What is the process for individuals to apply for trademark registration?
Design the trademark to be registered in advance. Including logo, Chinese and English names.
Determine the scope of use of the trademark. Trademarks are divided into 45 categories, and each category is further divided into sub categories. The specific scope of use and product names of registered trademarks should be determined.
Check whether the trademark is registered in advance. Go to the website of the State Administration for Industry and Commerce to check whether the trademark has been registered. If it has been registered, you should change the trademark before submitting it. You can submit a registration application without registering.
Submit materials to the local industrial and commercial bureau. For an individual to register a trademark, two copies of the ID card on the front and two copies of the ID card on the back, six copies of the design of the trademark, and a trademark registration application with my signature are required. Another 1000 yuan will be paid to the Trademark Office, and no refund will be made regardless of whether it passes or not.
Waiting for the review of the Trademark Office. It usually takes 12-16 months to get results.
Publicity period. After passing the preliminary examination of the Trademark Office, it will enter the three month publicity period. Anyone who has any objection can raise it. If there is no objection, it can be successfully registered. If there is any objection, the trademark objection defense shall be conducted, and the registration can be successful after the defense is passed.
Publication of trademarks. After passing the publicity period, the Trademark Office will issue a document to announce that the trademark is successfully registered and can be used. At this time, the trademark is protected by law.
Whether it is an enterprise registered trademark or an individual registered trademark, relevant laws and regulations should be followed. The Trademark Office will not accept applications for personal names without individual licenses. Therefore, even if you have the best idea and brand, you must have a company to apply. If you don't have a company, at least you need a business license for self-employed businesses.
