The circumstances that can divorce an active serviceman include: the serviceman has a major fault; Both husband and wife reach an agreement to divorce; There is evidence that the relationship between the two has indeed broken down and the marriage relationship cannot continue. In general, the non military party shall obtain the consent of the military when it applies for divorce.

 Article 1081 of the Civil Code of the People's Republic of China
 The spouse of an active serviceman who wishes to divorce shall obtain the consent of the serviceman, except that the serviceman has a serious fault.
 Paragraph 3 of Article 1079
 Divorce shall be granted if mediation fails in any of the following circumstances:
 （1） Bigamy or cohabitation with others;
 （2） Domestic violence or maltreatment or desertion of family members;
 （3） Gambling, drug abuse and other bad habits persist in teaching;
 （4） Two years of separation due to emotional discord;
 （5） Other situations that lead to the breakdown of the relationship between husband and wife.
