The public security organ requests the procuratorate to review and approve the arrest. After the arrest, the investigation and detention shall not exceed two months. After the public security organ completes the investigation, it shall transfer the case to the procuratorate for prosecution or not. The procuratorate shall make a decision within one month (which can be extended for half a month), and then the procuratorate shall file a public prosecution to the court. The court usually pronounces the sentence within two months, but not more than three months at the latest. Finally, the judgment was pronounced, and the appeal against the judgment was made within 10 days, and then the second instance was started. This is the end of the sentence.

In Article 115 of the Criminal Procedure Law, the public security organ shall investigate a criminal case that has been filed, collect and obtain evidence that the criminal suspect is guilty or not guilty, or that the crime is minor or serious. An active criminal or a major suspect may be detained first according to law, and a criminal suspect who meets the conditions for arrest shall be arrested according to law.
