According to the provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security and the Trial Measures for Reeducation through Labor forwarded by the State Council, the scope of application of Reeducation through labor is those criminals who have committed illegal and criminal acts, but do not need to be punished, and who have been given too little punishment for public security administration. Reeducation through labor is not a criminal punishment, so the divorce of reeducation through labor personnel should be the same as that of ordinary citizens. The difference is that the reeducation through labor personnel should first apply to the reeducation through labor administration organ where they are located, and then go through the divorce registration procedures after being approved by the reeducation through labor administration committee.
 2、 Conditions for divorce by agreement According to the relevant provisions of the Marriage Registration Regulations, the following five conditions must be met for divorce by agreement:
 (1) Both men and women who divorce by agreement must have legal marital status
 (2) Both parties must be persons with full civil capacity
 (3) Both husband and wife are indeed willing to divorce
 (4) The problems of children and property have been properly handled
 (5) Both parties must register for divorce at the marriage registration office. According to the Marriage Law of the People's Republic of China (hereinafter referred to as the Marriage Law) and relevant regulations, the divorce can only be dissolved in two ways: the first is divorce by agreement; The second is litigation divorce. There is no legal basis for the saying that the marriage relationship is automatically dissolved after separation for a period of time. Divorce by agreement refers to the divorce mode in which both men and women voluntarily dissolve the marriage relationship, reach an agreement on the legal issues related to divorce, and make the marriage relationship disappear after the approval of the marriage registration authority of the Civil Affairs Bureau. Agreed divorce is the most economical and fastest way to divorce. According to the current Marriage Registration Ordinance (hereinafter referred to as the Registration Ordinance), as long as both parties have reached a consensus on issues related to agreed divorce, the marriage registration authority of the Civil Affairs Bureau can handle it on the spot, and both parties will legally dissolve the marriage relationship.
