The fairness principle of judicial expertise is embodied in three aspects: procedural fairness, substantive fairness and the fairness of the subject of expertise.
[Legal Basis]
In Article 27 of the Several Provisions on Evidence in Civil Procedure, if a party objects to the appraisal conclusion made by the appraisal department entrusted by the people's court and applies for re appraisal, the people's court shall permit the party to submit evidence proving that one of the following circumstances exists:
(1) The appraisal institution or appraiser does not have the relevant qualification for appraisal;
(2) The appraisal procedure is seriously illegal;
(3) The expert conclusion is obviously based on insufficient evidence;
(4) Other circumstances that cannot be used as evidence after cross examination.
