In the case of divorce between the natural father and stepmother, or between the natural mother and stepfather, minor children are generally raised by the natural father or mother. However, if a stepfather or stepmother has ever supported and educated him, he may continue to be supported by his stepfather or stepmother with his consent.
    Legal basis:
Article 54 of the Interpretation of the Supreme People's Court on the Application of the Civil Code of the People's Republic of China Marriage and Family Part (I)
When the natural father and stepmother divorce or the natural mother and stepfather divorce, if the stepfather or stepmother does not agree to continue to support the stepchildren who have received their upbringing and education, they shall still be supported by the natural father or stepmother.
    Article 1072
No maltreatment or discrimination shall be allowed between step parents and step children.
The provisions of this Law on the relationship between parents and children shall apply to the rights and obligations between the stepfather or stepmother and the stepchildren who are supported and educated by them.
