    Persons who have received criminal punishment may not be enlisted. Because citizens who have been subjected to criminal punishment, reeducation through labor, receiving education or administrative detention may not be enlisted for active service. Persons who have received criminal punishment are citizens who have received criminal punishment and may not be enlisted in the armed forces.

    [Legal Basis]

    Article 8 of the Provisions on the Political Review of Conscription stipulates that citizens in any of the following circumstances shall not be enlisted for active service

    (1) Spreading statements with political errors, writing, compiling, publishing or publishing articles or works with political errors.

    (2) Having been subjected to criminal punishment, reeducation through labor, receiving education or administrative detention;

    (3) Being investigated or handled, or being investigated, prosecuted or tried due to suspected violation of discipline or law;

    (4) Having been expelled from public office, ordered to resign, expelled from school, or expelled from the Party, stayed in the Party for inspection, or expelled from the League due to serious mistakes;

    (5) Having the sign of an underworld organization or criminal gang, damaging the image of the country, or damaging the tattoo of social morality;

    (6) Closely related to foreign and overseas personnel with complex political background, which is politically suspicious;

    (7) Those who have participated in evil cult organizations or activities, or have participated in harmful kung fu organizations or actively participated in activities;

    The main family members, direct dependents, main members of social relations or other relatives who have a greater influence on themselves are backbone members of cults or harmful kung fu organizations;

    (8) He or the main members of his or her family, or his or her direct dependents have participated in illegal organizations such as ethnic separatism, violent terrorism, religious extremism, or criminal gangs with underworld nature, or have conducted activities;

    The main members of social relations or other relatives who have great influence on themselves are the backbone members of the above-mentioned illegal organizations;

    (9) Major family members, direct dependents, major members of social relations or other relatives who have a greater impact on themselves, who have been criminally punished, expelled from the Party, expelled from public office or have serious violations of the law that have not yet been investigated, and who have words and deeds of shielding and retaliation;

    (10) The main family members have criminal acts endangering national security or serious political problems, and they cannot draw a clear line themselves;

    (11) Other circumstances that do not meet the political requirements for enlistment for active service.
