There are the following provisions on alimony: 1. The payment standard of alimony: if there is a fixed income, it is generally 20% to 30% of its total monthly income. Those who bear the maintenance fees for two or more children may raise them appropriately, which generally shall not exceed 50% of their total monthly income. If there is no fixed income, it shall be determined according to the total income of the current year or the average income of the same industry with reference to the above proportion.
    2. The payment method of alimony: it shall be paid regularly, and it can be paid once if conditions permit. If one party has no economic income or is missing, his or her property may be used to offset maintenance fees.
    3. The payment period of alimony: generally until the child is 18 years old. If they are over 16 but under 18 years old, and their labor income is their main source of income, and they can maintain the general local living standard, they may stop paying maintenance fees.
    Legal basis:
Article 49 of the Interpretation of the Supreme People's Court on the Application of the Civil Code of the People's Republic of China Marriage and Family Part (I)
The amount of alimony may be determined according to the actual needs of the children, the affordability of both parents and the actual local living standard.
If there is a fixed income, alimony may generally be paid at the rate of 20 to 30 percent of the total monthly income. For those who bear the maintenance fees for two or more children, the proportion may be appropriately increased, but generally shall not exceed 50% of the total monthly income.
If there is no fixed income, the amount of alimony may be determined on the basis of the total income of the current year or the average income of the same industry, with reference to the above proportion.
Under special circumstances, the above proportion may be appropriately increased or reduced.
