1. If the party responsible for the traffic accident is not liable for damages, the injured party may bring a civil action through the people's court.

If the person who is responsible for the traffic accident does not bear the responsibility for compensation for the damage and is mainly responsible for it, he shall be punished as a traffic accident crime: if he commits the traffic accident crime, he shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention;
