Legal facts can be classified according to different standards. (1) Legal facts are generally divided into legal events and legal acts. (2) According to whether the emergence of legal relations requires the existence or non existence of a certain phenomenon, legal facts can be divided into positive legal facts and negative legal facts. (4) From the perspective of whether judges need to identify the facts, legal facts can be divided into identified facts and non identified facts.
Legal basis
Article 2 of the Constitution of the People's Republic of China All power in the People's Republic of China belongs to the people. The organs through which the people exercise state power are the National People's Congress and local people's congresses at various levels. The people manage state affairs, economic and cultural undertakings and social affairs through various channels and forms in accordance with the law. Article 3 The State organs of the People's Republic of China follow the principle of democratic centralism. The National People's Congress and local people's congresses at various levels are democratically elected, accountable to the people and subject to their supervision. The administrative, supervisory, judicial and procuratorial organs of the state are all created by the people's congress, responsible to it and subject to its supervision. The division of the functions and powers of the central and local state organs follows the principle of giving full play to the initiative and enthusiasm of local governments under the unified leadership of the central government.
