 According to Chinese laws, the medical expenses that meet the standards of the basic medical insurance drug catalogue, diagnosis and treatment items, medical service facilities, and emergency and rescue shall be paid from the basic medical insurance fund in accordance with national regulations. The part of the medical expenses of the insured that should be paid by the basic medical insurance fund shall be settled directly by the social insurance agency, medical institutions and drug distributors. The administrative department of social insurance and the administrative department of health shall establish a settlement system for medical expenses of medical treatment in different places to facilitate the insured to enjoy basic medical insurance benefits. The staff and workers shall participate in the basic medical insurance for the staff and workers, and the employing unit and the staff and workers shall jointly pay the basic medical insurance premium according to the state regulations.
 Legal basis
 Article 23 of the Full Text of the Social Insurance Law of the People's Republic of China, employees shall participate in the basic medical insurance for employees, and the employer and employees shall jointly pay the basic medical insurance premium in accordance with national regulations.
 Individual businesses without employees, part-time employees who do not participate in the basic medical insurance for employees in the employing unit and other flexible employees can participate in the basic medical insurance for employees, and the basic medical insurance premiums shall be paid by individuals according to the state regulations.
 Article 28 of the Full Text of the Social Insurance Law of the People's Republic of China shall be paid from the basic medical insurance fund in accordance with the state regulations for medical expenses that meet the basic medical insurance drug catalogue, diagnosis and treatment items, medical service facilities standards, and emergency and rescue.
 Article 29 of the Full Text of the Social Insurance Law of the People's Republic of China, the part of the medical expenses of the insured that should be paid by the basic medical insurance fund shall be settled directly by the social insurance agency, medical institutions and drug distributors.
 The administrative department of social insurance and the administrative department of health shall establish a settlement system for medical expenses of medical treatment in different places to facilitate the insured to enjoy basic medical insurance benefits.
