China's tourism laws and regulations
Provisions on Strictly Prohibiting Unauthorized Receipt of Rebates and Gratuities in Tourism Business

Article 1 These Provisions are formulated in order to strengthen the spiritual civilization construction of the staff and workers of the tourism system, oppose the improper acts of privately accepting rebates and tips in tourism business, maintain China's tourism reputation, and better develop tourism.

Article 2 Employees of the tourism system are not allowed to ask for or accept rebates (including coupons, physical objects and other remuneration) without permission.
Whoever, in violation of the provisions of the preceding paragraph, commits one of the following acts shall be punished by the tourism administration department according to the circumstances:
(1) If the amount of kickback demanded or received privately is less than 500 yuan, the illegal gains shall be confiscated, and a fine equal to or less than the illegal gains may be imposed, and an administrative warning or demerit recording shall be given at the same time.
(2) If the amount of kickback demanded or received privately is between 500 yuan and 1000 yuan, the illegal income shall be confiscated, and a fine equal to the equivalent of less than twice the amount of the illegal income may be imposed, and the punishment of detention for probation shall be given at the same time.
(3) Those who ask for or accept kickbacks without permission and the amount is more than 1000 yuan shall have their illegal income confiscated and be dismissed from public office at the same time.

Article 3 Business units such as shops, restaurants and automobile companies that receive tourists shall not pay rebates to individuals in their business operations.
Whoever, in violation of the provisions of the preceding paragraph, commits one of the following acts shall be punished by the tourism administration department in conjunction with the relevant competent departments according to the circumstances:
(1) If the amount of kickback voluntarily paid to a private person is less than 1000 yuan, a fine equivalent to not more than twice the amount of the kickback paid shall be imposed; The competent department shall give administrative sanctions to the person directly responsible and the person in charge of the business unit.
(2) If the amount of the kickback voluntarily paid to a private person is more than 1000 yuan but less than 2000 yuan, a fine equivalent to less than three times the amount of the kickback paid shall be imposed; The competent department shall give administrative sanctions to the person directly responsible and the person in charge of the business unit.
(3) If the amount of kickback paid to a private person on his own initiative is more than 2000 yuan, in addition to being punished in accordance with the provisions of item (2) of this paragraph, he may also be ordered to suspend business for rectification, or his business license may be revoked by the administrative department for industry and commerce according to law.

Article 4 The staff and workers of the tourism system shall not ask for or accept tips from tourists in their work; You may not accept tips from tourists. Tourists who offer gifts should decline them; If it is really impossible to refuse, it shall be handled in accordance with the relevant provisions of the state on gifts.

Article 5 Whoever, in violation of the provisions of Article 4, commits one of the following acts shall be punished by the tourism administration department:
(1) Those who do not take the initiative to ask for tips but accept tips will be criticized and educated, and their tips will be confiscated.
(2) Those who take the initiative to ask for tips, or hint or create difficulties for tourists, causing adverse effects, shall be given administrative sanctions, and may also be fined less than three times the amount of tips received; If the circumstances are serious and the consequences are serious, the offender may be detained for probation or even dismissed from public office.

Article 6 Those who violate Article 2, Article 3 and Article 4 of these Provisions, if the circumstances are serious and the criminal law is violated, shall be handed over to the judicial organ for investigation of criminal responsibility according to law.

Article 7 Those who are dismissed from public office for asking for or receiving kickbacks or tips without permission shall not be re employed as employees of the tourism system.

Article 8 The staff members who adhere to the principle, refuse to accept rebates and tips, enthusiastically provide services to tourists, and are well received by tourists, shall be given spiritual and material rewards.

Article 9 The money and material objects confiscated shall be disposed of in accordance with the relevant provisions of the State.

Article 10 Tourism administrative departments shall be responsible for supervising and inspecting the implementation of these Provisions. Industry and commerce, finance, audit and other departments shall strengthen cooperation within their respective responsibilities.

Article 11 These Provisions are applicable to all units in the tourism system, as well as other business units such as shops, restaurants and automobile companies involved in tourism business.

Article 12 The term "more than" as mentioned in the present Provisions includes the given number.

Article 13 These Provisions shall come into force as of the date of promulgation.
