China's tourism laws and regulations
Trial Measures for Reporting System of Major Tourism Safety Accidents

(Issued by the National Tourism Administration on April 15, 1993)

Article 1 These Measures are formulated for the purpose of timely understanding and properly handling major tourism safety accidents.

Article 2 The major tourism safety accidents mentioned in these Measures refer to:
(1) Accidents causing serious personal injury or death of overseas tourists;
(2) Major fires and other malignant accidents in accommodation, transportation, sightseeing, catering, entertainment and shopping places for foreign-related tourism;
(3) Other accidents causing serious economic losses.

Article 3 The tourism administrative departments of all provinces, autonomous regions, municipalities directly under the Central Government, and cities specifically designated in the state plan, as well as the units participating in the contact network of the "China Tourism Emergency Rescue Coordination Agency" (hereinafter referred to as the "reporting units"), have the responsibility to report major tourism safety accidents to the "China Tourism Emergency Rescue Coordination Agency".

The fourth reporting unit, after receiving the report of major tourism safety accidents in tourist attractions, hotels, on the way to traffic or other occasions, shall report the accident to the "China Tourism Emergency Rescue Coordination Agency" directly by telex, telephone or other effective ways in addition to the local relevant departments.

Article 5 The report of major tourism safety accidents mainly includes:
1. Contents of the first report after the accident:
(1) Time and place of the accident;
(2) Preliminary information of the accident;
(3) Accident reception unit and other units related to the accident;
(4) Name, unit and telephone number of the reporter.
2. Report contents during accident handling:
(1) Casualties and names, gender, age, nationality, group name and passport number of casualties;
(2) Progress of accident handling;
(3) Analysis of accident causes;
(4) Reflection and requirements of relevant parties;
(5) Other matters requiring instructions or reports.
3. After the accident handling, the reporting unit shall carefully summarize the overall situation of the accident occurrence and handling, and make a written report, including:
(1) Accident process and handling;
(2) Accident causes and responsibilities;
(3) Accident lessons and future preventive measures;
(4) Remediation process and compensation;
(5) Feedback from relevant parties and the families of the victims;
(6) Problems left over by the accident and others.

Article 6 After receiving the report from the reporting unit, the "China Tourism Emergency Rescue Coordination Agency" shall report the situation to the relevant parties in a timely manner and reply to the questions asked for instructions.

Article 8 These Measures shall come into force as of the date of issuance, and the National Tourism Administration shall be responsible for interpretation and revision.
