In order to further standardize the construction of national reserve forests and promote the high-quality development of national reserve forests, our bureau has formulated the Administrative Measures for the Construction of National Reserve Forests (for Trial Implementation). Measures for the Administration of National Reserve Forest Construction (for Trial Implementation)

  

Chapter I General Provisions

   Article 1 In order to standardize the construction of national reserve forests, ensure timber safety and improve the ecological environment, these Measures are formulated in accordance with the Forest Law of the People's Republic of China, the Opinions of the General Office of the State Council on Encouraging and Supporting Social Capital to Participate in Ecological Protection and Restoration, the Guiding Opinions of the General Office of the State Council on Scientific Greening and other laws, regulations and relevant provisions.

   Article 2 These Measures are applicable to the forest planting activities and supporting diversified business activities that are included in the construction scope of the national reserve forest planning or implementation scheme, relying on special investment or special financial loans, and carried out in accordance with the relevant policies and technical provisions of the national reserve forest construction.

   Article 3 The construction of national reserve forests should adhere to the principle of "overall planning, highlighting key points, government guidance, market operation, adaptation to local conditions and scientific cultivation".

   Article 4 The construction of national reserve forests should, on the premise of strict protection of cultivated land, carry out intensive plantation cultivation, transformation of existing forests, tending of young and middle-aged forests and related supporting activities, give priority to intensive plantation cultivation according to the actual situation, and develop medium and short cycle industrial raw material forests and long cycle large diameter timber forests as a whole. The construction of national reserve forests shall not be carried out within the scope of national public welfare forests.

   Article 5 The State Forestry and Grassland Administration is responsible for the construction and management of national reserve forests. The local competent forestry and grassland departments at various levels shall be responsible for the management of the construction of national reserve forests in their respective administrative regions. The competent forestry and grassland authorities in various regions should discuss development and reform, finance and other departments and financial institutions to establish a joint working mechanism to jointly strengthen the management of national reserve forest construction.

   Article 6 The relevant construction entities shall be responsible for the specific implementation of national reserve forest construction. The main body of national reserve forest construction refers to enterprises and institutions or other cooperative economic organizations and specialized forestry households that undertake the task of national reserve forest construction and have independent legal personality.

  

Chapter II Planning and Investment

   Article 7 The plan and implementation plan for the construction of national reserve forests shall be formulated by the State Forestry and Grassland Administration in consultation with the National Development and Reform Commission and other departments. The competent forestry and grassland authorities at the provincial level shall, in light of their actual work and in accordance with the national plan and implementation plan for the construction of national reserve forests, work out the plan or implementation plan for the construction of national reserve forests in their respective administrative regions.

   Article 8 The national reserve forest construction subject shall prepare the national reserve forest project construction plan according to the provincial national reserve forest construction plan or implementation plan, and define the specific construction scope, content, objectives, tasks, technical route, investment and fund raising, risk control, environmental impact assessment, benefit analysis, safeguard measures, etc. Scientifically determine the investment proportion of afforestation activities and supporting diversified business activities of national reserve forests.

The construction scheme shall be submitted to the provincial forestry and grassland authorities for expert argumentation according to the procedure. Among them, the total investment is more than 2 billion yuan (including 2 billion yuan), as well as the national reserve forest construction projects that are outside the construction scope of the national reserve forest planning and implementation plan, but need to be carried out due to the national major strategy, etc. The construction plan, after being reviewed by the provincial competent forestry and grassland authorities, is reported to the State Forestry and Grassland Administration for organizing experts to demonstrate. If the construction plan fails to organize experts to demonstrate according to the procedure, it shall not be included in the construction scope of the national reserve forest.

The national reserve forest construction project implemented by the government and social capital cooperation (PPP) mode, which has been included in the national PPP comprehensive information platform project database according to relevant requirements, does not need to organize experts to demonstrate.

  Article 9 The investment plan within the central budget for national reserve forest construction shall be declared and issued according to relevant regulations. For the construction of national reserve forests, the investment within the central budget corresponding to the planned tasks can be used as the project capital.

  Article 10 Where financial loans are used to construct the national reserve forest, the construction subject of the national reserve forest shall, in accordance with the relevant provisions of financial institutions, go through the project loan procedures and report the loan results to the provincial competent forestry and grassland authorities in a timely manner according to the procedures, and the provincial competent forestry and grassland authorities shall report the results to the State Forestry and Grassland Administration in a timely manner.

  

Chapter III Organization and Implementation

   Article 11 The construction of national reserve forests shall be organized and implemented according to the requirements of operation design. The construction entity of the national reserve forest shall entrust a qualified design unit to prepare the operation design.

   Article 12 The tree species for national reserve forest construction shall meet the requirements of national reserve forest tree species catalogue, and shall be suitable for the site and the tree species. Promote the use of fine varieties, fine provenance trees, native trees, rare trees and efficient cultivation techniques.

