    Premarital property is a legal term. It refers to the property acquired by one spouse before marriage. The premarital property of one spouse, whether movable or immovable, tangible or intangible, will be protected by law as long as it is legally obtained. According to the provisions of Article 19 of the Marriage Law of the People's Republic of China, the husband and wife may agree that the property acquired during the marriage relationship and the pre marital property shall belong to their own ownership, joint ownership, or part of their own ownership, part of their joint ownership. The agreement shall be in writing. It is suggested that both parties sign a prenuptial property agreement for remarriage.
    The prenuptial property agreement shall generally include the following contents:
    1. The name, gender, occupation, address and other basic information of the party concerned;
    2. The name, quantity, type, price method, status, etc. of the scope (including debts) of premarital property shall be listed in detail for each party's premarital property.
    3. The ownership of the above premarital property rights, to which party the premarital property rights of both men and women belong, and how to use them, etc.
    4. Property before marriage and income after marriage.
    5. The ownership of income generated from the disposition of premarital property after marriage.
    6. The principle of use, maintenance and disposal of premarital property;
    7. Other matters that should be agreed, such as the agreement on how to pay off the debts before marriage.
    8. The conditions and time for the effectiveness of the prenuptial property agreement.
    9. Signed by both men and women.
    10. Date of signing the property before marriage.
    Article 18 of the Marriage Law of the People's Republic of China
    Under any of the following circumstances, it shall be the property of the husband and wife:
    (1) Premarital property of one party;
    (2) Medical expenses, living allowance for the disabled and other expenses received by one party due to physical injury;
    (3) The property determined in the will or gift contract to belong to the husband or wife only;
    (4) Daily necessities for one party;
    (5) Other property that should belong to one party.
