Beijing News According to the Ministry of Commerce, the Ministry of Commerce of the People's Republic of China (hereinafter referred to as the Ministry of Commerce) received on April 22, 2024 from Yunnan Yuntian Chemical Co., Ltd., Ningxia Coal Industry Co., Ltd. of National Energy Group, Kaifeng Longyu Chemical Co., Ltd., Yankuang Lunan Chemical Co., Ltd., Tangshan Zhonghao Chemical Co., Ltd PetroChina Inner Mongolia New Materials Co., Ltd. (hereinafter referred to as "the applicant") formally submitted an anti-dumping investigation application on behalf of the copolymer formaldehyde industry in mainland China. The applicant requested to conduct anti-dumping investigation on imported copolymer formaldehyde originating in the EU, the United States, Taiwan and Japan. In accordance with the relevant provisions of the Anti dumping Regulations of the People's Republic of China, the Ministry of Commerce has examined the qualifications of the applicants, relevant information about the products applied for investigation, relevant information about similar products in mainland China, the impact of the products applied for investigation on the industries in mainland China, and relevant information about the countries (regions) applying for investigation.
According to the evidence provided by the applicant and the preliminary examination of the Ministry of Commerce, the output of the applicant's copolymer formaldehyde accounted for more than 50% of the total output of similar products in mainland China in the same period in 2021, 2022 and 2023, which was in line with the provisions of Articles 11 and 13 of the Anti dumping Regulations of the People's Republic of China on the application for anti-dumping investigation by industries in mainland China. At the same time, the application contains the contents and relevant evidence required for the initiation of anti-dumping investigations under Articles 14 and 15 of the Anti dumping Regulations of the People's Republic of China.
According to the above review results, and in accordance with the provisions of Article 16 of the Anti dumping Regulations of the People's Republic of China, the Ministry of Commerce has decided to initiate an anti-dumping investigation on imported paraformaldehyde originating in the EU, the United States, Taiwan and Japan from May 19, 2024. Relevant matters are hereby announced as follows:
1、 Case filing investigation and investigation period
Since the date of this announcement, the Ministry of Commerce has initiated an anti-dumping investigation on imported copolyparaformaldehyde originating in the EU, the United States, Taiwan and Japan. The dumping investigation period determined in this investigation is from January 1, 2023 to December 31, 2023, and the industrial injury investigation period is from January 1, 2021 to December 31, 2023.
2、 Investigated products and investigation scope
Scope of investigation: Imported polyoxymethylene originating in the EU, the United States, Taiwan and Japan
Name of investigated product: Copolyformaldehyde, also known as polyoxymethylene copolymer, or polyoxymethylene copolymer
English name: Polyformaldehyde Copolymer, or Polyoxymethylene Copolymer, or Copolymer type Acetal Resin, or Acetal Copolymer, etc. The English name is usually referred to as POM Copolymer
Chemical formula:
-[CH2-O]n-[CH2-O-CH2-CH2]m-(n>m)
Physical and chemical characteristics:
Copolyformaldehyde is a thermoplastic resin synthesized from formaldehyde, which has - CH2-O-main chain and - [CH2-O-CH2-CH2] - intercalated bond (the content of - CH2-O - by weight is more than 50%), and meets the following performance indicators at the same time:
Main applications: Copolyformaldehyde has good comprehensive mechanical properties such as high mechanical strength, high fatigue resistance, high creep resistance, etc. It can partially replace copper, zinc, tin, lead and other metal materials, and can be directly used or modified for automotive accessories, electronic appliances, industrial machinery, daily necessities, sports equipment, medical appliances, pipe fittings, building materials and other fields.
This product is included in the Import and Export Tariff of the People's Republic of China (2023): 39071010, 39071090. Other products such as homoparaformaldehyde and modified paraformaldehyde under these two tariff codes are not included in the scope of this investigation.
3、 Register to participate in the survey
Interested parties shall register with the Trade Relief Investigation Bureau of the Ministry of Commerce to participate in this anti-dumping investigation within 20 days from the date of this announcement. The interested parties participating in the investigation shall provide basic identity information, the quantity and amount of the investigated products exported or imported to the mainland of China, the quantity and amount of similar products produced and sold, and related information and other explanatory materials in accordance with the Reference Form for Registration to Participate in the Investigation. The Reference Format for Registration to Participate in the Investigation can be downloaded from the website of the Trade Remedy Investigation Bureau of the Ministry of Commerce.
