    It is generally not allowed to sue a third party for breaking the marriage. However, if the mistress and her original husband have gone through the marriage registration procedures and there is relevant evidence to prove that the mistress has bigamy, they can report the case to the public security organ and the People's Procuratorate will initiate a public prosecution. Generally, the court will sentence a junior who commits bigamy to fixed-term imprisonment of not more than two years or criminal detention.
    Legal basis:
    Article 1042 of the Civil Code of the People's Republic of China
    Arranging marriages, buying and selling marriages and other acts that interfere with the freedom of marriage are prohibited. It is forbidden to ask for property through marriage.
    Bigamy is prohibited. Persons with spouses are prohibited from cohabiting with others.
    Domestic violence is prohibited. Abuse and abandonment among family members are prohibited.
