A criminal sentenced to death with a suspension of execution is executed in prison. If a criminal sentenced to death with a two-year suspension of execution does not commit an intentional crime during the period of suspension of execution of the death penalty and should have his sentence commuted upon expiration of the period of suspension of execution of the death penalty, the executing organ shall submit a written opinion to the Higher People's Court for a ruling;
 If a person intentionally commits a crime, the circumstances are flagrant, and it is verified that the death penalty should be executed, the Higher People's Court shall report to the Supreme People's Court for approval; If the death penalty is not executed for an intentional crime, the period of suspension of execution of the death penalty shall be recalculated and reported to the Supreme People's Court for the record.

 In Article 261 of the Criminal Procedure Law, the President of the Supreme People's Court shall sign and issue an order to execute the death penalty if the Supreme People's Court orders and approves the immediate execution of the death penalty.
