There are two common types of houses with small property rights: one is built on the collective construction land, that is, the houses built on the "homestead" are only owned by the collective in the rural area, and even farmers in other villages can't buy the houses; the second is built on the collective enterprise land or occupied farmland illegally.
 Such properties do not have the land use permit and pre-sale permit issued by the state, and the purchase contract will not be filed with the Land, Land and Housing Administration Bureau. There is no legal and valid property right certificate.
 The property rights of small property houses are incomplete, and a series of problems and disputes are likely to occur in the process of the sale and transfer of small property houses. Therefore, generally, small property houses are not allowed to be sold, but they can be traded within the collective members when they are determined to sell. The transaction of houses with small property rights is generally paid off in a lump sum, and mortgage loans cannot be handled. Since the purchased house with small property rights is not recognized and protected by law, and has not been approved by the national real estate authority, legal property rights procedures cannot be handled, nor can it be legally transferred after purchase. At the same time, it also has a great impact on the value maintenance and appreciation of houses.

 The right to the use of land collectively owned by farmers may not be assigned, transferred or leased for non-agricultural construction, except for enterprises that conform to the general plan for land use and legally acquire land for construction, where the right to the use of land is transferred according to law due to bankruptcy, merger and other circumstances.
