Compensation for traffic accidents is based on the proportion of liability determination. The traffic accident liability mainly includes: full liability, primary liability, equal liability, secondary liability and no liability. The corresponding proportion of liability for compensation is 100%, 60-90%, 50%, 10-40% and 0%.

 According to Article 73 of the Road Traffic Safety Law, the traffic management department of the public security organ shall, in accordance with the on-site inspection, inspection and investigation of the traffic accident and the relevant inspection and appraisal conclusions, timely prepare a traffic accident identification letter as evidence for handling the traffic accident. The letter of determination of traffic accidents shall state the basic facts of the traffic accidents, the causes of the traffic accidents and the responsibilities of the parties concerned, and shall be served on the parties concerned.
