1. According to Article 32 of the Marriage Law
 The second and third paragraphs stipulate: "The people's court shall conduct mediation in the trial of divorce cases; if the feelings have really broken down and mediation is invalid, divorce shall be granted
 1、 If mediation fails, divorce shall be granted: (1) bigamy or cohabitation of a person with a spouse; (2) Committing domestic violence or maltreating or abandoning family members; (3) Those who have bad habits such as gambling and drug abuse and refuse to change after repeated education; (4) Separated for two years due to emotional discord; (5) Other circumstances that lead to the breakdown of the relationship between husband and wife. " 2. According to the above legal provisions, separation for two years also requires: (1) separation emphasizes that both husband and wife do not perform their obligations to each other, rather than unilaterally failing to perform their family obligations; (2) The reason for separation must be emotional breakdown and separation; (3) Separated for two years due to emotional breakdown, but no reconciliation is possible after mediation. Divorce can only be granted if the above conditions are met.
