If parents or guardians are unable to support their children and choose to send their children out to others, they should also go through the relevant legal procedures. Children cannot be sent out privately. Otherwise, if the circumstances are serious, it will constitute the crime of abducting and selling children, and they will be sentenced to at least five years' imprisonment. The parents have special difficulties and are unable to support their children. Raising minor children is the legal obligation of both parents. In general, as long as one of the parents has the ability to support, it is not allowed to transfer the obligation of raising children through placement for adoption. Even if the parent is unable to support the child, he or she has no right to exempt the parent who has the ability to support him or her from the obligation of supporting him or her and send the child to another person for adoption.

 Article 1094 of the Civil Code of the People's Republic of China [Scope of the person placing out the child for adoption] The following individuals and organizations may be persons placing out the child for adoption:
 （1） Guardians of orphans;
 （2） Child welfare institutions;
 （3） Parents who have special difficulties and are unable to support their children.
