 Either husband or wife can apply for divorce. Divorce should also consider property division and child rearing
 If there is no joint property of husband and wife, there is no need to divide the property. If there is no bigamy; Cohabitation of a married person with another person; Domestic violence; In case of maltreatment and abandonment of family members, no compensation is required.
 For children under the age of 2, the general custody right is mostly awarded to women.

 The first and second paragraphs of Article 32 provide that if one of the men and women requests divorce, the relevant departments may mediate or directly file a divorce lawsuit with the people's court. When hearing a divorce case, the people's court shall conduct mediation. If the feelings have really broken down and the mediation is ineffective, divorce shall be granted.
