China's tourism laws and regulations
Interim Measures for the Administration of Tourism Safety

Chapter I - General Provisions
Article 1:
To strengthen tourism safety management. These Measures are formulated in accordance with relevant laws and regulations to ensure the personal and property safety of tourists.
Article 2:
Tourism safety management should implement the policy of "safety first, prevention first".
Article 3:
These Measures are applicable to enterprises and institutions engaged in tourism business.
Article 4:
Tourism administrative departments at all levels shall be responsible for organizing the implementation of these Measures.
Chapter II - Safety Management Article 5:
Tourism safety management should follow the principles of unified leadership, hierarchical management, and grassroots oriented.
Article 6:
Tourism administrative departments at all levels must establish and improve tourism safety management institutions.
Article 7:
Tourism administrative departments at all levels, under the leadership of the local government, together with relevant departments, manage tourism safety.
Article 8:
Responsibilities of tourism safety management organization:
(1) Guide, supervise and inspect the implementation of these Measures and various national regulations related to tourism safety by local tourism enterprises and institutions;
(2) Organize and implement tourism safety education and publicity;
(3) Check and accept the safety facilities of tourism enterprises and institutions together with relevant departments before opening;
(4) Urge and inspect tourism enterprises and institutions to implement the insurance system for tourists' personal and property safety;
(5) Accept tourists' complaints about safety issues and properly handle them together with relevant departments.
(6) Establish and improve the safety inspection system, and hold safety work meetings regularly;
(7) Participate in the handling of accidents involving the personal and property safety of tourists.
Chapter III - Accident Handling Article 9:
After the accident, the accident unit shall handle it according to the following procedures:
(1) The accompanying personnel shall report to the competent department immediately, and the competent department shall report to the centralized management department in a timely manner;
(2) . Strictly protect the site together with the relevant units in the place where the accident occurred;
(3) Cooperate with relevant departments to carry out rescue and investigation;
(4) The person in charge of the relevant unit shall rush to the site for handling in time;
(5) Special serious accidents shall be handled in strict accordance with the Interim Provisions of the State Council on the Investigation Procedures of Special Serious Accidents.
Article 10:
When dealing with accidents involving heavy casualties of foreign tourists, attention should be paid to the following matters:
(1) Immediately notify the relevant embassies and consulates in China and the delegation units through the foreign affairs administration department;
(2) Provide convenience for foreign embassy and consulate personnel, group units and families of casualties who come to understand and deal with the accident;
(3) Coordinate with relevant departments to facilitate international emergency organizations to participate in the treatment of casualties of tourists (groups) insured abroad;
(4) The death of foreign tourists in China shall be handled in strict accordance with the Procedures for Handling Foreigners Who Die in China issued by the Ministry of Foreign Affairs.
Article 11:
Compensation for foreign tourists. Properly handle in accordance with relevant national insurance regulations.
Article 12:
After the accident is handled, the accident investigation report shall be written immediately, including:
(1) Accident process and handling;
(2) Accident causes and responsibilities;
(3) Lessons from accidents;
(4) Precautions in the future.
Chapter IV - Rewards and Punishments Article 13:
Units or individuals who have made remarkable achievements or outstanding contributions in tourism safety work will be commended or rewarded.
Article 14:
The tourism administration shall be responsible for the violation of relevant safety laws and regulations, resulting in tourist casualties and failure to comply with these Measures
The administrative department and relevant departments shall respectively impose the following penalties on the person directly responsible and the responsible unit:
(1) Warning;
(2) , fine;
(3) . Rectify within a time limit;
(4) . Suspension of business for rectification;
(5) . Revocation of business license; Those who violate the criminal law. The judicial organ shall investigate criminal responsibility according to law.  
Chapter V - Article 15 of the Supplementary Provisions:
These Measures shall be interpreted by the National Tourism Administration.
Article 16:
The tourism bureaus of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Measures and in combination with the actual conditions of their respective regions, formulate implementation measures and report them to the National Tourism Administration for the record.
Article 17:
These Measures shall come into force as of March 1, 1990.