Interested parties shall register to participate in this anti-dumping investigation through the "trade remedy investigation information platform"（ https://etrb.mofcom.gov.cn ）The electronic version shall be submitted, and the written version shall also be submitted according to the requirements of the Ministry of Commerce. The electronic version and the written version shall have the same content and the same format.
The interested parties mentioned in this Announcement refer to the individuals and organizations specified in Article 19 of the Anti dumping Regulations of the People's Republic of China.
4、 Access to public information
Interested parties can download the non confidential text of the application submitted by the applicant on the website of the Trade Remedy Investigation Bureau of the Ministry of Commerce or go to the Trade Remedy Public Information Reference Room of the Ministry of Commerce (Tel: 0086-10-65197878) to search, read, copy and copy the application. During the investigation, interested parties can query the public information of the case through relevant websites, or search, read, copy and copy the public information of the case in the Trade Remedy Public Information Reference Room of the Ministry of Commerce.
5、 Comments on filing
If interested parties need to comment on the product range and applicant qualification of this survey, the investigated country (region) and other relevant issues, they can submit written comments to the Trade Relief Investigation Bureau of the Ministry of Commerce within 20 days from the date of this announcement.
6、 Investigation method
In accordance with the provisions of Article 20 of the Anti dumping Regulations of the People's Republic of China, MOFCOM may use questionnaires, sampling, hearings, on-site inspections and other means to learn about the situation from interested parties and conduct investigations.
In order to obtain the information needed for the investigation of this case, the Ministry of Commerce usually issues a questionnaire to interested parties within 10 working days from the deadline for registration to participate in the investigation specified in this announcement. Interested parties can download the questionnaire from the trade remedy investigation bureau website of the Ministry of Commerce.
The inquiry information of the Questionnaire on Foreign (Regional) Exporters or Producers of Copolyformaldehyde Anti dumping Case includes the company's structure and operation, the products under investigation, export sales to the mainland of China, domestic (regional) sales, business and financial information, production costs and related expenses, estimated dumping margin and checklist. The inquiry information of the Questionnaire on Copolyformaldehyde Anti dumping Cases among Chinese Mainland Producers includes the basic information of the company, the situation of similar products, business and related information, financial and related information, and other issues that need to be explained. The inquiry information of the Questionnaire of Importers in Mainland China on Copolyformaldehyde Anti dumping Case includes the basic information of the company, the trade of the investigated products and relevant information.
Interested parties shall submit complete and accurate answers within the specified time. The answer sheet should include all the information required by the questionnaire.
7、 Submission and processing of information
The interested parties shall submit comments and answers during the investigation through the "trade remedy investigation information platform"（ https://etrb.mofcom.gov.cn ）Submit the electronic version, and submit the written version according to the requirements of the Ministry of Commerce. The electronic version and the written version shall have the same content and the same format.
If the information submitted by interested parties to the Ministry of Commerce needs to be kept confidential, they can request the Ministry of Commerce to keep the relevant information confidential and explain the reasons. If MOFCOM agrees with its request, the interested party applying for confidentiality shall also provide a non confidential summary of the confidential information. The non confidential summary shall contain sufficient and meaningful information so that other interested parties can have a reasonable understanding of the confidential information. If a non confidential summary cannot be provided, reasons shall be given. If the information submitted by the interested party does not indicate the need for confidentiality, the Ministry of Commerce will regard the information as public information.
8、 Consequences of non cooperation
According to Article 21 of the Anti dumping Regulations of the People's Republic of China, when MOFCOM conducts an investigation, interested parties shall truthfully report the situation and provide relevant information. If an interested party fails to truthfully report the situation or provide relevant materials, or fails to provide necessary information within a reasonable time, or seriously obstructs the investigation in other ways, MOFCOM may make a ruling based on the facts already obtained and the best information available.
9、 Investigation period
This investigation will start on May 19, 2024, and should generally be completed before May 19, 2025. Under special circumstances, it can be extended for 6 months.
