Just after the punishment of Lianyungang, a deputy to the National People's Congress jumped out to do it. He proposed legislation to restrict online celebrities from cracking down on counterfeits. The government replied that in the future, it would restrict professional playing with dummies. Before online celebrities crack down on counterfeits, they must go to the local competent department to apply for registration of the number of people, location, purpose, equipment and other details for filing. Online celebrities can only take action after they have been reviewed and approved by the department leader.
Don't be afraid of cheating? If you don't owe your salary, will you ask for it maliciously? Do not fundamentally solve the problem, but always want to solve the person who raises the problem. Does such a standard standardize the person who pursues light, or encourage the businessmen to cheat?
Wang Bo, deputy to the National People's Congress, put forward a "shocking" proposal: Want to crack down on counterfeits? Let the government know first! What exactly is this operation? Will you arrange the evacuation of ghost scales first?
The two high-profile online celebrity crackdowns in Lianyungang and Nanjing not only led the market supervision department, but also frustrated the city's image. This made Representative Wang suddenly wake up: this "anti fraud" trend has to be cured.
Wang Bo's logic is that no matter who or how big the online celebrities are, they have to follow the procedure before cracking down on counterfeits. They told the local market supervision bureau in advance: "Today I will go to your site to crack down on counterfeits. There will be many stores at any time and at any place, and they will report all the same." Doesn't this obviously reserve a reception time for "ghost scales" to call names?
The proposal was quickly replied by the relevant departments. First of all, it was made clear that the law did not prohibit people from reporting quality problems, and encouraged people to say no to food safety and fraud. There were rewards for reporting! This does not mean that the fight against counterfeiting is protected and supported by law.
However, like fishing, it needs to be reported in advance.
Online celebrity crackdowns are also consumers. Whether it is for the compensation amount specified by law or for the flow, it is allowed by law and welcomed by consumers. You don't sell fake weighers. What are you afraid of?
Wang Bo's deliberate proposal was also welcomed by the "ghost scales", which was too close to their hearts.
Wang Hai, a famous professional crackdown on counterfeit goods, paid attention to the proposal of Wang Representative and the response of relevant departments, and immediately sent a long article to express the interpretation of beating dummies.
Will the Market Supervision Administration begin to restrict consumers from cracking down on counterfeits? The Interim Rules for the Publicity of Complaint Information in Market Supervision and Management has also been specially issued. In the future, the complaints and reports of consumers, also known as professional crackdowns, will no longer be filed?
With these questions in mind, Shi Ruijie, a consumer, specifically consulted the Market Supervision Administration, which replied in three aspects:
1、 The market supervision department encourages and supports social supervision, and has specially issued the Interim Measures for Rewards for Reporting Major Illegal Acts in the Field of Market Supervision.
2、 The complaints and reports are divided into two parts. As for complaints, specific groups were not excluded from consumers, nor was the right of consumers to crack down on counterfeits restricted. For reporting, it means that a natural person, legal person or other organization reports to the Market Supervision Department that an operator is suspected of violating the market supervision laws, regulations and clues, without being restricted by the interests. The public can report the operators' suspected illegal behaviors according to law.
3、 In order to promote social co governance, consumers' right to crack down on counterfeit goods was not restricted.
The above content affirms the positive significance of consumers' crackdown on counterfeit goods, and shows that consumers' right to crackdown on counterfeit goods has never been restricted. The new Regulation on the Implementation of the Law on the Protection of Consumers' Rights and Interests has been promulgated and will be implemented soon. The Market Supervision Administration has put forward that everyone is a consumer.
After the professional crackdown on counterfeiters represented by Wang Hai appeared, there were five different voices in public opinion:
1、 Think Wang Hai is not a real consumer;
2、 Wang Haizong went to large state-owned malls to buy fake goods and claim compensation, instead of going to small malls or individual vendors. As a result, the public economy was damaged;
3、 The income obtained by Wang Hai by claiming for fake goods belongs to illegitimate income;
4、 Wang Hai bought fake claims for profit, with impure motives;
5、 One Wang Hai has upset the business community in Beijing. After more "Wang Hai" appear, the market order will be disordered.
Wang Hai refuted the above five views. He said that he is law-abiding, and it is illegal for operators to manufacture and sell fake products when they act according to the rights granted by the state. Wang Hai deals with breaking the law by abiding by the law. What's wrong with law-abiding people claiming compensation from lawbreakers?
Wang Hai refuted the above five voices one by one:
First, anyone who buys goods from producers or operators can be called a consumer. Consumers are not necessarily the final consumers of the goods they buy, and not only the final consumers can claim for the fake and inferior goods they buy. All people or units who buy fake and inferior goods have the right to claim for compensation. For example, malls can also claim for compensation when they buy fake and inferior goods from purchasers, even though they are not the final consumers. Why does Wang Hai have no right to claim compensation if he is not the ultimate consumer?
Second, there may be two cases when the shop sells fake goods. First, we knew it was fake when we purchased, but the purchase price was cheap and profitable; The second is that when purchasing goods, they do not know that they are fake, and they are fraudsters themselves. In the first case, businesses have nothing to say about doubling compensation to consumers; In the second case, the merchant should make compensation first, and then claim compensation from the producer or other operators. No matter what the nature of the commercial enterprise is, as long as the fake goods are sold and others come to claim compensation, they should double the compensation to consumers. As for Wang Hai, the reason why he doesn't buy fake goods from self-employed people is very complicated, which is another problem. If the public stores suffer losses due to Wang Hai's claim, it is not surprising. If you sell fake goods, you deserve to lose. Public owned shopping malls should learn from it and improve their work.
Third, Wang Hai's claim for fake goods is legitimate income. Illegal income refers to illegal income. To measure whether an income is legitimate or not, the key is to see whether the income is illegal or not. Wang Hai's income is allowed by law.
Fourth, Wang Hai's behavior is not motivated by impure motives. To investigate whether the motivation of an economic behavior is pure, we must combine it with the consequences. It is unscientific to investigate it alone. Wang Hai's claim for fake goods not only protects the interests of individuals, but also protects the interests of others, which is very beneficial to the healthy and orderly development of the market economy. There are too few consumers like Wang Hai now. If more Wang Hai appeared, it would be very beneficial to eliminate counterfeits. Vigorously publicizing the Wang Hai phenomenon will surely awaken and stimulate more consumers to use legal weapons to protect their legitimate rights and interests. If we say that "motive is impure", then the real motive is impure for those who sell fake goods to make huge profits.
Fifth, the market order will be disordered if fake and shoddy goods flood the market. More fake and inferior consumers like Wang Hai will be less, and the market order will be normal. From disorder to order, the socialist market economy must rely on the power of social supervision.
