Agency includes entrusted agency and legal agency. The entrusted agent shall exercise the power of agency according to the entrustment of the principal. The legal representative shall exercise the power of agency in accordance with the provisions of law.
If an agent fails to perform or does not fully perform his duties, thereby causing damage to the principal, he shall bear civil liability.
If the agent and the counterpart collude maliciously and damage the lawful rights and interests of the principal, the agent and the counterpart shall bear joint and several liability.
