenience to the passenger's travel life, the passenger shall be given appropriate temporary living supplies compensation at the stopover or destination.

Article 52 The amount of compensation for all or part of the passengers' checked baggage damaged or lost shall not exceed RMB 50 per kilogram. If the value of baggage is less than 50 yuan per kilogram, compensation shall be made according to the actual value. Excess baggage fees collected will be refunded.
The weight of passengers' lost baggage shall be calculated according to the actual weight of checked baggage. If the weight cannot be determined, each passenger's lost baggage can only be compensated according to the free baggage allowance enjoyed by the passenger.
If the passenger's lost baggage has handled the declared value of baggage, compensation shall be made according to the declared value, and the declared value surcharge will not be refunded. If the declared value of baggage is higher than the actual value, compensation shall be made according to the actual value.
If the baggage is damaged, it shall compensate or bear the repair cost according to the reduced value of the baggage.
The maximum amount of compensation borne by the carrier shall not exceed 2000 yuan per passenger due to the loss of the passengers' personal baggage and carry on items caused by events occurring during boarding and disembarking or on board the aircraft.
For domestic leg constituting international transportation, baggage compensation shall be handled according to applicable provisions on baggage compensation for international transportation.
After the lost baggage of the compensated passenger is found, the carrier shall promptly notify the passenger to claim it, and the passenger shall take back his baggage and return all compensation. The compensation for temporary living supplies is non refundable. If the passenger is found to have committed obvious fraud, the carrier has the right to recover all the compensation.

Article 53 If the passenger's checked baggage is lost or damaged, he/she shall claim compensation from the carrier or agent within the legal time limit, and attach the ticket (or photocopy), the identification copy of the baggage tag, the Baggage Transport Accident Record, the certificate certifying the content and price of the baggage and other relevant certificates.

Chapter XII Passenger Service

Section 1 General Services

Article 54 The carrier shall, on the basis of ensuring flight safety and normal flight, provide good service, and with a civilized, courteous, warm and considerate service attitude, conscientiously do a good job in various services of air and ground passenger transportation.

Article 55 Personnel engaged in air passenger transport services shall receive appropriate training and obtain certificates of competency. Personnel who have not obtained the job qualification certificate shall not be engaged in air transport passenger services.

Article 56 In the process of air transport, if the passenger is ill, the carrier shall actively take measures to rescue him.

Article 57 During air flight, the carrier shall provide drinks or meals to passengers according to flight time.

Section II Service of irregular flights

Article 58 If the flight is delayed or cancelled at the place of departure due to maintenance, flight allocation, business, crew and other reasons, the carrier shall provide passengers with food, accommodation and other services.

Article 59 If the flight is delayed or cancelled at the place of departure due to non carrier reasons such as weather, emergencies, air traffic control, security inspection and passengers, the carrier shall assist passengers to arrange meals and accommodation at their own expense.

Article 60 If the flight is delayed or cancelled at the stopover, the carrier shall be responsible for providing accommodation services to the stopover passengers for whatever reason.

Article 61 In case of flight delay or cancellation, the carrier shall promptly notify passengers of flight delay or cancellation and other information, and make explanations.

Article 62 The carrier and other support departments shall cooperate with each other, perform their own duties, be conscientious and responsible, and jointly ensure the normal flight and avoid unnecessary flight delays.

Article 63 In case of flight delay or cancellation, the carrier shall carefully arrange subsequent flights or refund tickets according to the requirements of passengers and the provisions of Articles 19 and 23 of these Rules.

Chapter XIII Supplementary Provisions

Article 64 These Rules shall come into force as of March 1, 1996. The Rules for the Domestic Transport of Passengers and Luggage formulated and implemented by the Civil Aviation Administration of China on January 1, 1985 shall be repealed at the same time.
