What clauses should a labor contract contain? A labor contract is an agreement between a worker and an employer that establishes a labor relationship and defines the rights and obligations of both parties. The conclusion and modification of labor contracts shall follow the principles of equality, voluntariness and consensus through consultation, and shall not violate the provisions of laws and administrative regulations. A labor contract is legally binding once it is concluded in accordance with the law, and the parties must perform their obligations under the labor contract.
    The first paragraph of Article 17 of the Labor Contract Law stipulates that a labor contract shall contain the following provisions: (1) the name, domicile and legal representative or principal person in charge of the employer; (2) The name, address and resident identity card or other valid certificate number of the worker; (3) Term of labor contract; (4) Work content and location; (5) Working hours, rest and vacation; (6) Labor remuneration; (7) Social insurance; (8) Labor protection, working conditions and occupational hazard protection; (9) Other matters required by laws and regulations to be included in the labor contract. This provision is formed by adding specific items on the basis of the provisions of the Labor Law.
    The necessary provisions of the labor contract stipulated in the Labor Law include seven items: the term of the labor contract, the content of work, labor protection and working conditions, labor remuneration, labor discipline, conditions for termination of the labor contract, and liability for breach of the labor contract.
    The current provisions of the Labor Contract Law are nine. By comparing the two, it can be found that the added items include: the name and address of the employer and the legal representative or main person in charge, the name and address of the worker and the number of the resident ID card or other valid documents, the workplace, working hours, rest and vacation, occupational hazard protection, and social insurance; The labor discipline, conditions for termination of labor contracts and responsibilities for violation of labor contracts have been reduced. It can be said that the provisions of the Labor Contract Law are more detailed and specific.

    Legal basis

    Article 17 [Contents of Labor Contract] of the Labor Contract Law of the People's Republic of China (2012 Revision) shall contain the following clauses:
    (1) The name, address, legal representative or principal person in charge of the employer;
    (2) The name, address and resident ID card or other valid ID card number of the worker;
    (3) Term of labor contract;
    (4) Work content and location;
    (5) Working hours, rest and vacation;
    (6) Labor remuneration;
    (7) Social insurance;
    (8) Labor protection, working conditions and occupational hazard protection;
    (9) Other matters required by laws and regulations to be included in the labor contract.
    In addition to the necessary clauses specified in the preceding paragraph, the employer and the employee may agree on other matters such as probation period, training, confidentiality, supplementary insurance, welfare benefits, etc.
