    People with AIDS can be detained for crimes, but there is no clear regulation on how to detain people with AIDS at present. The detention measures for people with AIDS are the same as those for ordinary suspects.

    [Legal Basis]

    Article 10 of the Regulations on Detention Centers stipulates that prisoners in detention centers shall undergo physical examination and shall not be taken into custody under any of the following circumstances:

    (1) Suffering from mental illness or acute infectious disease;

    (2) If he suffers from other serious diseases, his life may be endangered or he cannot take care of himself in custody, except for those who are dangerous to society if he does not take custody because of the heinous crime;

    (3) A woman who is pregnant or breast-feeding her own baby under one year old.