   Article 13 The provincial competent forestry and grassland authorities shall organize the local competent forestry and grassland authorities and the national reserve forest construction main body to land all the intensive plantation cultivation plots and existing forest cultivation plots under the construction of the national reserve forest in accordance with the requirements of the technical specifications for afforestation and greening landing maps, and actively do a good job in the landing map of the young and medium-sized forest tending plots if conditions permit.

   Article 14 Intensive plantation cultivation of national reserve forests shall comply with relevant technical regulations for afforestation, adhere to the principle of ecological priority and environmental friendliness, and take intensive management measures. Promote the construction of mixed forests.

   Article 15 The existing forest transformation of the national reserve forest shall comply with the relevant technical regulations for the transformation of the national reserve forest. For the forest with good site conditions but not suitable for trees, unclear target species, and insufficient production potential, afforestation under the canopy, thinning transformation, replanting and other measures shall be taken.

   Article 16 The tending of young and middle-aged forests in national reserve forests should follow the relevant regulations of forest tending, select young and middle-aged forests with promising cultivation prospects and great potential for production increase, and take measures such as thinning, pruning, and fertilization.

  

Chapter IV Supervision and Management

   Article 17 The provincial competent forestry and grassland authorities shall, in accordance with the relevant provisions of the State Forestry and Grassland Administration, organize statistical analysis of the annual construction of the national reserve forests in their respective administrative regions, and report the results of statistical analysis to the State Forestry and Grassland Administration before the end of March of the next year. The State Forestry and Grassland Administration shall, according to the actual work needs, organize and carry out an assessment of the construction of national reserve forests in due time.

   Article 18 The results of statistical analysis and evaluation of national reserve forests serve as an important basis for investment arrangement within the central budget, review of reserve forest financial loan projects, rewards and punishments, etc. Statistical analysis and evaluation results shall be reported within a certain range.

   Article 19 The competent forestry and grassland authorities in various regions should cooperate with financial institutions and relevant departments to strengthen the supervision of national reserve forest construction projects, and timely and accurately grasp the task completion, construction results, fund use and management.

   Article 20 Those who fail to comply with the relevant provisions of the national reserve forest construction and the requirements of the annual operation design shall be ordered to rectify; Illegal arbitrage and misappropriation of funds shall be handled in accordance with laws and regulations to ensure the healthy development of national reserve forest construction. Strengthen risk early warning, prevention and control to avoid financial risks.

  

Chapter V Safeguard Measures

   Article 21 We will encourage diversified investment and financing to build a national reserve forest without increasing the implicit debt of local governments. In combination with land greening, various support funds can be used as a whole according to regulations to support the construction of national reserve forests in terms of artificial afforestation, restoration of degraded forests, forest tending, etc. Encourage and support social capital to participate in the construction of national reserve forests. The discount interest and insurance of national reserve forest loans shall be implemented in accordance with relevant regulations.

For the diversified investment and financing construction of national reserve forest project, the preparation, approval and project supervision of its construction scheme and operation design shall refer to the financial loan project.

   Article 22 The construction subject of the national reserve forest enjoys the right to use and manage the forest land related to the construction of the national reserve forest, as well as the ownership and management rights of the relevant trees.

   Article 23 The construction subject of the national reserve forest may dispose of all its trees according to law and regulations.

   Article 24 The State Forestry and Grassland Administration shall standardize the declaration, demonstration, examination and statistics of national reserve forest projects by building and improving the management system of national reserve forest project database.

The subject of national reserve forest construction shall strengthen file management, timely submit relevant information to the provincial competent forestry and grassland authorities according to procedures, and the provincial competent forestry and grassland authorities shall report to the State Forestry and Grassland Administration after summary and review.

   Article 25 The competent forestry and grassland authorities at various places should strengthen the talent training, scientific and technological support, publicity and training of national reserve forest construction, regularly organize and carry out management and technical personnel training, timely carry out publicity of national reserve forest construction and management models, and expand social impact.

   Article 26 Local competent forestry and grassland authorities and national reserve forest construction entities should strengthen the construction of infrastructure support and guarantee capacity such as roads, fire prevention facilities, reservoirs, management and protection houses in national reserve forest areas.

   Article 27 The competent forestry and grassland authorities at the provincial level shall organize the confirmation of the national reserve forest projects that cannot continue to be constructed due to force majeure or major policy adjustments, and make a copy to the State Forestry and Grassland Administration.

   Article 28 The provincial competent forestry and grassland authorities shall specify the corresponding institutions responsible for the construction and management of national reserve forests.

  

Chapter VI Supplementary Provisions

  Article 29 These Measures shall be interpreted by the State Forestry and Grassland Administration.

   Article 30 The local competent forestry and grassland authorities at various levels may, in accordance with these Measures, formulate corresponding implementation rules.

   Article 31 These Measures shall come into force as of the date of promulgation.
