    The detention for the crime of provocation and trouble making is generally 10 days, with a maximum of 37 days. The crime of provoking trouble is a criminal case, which needs to follow the procedures prescribed by law. If the public security organ believes that criminal responsibility should be investigated after investigation, it will transfer the case and materials to the procuratorate, which will review and decide whether to initiate a public prosecution in the court.

    Legal basis:

    Article 293 of the Criminal Law of the People's Republic of China shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance if he commits one of the following acts of provoking trouble and disrupting public order:
    (1) Beating others at will, to a flagrant extent;
    (2) Chasing, intercepting, abusing or intimidating others to a flagrant extent;
    (3) Forcibly taking or demanding or arbitrarily damaging or occupying public or private property, to a flagrant extent;
    (4) Make troubles in public places. Causing serious disorder in public places. Whoever gathers others to commit the acts mentioned in the preceding paragraph for many times, thus seriously disrupting public order, shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and may also be fined.
