    The divorce of one cheating party does not affect the property judgment, but divides the property according to the normal legal procedures. If one party has an affair, if it reaches the same level of bigamy or public illegality, the innocent party can claim damages.

    [Legal Basis]

    In Article 46 of the Marriage Law, if one of the following circumstances leads to divorce, the innocent party has the right to claim damages:

    (1) Bigamy;

    (2) The person with spouse cohabits with another person;

    (3) Domestic violence;

    (4) Maltreating or abandoning family members. (The Marriage Law will expire on December 31, 2020)

    Article 1091 of the Civil Code states that the faultless party shall have the right to claim damages if divorce is caused by any of the following circumstances:

    (1) Bigamy;

    (2) Cohabitation with others;

    (3) Domestic violence;

    (4) Abuse or abandon family members;

    (5) There are other major faults. (The effective date of the Civil Code is January 1, 2021)
