 3. The punishment age of the main element is different, and the person who is 14 years old but not 16 years old can constitute the crime of arson; Those who have reached the age of 16 for the crime of fire shall bear criminal responsibility.
 4. The form of subjective sin is different: the crime of arson consists of intention, while the crime of fire is due to negligence. This is the fundamental difference between the nature of the two crimes.
