In fact, a foster relationship has been formed between the stepparents and their stepchildren receiving their upbringing and education, that is, a situation similar to the simulated kinship. The relevant provisions of the Marriage Law on the relationship between parents and children shall apply to the rights and obligations between the stepfather or stepmother and the stepchildren they support, that is, the stepparents and children have the right to inherit property from each other.
According to the provisions of Article 10 of the Inheritance Law of China, the first order of inheritance is spouse, children, children mentioned by parents, including parents who have legitimate children, children born out of wedlock, adopted children and stepchildren with foster relationships, including biological parents, foster parents and stepparents with foster relationships. Where a stepchild inherits the estate of his or her stepparents, it shall not affect his or her inheritance of the estate of his or her natural parents, nor shall it affect his or her inheritance of the estate of his or her natural children.
