When expropriating the houses of units and individuals on state-owned land, fair compensation shall be given to the owners of the houses expropriated. The compensation for the value of the houses to be expropriated shall not be lower than the market price of similar real estate of the houses to be expropriated on the date of the announcement of the decision on house expropriation. According to the legislative spirit, the compensation for the expropriated housing should refer to the price of the new commercial housing in the nearest location, so that the living conditions and quality of life of the expropriated person do not decrease after the housing is expropriated.

Article 2 of the Regulations on the Expropriation and Compensation of Houses on State owned Land, in order to meet the needs of public interests, the owner of the houses expropriated (hereinafter referred to as the expropriated person) shall be compensated fairly when the houses of units and individuals on State owned land are expropriated.
Article 19 The compensation for the value of the houses to be expropriated shall not be lower than the market price of similar real estate of the houses to be expropriated on the date of the announcement of the decision on house expropriation. The value of the houses to be expropriated shall be evaluated and determined by the real estate price evaluation agency with corresponding qualifications in accordance with the housing expropriation evaluation methods.
If there is any objection to the value of the house expropriated determined by the appraisal, it may apply to the real estate price appraisal agency for reexamination and appraisal. If there is any objection to the review result, it can apply to the Real Estate Price Evaluation Expert Committee for appraisal.
The measures for the assessment of housing expropriation shall be formulated by the competent department of housing and urban and rural construction under the State Council. In the process of formulation, public opinions shall be solicited from the public.
